*Prelim Hearing (@ ET) – NY – Gabriella Maria Boyd (2) (April 28, 2018, Mamaroneck) – *Cynthia P. Arce (28) “mom” arrested (4/20/18) & charged & indicted (9/12/18) & arraigned (9/17/18) 2nd degree murder (Class A felony), charged (4/30/18) with 2 counts of attempted aggravated murder of 2 police officers (Class A felony), 2 counts of attempted aggravated assault on 2 police officers (Class C felony) & 2 counts of 2nd degree assault (Class D felony). Plead not guilty. No bond.
Two LE were trying save her baby. Arce was in intensive care at Westchester Medical Ctr. w/3 gunshot wounds.
5/17/18 update: Charges that Cynthia Arce tried to kill two Mamaroneck police officers are headed to a grand jury. Only her attorney was at hearing, as she is still in intensive care with a perforated bowel and wounds to an arm and a leg after being shot by officers trying to save her little girl. Stun gun did not work on her.
9/18/18 Update: Plead not guilty. Defense will make a Motion for a psychiatric defense. Next Prelim hearing on 10/2.
10/2/18 Update: Prelim hearing continued to 10/9. 10/12/18: Hearing on 10/16.

Holiday card from Cynthia Arce, dead girl's mother, stuns father's family


On Dec. 22, as Gabriella Boyd's grandparents were preparing for their first Christmas since the Mamaroneck toddler's death, they received a holiday card depicting angels.

When they opened it, a note was addressed to them, their son and Gabriella's father, Stephen Boyd, and the girl's uncle. It was anything but cheerful.

"It's comical how you hold onto her ashes. The four of you will never see her again. Happy New Year," the card read. "My apologies for the limited time you had with her. That's what God wanted. I'll ask Him why when I see him."

Arce was forced to show up in court Friday afternoon — after refusing to be brought from the jail for her scheduled court appearance that morning — so state Supreme Court Judge Barry Warhit could issue an order of protection barring her from any further contact with Stephen Boyd, his parents and his girlfriend.

Arce's lawyer, Richard Portale, who is pursuing a psychiatric defense that will argue Arce likely suffered from post-partum psychosis, did not speak about the card. But he said his client had gone about six weeks at the jail without seeing a psychiatrist or taking medication. Arce had a history of bipolar disorder. He said she now has a new doctor and is on new medications.

Portale has still not filed the formal notice for a psychiatric defense, in part because he has been unable to get all of Arce's medical records. On Friday he specifically cited the records from Dr. Herold Abellard, a New Rochelle psychiatrist who was treating Arce at the time of Gabriella's death.

Portale said Abellard has not refused to turn over the records but has failed to do so each time he said he would.

Warhit said he would sign a subpoena requiring Abellard to either show up in court Jan. 24 with the records or provide them to Portale before then.
