GUILTY NY - Dr. Mary Yoder, 60, fatally poisoned, Whitesboro, 22 July 2015 #2

Wow! Just got home and hurried to check...I was sure I would see hung jury, but at least they found her guilty of something! I still think if they thought the evidence showed manslaughter, it showed that it was murder. But, maybe they thought that she didn't intend to kill her? Just gave her too much? I don't think so. Maybe it was a compromise in order to satisfy everybody on the jury. (Though I know they're not supposed to do that--it does happen.) I hope the judge considers the totality of the evidence and gives her the maximum!:jail:

:tyou:....Thanks Niner and Harmony for all your hard work.

My thoughts are with Dr. Mary Yoder tonight- RIP...:candle:...

... at least the jurors found Conley GUILTY of something (although I didn't understand how they didn't say guilty of 1st degree murder because it looked like, to me, premeditation was there - most definitely. :sheesh:

Haven't had the time to get up to speed but so glad to see a GUILTY verdict in the thread title! I did not expect anything to happen today tbh, I thought they would deliberate for a couple more days.

Now back to reading. Thanks in advance to Niner and Harmony for updating the thread every day throughout this very interesting trial.

Thank You Niner and Harmony for all your hard work.
I wasn't able to follow this second trial like I did the first one, and so I really appreciated your posts and updates.

Manslaughter 1st - I guess it's better than nothing. Hopefully, she'll
get the maximum sentence.

Thank you Niner and Harmony for bringing this to us.

She was only charged with 2nd degree murder - so no guilty on 1st degree.

Will she go for an appeal?

according to this:

Defense arguing against. Says substantial likelihood of success on appeal.

I assume defense is going to appeal. This statement was said after Judge revoked her "house arrest".

I agree with you all - at least jurors found her guilty on Manslaughter!

Harmony - hopefully you are taking care of your foot! Take it easy!!

Wow, wonderful news!! I've missed alot--I need to go back and catch up properly! Thanks for all the tweets and updates, much appreciated.

EDIT: All caught up :D

Harmony ouch...maybe slow down a little ma'am--rest up and take it easy for a few days! :seeya:

2nd degree in NY is like 1st degree in other states...I for some reason can’t paste my link explaining it LOL...

I agree. I believe 1st degree in N.Y. is reserved for police, prison guards, firemen. Possibly killing while committing a felony.

Yes you are right for some reason I couldn’t get my other link to paste, but this one seems to work. It talks about New York:

http://www.funtrivia.com/askft/Question117986.html

It says this:

The second scheme, used by New York among other states:

First Degree Murder: Murder involving special circumstances, such as murder of a police officer, judge, fireman or witness to a crime; multiple murders; and torture or especially heinous murders. Note that a "regular" premeditated murder, absent such special circumstances, is not a first-degree murder; murders by poison or "lying in wait" are not per se first-degree murders. First degree murder is pre-meditated.[6] However, the New York Court of Appeals struck down the death penalty as unconstitutional in the case of People v. LaValle, because of the statute's direction on how the jury was to be instructed in case of deadlock in the penalty phase.

Second Degree Murder: Any premeditated murder or felony murder that does not involve special circumstances.[7]
Schemes similar to Pennsylvania's are used in California and Massachusetts. A scheme similar to New York's is used in Texas, but first degree murder is called "capital murder".

If you are wondering what the split was before they came back with a guilty verdict - I found this article:

http://wibx950.com/exclusive-defense-attorney-policelli-breaks-down-kaitlyn-conley-verdict/

The retrial of Kaitlyn Conley ended in a conviction later Monday, November 6th, after jurors came back with a message for the judge claiming they were 'hung' by a margin of 10-2. The judge gave jurors the Allen Charge and sent them back to deliberate. Two hours later, the jury sent a message to the court that they had reached a verdict

She will be sentenced on January 11th

See you then! :seeya:

BBM Thank You. I don't want to forget the date. I want to hear Kaitlyn gets a long sentence and doesn't ever wiggle out of the consequences of her actions. Sadly, IMO, she has caused so much suffering and loss.

My thoughts and prayers go out to Dr. Mary, may she rest in peace and find joy on the other side.

That's exactly what I thought, one or two who didn't agree but came round pretty quickly. Thanks Niner for posting!

The Dateline special on now is called "POISONED".

It's too real, and brings tears to my eyes, to see all the players in this case we've followed being interviewed and telling how the tragedy unfolded.

Yuck, Kaitlyn putting her "innocent" spin on it is hard to watch knowing what we know now.

Not knowing anything about this case or even hearing of it I watched the 2 hr Dateline. On Caitlyn's interview portions I immediately picked up some "Duper's Delight" signs, little micro expressions. Even before I knew she had been arrested and was facing trial I thought something about her was off. She was leaking out, as they say, in her expressions and mannerisms. At least to my untrained eyes.

So I'm not surprised to learn she was behind the poisoning, but what's still not really clear is why she needed to poison Doc Yoder to get the son's attention. She had his attention and was willing to have sex with him, and did. That's more potent than any 'poison.'

This was a really good dateline! I got to know Mary, and really felt the daughters
pain/loss. But I'm shocked that Mary' sisters were on KC' side and blame Mary' husband, Bill for Mary' death. They even sat on the defense side of court room, and commiserated w/her, relating KC to their own daughters! Yuck!

IMO, KC killed Mary, because she enjoyed it!
