GUILTY NY - Dr. Mary Yoder, 60, fatally poisoned, Whitesboro, 22 July 2015 #2

It's possible she may not be retried.
It's important to understand how it happened that Conley was let out of prison for the time being. It's possible the Prosecution will decide there isn't enough evidence without that supplied by Conley's very own phone.

That particular evidence pulled from Conley's phone was deemed unusable by an Appellate Court because it could've been successfully suppressed by her first trial attorney.

Last month the Appeals Court decided that phone evidence is now deemed unusable. Conley is out of prison while the Prosecution weighs whether there's a convictable case without that evidence.

Carville said his staff is deciding whether to present the case to another grand jury. Their office is evaluating what evidence would be admissible in light of the recent appellate court decision.

Based on the appeals court decision,
it is possible that evidence pulled from Conley’s phone, which was crucial to the prosecution case, won’t be usable.

Hopefully, there will be a decision whether to retry or not within the 45 days they were arguing about, but there's no timetable on this. I know we're all eager to know what is decided.

When asked what his office’s next step is, Carville said it will be meeting to reevaluate all of the evidence in light of the Appellate Division’s decision and decide whether or not there was enough viable evidence.

When asked, Carville said there was no timetable for when this would happen, but that it wouldn’t be in the immediate future, if at all. 😲

“We need to reexamine the evidence first,” he said.

Carville doesn't seem too willing to retry her, for some reason. What happened to the original prosecutors in the case? I know McNamara retired but what about the rest?

Is this the same episode as the one that was aired in 2018 during the trial?

Probably. I thought the Dateline episode was probably one I saw before, so I didn't watch it to see if they gave any updates concerning Conley being released from prison for now.

After two murder trials and a conviction, woman accused of poisoning her boss awaits news of whether she'll be tried again

If there aren't any updates as of March 2025, the 2018 episode seems rather useless now. Based on the sneak peek, it's just a replay of the episode from 2018.

Just watched the Dateline episode. It seems pretty obvious she was guilty and it makes me sick when defense attorneys are all happy when they get someone off on a technicality.

I did not follow the Yoder case at all, but just saw M. William Phelps' book*

"We Thought We Knew You: A Terrifying True Story of Secrets, Betrayal, Deception, and Murder"
then noticed, book was released in 2020.

Anybody read this book???

From this review ---
"unravels a twisting trail of evidence to reveal the heartless scheme that tore a family apart, divided a community, and culminated in two gripping, high-profile trials."
--- it covers both trials, so it would just be missing the update about the appellate decision

Kindle version px is only $7.07, so I guess I'll Buy Now with 1-Click.

I thought it was a good book. I think I recommend it anywhere I post about this case.
