Judge Dwyer is charging the jury. #ConleyRetrial



Judge says jury must consider only 2 charges - murder 2nd and manslaughter 1st. #ConleyRetrial

Judge on murder 2nd - Intent to cause death of another person - intent means conscious objective or purpose

Judge on manslaughter 1st - intent to cause serious physical injury.

Conley can not be found guilty of both murder & manslaughter.

Judge tells jury they must not consider any possible punishment, that is up to the court alone to decide.

Judge: Verdict must be unanimous.

Three court attendants are sworn in before jury begins deliberations.

Judge tells jury that may request to leave for the day if they decide they don’t want to begin deliberations until tomorrow.

Jury will return tomorrow at 9:30am to continue deliberations

This is a much stronger case than the first one, IMO. I see a guilty verdict coming down.

Back in Oneida County court as the jury begins their deliberations in the Kaitlyn #ConleyRetrial. They started at 9:30am.

I don't know!! I didn't follow the first one here. :dunno: It was 8-4 for acquittal !

Yoder family and Conley’s parents are here in the courtroom - Attorneys are in the back with the judge - Conley is in the hallway.

Surely not a verdict already! But, like I said, it wouldn't take me long. If they took a first vote, and were all in agreement, is there any need to deliberate? Would that be cause for a mistrial? I was on a jury once in which that happened, but we just kinda chatted for a little while, so it wouldn't be so obvious. lol...There was NO doubt of the guilt though. Don't even know why it was brought to court. It was for assault, not murder.
