5K run held in honor of toddler who died in Mamaroneck
NEW ROCHELLE -

A 5K run was held Saturday in honor of a toddler who was found dead in a home in Mamaroneck in April.

Gabriella Boyd was 2 years old when she died in April.

The runners of the 5K are supporting the newly created Gabriella Boyd Foundation.

Gabriella's uncle says that the foundation is for custody advocacy.

On April 27, Gabriella was at the home of her mother, Cynthia Arce, on Chestnut Avenue in Mamaroneck. Gabriella's father, Stephen Boyd, had received a court order giving him physical custody of Gabriella.

Gabriella Boyd: Mamaroneck toddler's death ruled a homicide

The death of Mamaroneck toddler Gabriella Boyd has been ruled a homicide, the
attorney for the girl's father confirmed Wednesday.

Martin Rosen, who represents Stephen Boyd, said he has not been given a copy of the girl's autopsy following her death on April 28, but was told the results by prosecutors.
"I don't know the details, but Stephen will get it and then I'll know all the details,"
Rosen said. "I know the basics. It was ruled a homicide. The cause of death is
undetermined. That's very common when it deals with children."

It was unclear why the autopsy took more than four months after the girl's death.

The district attorney's office, which has refused to comment on the autopsy,
confirmed the results in a statement after The Journal News/lohud published this report.

"The DA’s office position is it is up to the family whether or not the autopsy findings will be made public," the statement said. "The autopsy will be presented to the Grand Jury. Since this is an ongoing investigation, there will be no further information from the District Attorney’s Office."

Cynthia Arce's lawyer: Postpartum depression could have led to Gabriella Boyd's killing in Mamaroneck

The death of 2-year-old Gabriella Boyd "was not an intentional homicide" as the child's mother was bipolar and could have suffered from post-partum depression, her lawyer said Wednesday.

Portale's comments came hours after the Westchester District Attorney's Office confirmed that Gabriella's death in late April was a homicide of undetermined cause.

While not discussing what might have happened to Gabriella, Portale conceded that his client caused the girl's death but that he would pursue a psychiatric defense that she was not criminally responsible for her actions that day.

"By definition, undetermined doesn't tell us anything other than they don't know for sure," Portale said. "But this isn't about who caused Gabriella's death. This is about the fact that her mother suffered from either an acute psychotic break or acute post-partum psychosis. And that's so sad."

Prosecutors are expected to present the case to a grand jury this month and seek an indictment for the attack on the police and homicide charges connected to Gabriella's death.

The dates of the incidents are before April 28 and this persons birth year is 1973, so I don’t think it’s the same person.

Mamaroneck woman charged with murder in daughter's death

Cynthia Arce, 29, was charged with second-degree murder in an indictment handed up by a Westchester grand jury on Wednesday. The indictment offers no details on how Gabriella Boyd was killed but accuses Arce of doing so intentionally.

Her arraignment in Westchester County Court has not yet been scheduled. That will be her first court appearance in the case. She was arraigned in her hospital room following her arrest and was not well enough to appear in Village Court the two times the case was called there in May.

Cynthia Arce of Mamaroneck Indicted for the Murder of Her Baby Daughter

The Westchester Grand Jury indicted Arce on one count of Murder in the Second Degree, a class A felony, in the death of Gabriella Boyd.

In the attack on the two police officers she faces the following charges:

  • Two counts of Attempted Aggravated Murder, class A felonies
  • Two counts of Attempted Aggravated Assault upon a Police Officer, class C felonies
  • Two counts of Assault in the Second Degree, class D felonies

Cynthia Arce left 'joining the angels' note near her dying daughter: autopsy

Notes were found in the Mamaroneck home suggesting she would be joining the angels. And her mother, Cynthia Arce, was bleeding in a bathtub overflowing with water, with another note saying she would now be with Gabriella.

Those details were revealed for the first time in Gabriella’s autopsy report obtained by The Journal News/lohud.

Arce, 29, was arraigned in Westchester County Court on Tuesday, with her lawyer entering a not guilty plea on her behalf to charges that include second-degree murder in Gabriella's death April 28 and aggravated attempted murder for allegedly attacking two police officers with knives as they tried to save her daughter.

Her mother was in the gallery as was Gabriella's father, Stephen Boyd, and several of his relatives and friends.

When defense lawyer Richard Portale said he would need time to gather medical records before making what he expects will be a motion for a psychiatric defense, Boyd yelled out from the front row, "I've been waiting five months."

Westchester County Judge George Fufidio admonished Boyd to maintain decorum. Afterwards, Portale said he wasn't taking issue with the brief outburst.

"He's a grieving dad," said Portale, who also described the past months as "a very sobering experience" for his client.

The autopsy did not determine a cause of death and found no signs of trauma. But the Medical Examiner’s Office ruled Gabriella’s death a homicide, finding that the notes in the house and the circumstances indicated “the death occurred by someone else’s actions.”

The murder charge accuses Arce of intentionally killing her daughter but prosecutors have not yet revealed how they believe she did it.
