GUILTY NY - Dr. Mary Yoder, 60, fatally poisoned, Whitesboro, 22 July 2015 #2

This was a really good dateline! I got to know Mary, and really felt the daughters
pain/loss. But I'm shocked that Mary' sisters were on KC' side and blame Mary' husband, Bill for Mary' death. They even sat on the defense side of court room, and commiserated w/her, relating KC to their own daughters! Yuck!

IMO, KC killed Mary, because she enjoyed it!
During the trial one of the sisters was admonished by the Judge for speaking out during testimony. A day or two later one or possibly the same sister was removed from the courtroom for speaking out. They really seem to have it out for Mary's husband. Even one of their sons switched sides after the first trial. I was not impressed with them after watching dateline.

I just watched Dateline's presentation of this case, 60 yr old chiropractor poisoned, last night. I was surprised and perplexed by several facets. The defendant K Conley admitted to writing the anonymous letter to the police, essentially "framing" the son. Also there is uncontested evidence of ordering colchicine over internet. In the prior mistrial proceedings the defense offered the theory that the husband did it; whereas during the most recent trial the defense offered the theory that the son did it. I am perplexed by how each of these defenses/ theories account for the letter and Conley's admission to writing it. Any theory of murder by someone other than K Conley, it seems to me, must explain this letter away. Similarly I am dumbfounded that DA/prosecution filed a charge of 2nd degree murder. By what theory could a 2nd degree murder be prosecuted. The letter, the lengthy interrogation tapes, the computer forensics strongly imply premeditation. I could see a defense stating the death was unintended and hence an "accident" but such a position stretches credulity. In addition I will grant the prosecution's theory of motive is somewhat convoluted but based on what I saw, makes perverse sense. I suspect that K Conley is somewhat of a "whack job" - but that characterization can easily be deconstructed by a good defense attorney. Finally I find it "interesting" that the victims sisters sided with the defendant despite pretty impressive body of evidence pointing to her guilt. This phenomenon speaks to interpersonal relationships and family dynamics vis a vis the husband the other "rogue sister". And then to the point that the 2 juries tilted towards split decisions/ hung jury- I suppose the defendant presented herself as this innocent, demure, delicate flower, utterly incapable of homicide. I found her persona in the TV interviews prior to the verdicts a nice piece of theatrics. Her appearance demeanor and thespian capability coupled with a really savvy defense attorney team would make the case for murder a real challenge

I addressed this point in my recent post. Family dynamics and the formation/ foundation of beliefs regarding guilt or innocence require complex cognitive processes not the least of which is the exercise of "logic" "inference" "evidence/ truth/ facts" and weighing those elements. To what extent subconscious factors - bias, prejudice, moral preferences, - play important roles is always open to speculation. The family sisters, I suspect, developed a deep level hatred for the husband for whatever reasons plus a "distaste" for the "rogue sister" who was bedding the husband caused them all to side with K Conley. When I was first told about this case I thought the husband did it - out of common sense. Indeed had Jose Baez, Casey Anthony fame, been on the case the husband probably would have been hung drawn and quartered.
 
2nd degree is premeditation in NY. 1st is reserved for police officers and some other stuff I can’t remember.

I too had a hard time watching Mary’s family support her killer. I thought they did a good job, but us here know so much more from each trial. Wish that had been covered more. I get they can’t fit it all in though and overall they did a good job.

The Dateline episode was so-so, I've never been a big fan of Andrea Canning so maybe that comes into play with how I feel about the coverage.

Here's my problem with the prosecution and their arguments. They say Kaitlyn Conley's motive for killing Mary Yoder was to get Adam Yoder back together with her but she was the one who broke up with him in the first place because he was unstable according to the Conley sisters so why would she suddenly want him back and how exactly would he go back to her if she killed his own mother? Either someone is playing doubt or it's not an act.

*Sentencing (@ am ET) - NY - Dr. Mary Louise Yoder (60), poisoned (July 22, 2015) - Kaitlyn "Katie" Conley (23) charged with 2nd degree murder (poisoning her boss) (for Jurors murder or manslaughter; Dismissed charges: 2 counts of 1st degree falsifying business records, 2nd degree forgery & 2 counts Misdemeanor petit larceny);pled not guilty/Free on House arrest. Trial should last at least 3 weeks or more//into 4th week. First trial in April ended in a hung jury: 8-4 for acquittal.
Monday 11/6 update: Jury came back after lunch & about 3 hours of deliberations and said they were hung/deadlocked. Judge gave them the Allen charge. Sent them back to deliberate. Came back at 3:15pm local time - 2nd degree Murder - Not guilty; 1st degree Manslaughter - Guilty; sentencing Jan. 11, 2018/Bail revoked!

Don't know "what time" this starts, but I'll keep the tweet pages open and will post when something appears!

Policelli - “The jury’s verdict is completely irrational.:

ADA Michael Coluzza argues against setting aside the verdict. He is going through several facts presented during the case saying the “evidence is overwhelming.”

The court believes there was sufficient proof favorable to the people and has denied the defense’s request.

Hegde says her mother’s killer had taken care of her children. “We were in full panic mode.” They were afraid someone else in their family would die.

Hegde says Conley was in the hospital when Mary died - “no remorse” - “she wanted to watch it happen.”

“This is not someone who was concerned at any time for what happened to my mother.” - asks judge to give Conley max sentence.

William Yoder now speaks. “She was my wife, my life partner, my soulmate.”

William Yoder talks about the woman his wife was - they were still deeply in love - says she was like an angel.

Mary and Bill were planning a grand vacation to Europe - “All of those exciting dreams and plans were ripped out of our hands.”

Bill says he doesn’t know what her sentence should be, but says at least 25 more years were taken from Mary, so maybe that’s a just punishment.

Bill: We had to watch her die time and time again, says Conley just sat there letting it happen.

Bill: Mary loved Katie like she was her own daughter, but says he never saw Katie shed a tear over Mary’s death.

Bill: Adam has been the target of a slanderous campaign the last two years - there was no evidence against him.

Bill says he doesn’t know if Adam will speak today, because he’s worried his words will be twisted once again. Bill says he supports Adam no matter his choice.

Bill says if people saw Conley during the trial, they wouldn’t think she was sweet at all... she somehow found Mary’s death funny or amusing.

Conley family shakes their head at Bill Yoder’s statement.
