New York Second Degree Murder Laws - FindLaw

"Convictions for any other type of second-degree felony carry a sentence of a 15 to 25-year term in prison."

Are you kidding me? 15-25 years? That's all you get in NY for murdering, mutilating and stuffing someone's remains in a bin in a storage unit? WTF?

Pretty sure the wording is misleading. Murder in the first or second degree is a class A-1 felony which gets you 25 to life in prison.

Oh Grace.
Your time with your former husband sounds horrid.:(:(
Luckily you were able to leave safely, unlike Jeannie and many other women.
Perhaps with all these tragic cases in the media, women will learn to leave as soon as the relationship changes before it escalates further.
MOO.

I'm glad that the ugly truths are being reported; maybe that will help a few people. However, I think it will take a lot more than media reports to change the culture of domestic violence. IMO, there needs to be a major awakening to the realization that females are equal human beings with equal rights, and not the property of men. It needs to start with the way girls are raised and educated, and then followed through in our public institutions, legal system and LE's attitudes and practices.

Janine's friends and coworkers, and maybe family, were aware of much of what was going on, per the articles above. I wonder if anyone tried to help her see other options, or let her know that bringing a predatory, immoral woman into her home to lure away her abusive husband was not a good idea and not safe. That only doubled the number of monsters in her home! Desperate people often don't think clearly and resort to doing desperate things. That's when a person needs a real friend to step in and give her a no-nonsense reality check and a helping hand. I very much appreciate having had those types of people in my life at various times. There's a difference between meddling and supporting. In so many of the cases we read about here, it seems to me that a supportive intervention might have prevented a tragedy. MOO.

Michael and Egea were both due in court Thursday, but were not present as attorneys waived their appearance.

Although certificates of indictment for a felony were handed, prosecutors wouldn't say what the felony is. However, since the certificate has to be submitted for bail application, the judge may ask prosecutors to reveal what the felony is although it is not necessary until the arraignment.

Gosh, I hope so! That sentence didn't make any sense to me, considering the circumstances.

They could not possibly make bail. Do defendants have to ask for bail or can everyone just agree against the possibility. I mean, I'm sure the judge will order a high bail, and this is not a couple who has any assets to make bail. Jeanine largely supported them.

Yes, it was worded oddly. I found another site that listed the sentence as minimum 15 years to life, maximum 25 years to life. That makes much more sense to me!

NEW YORK (WCBS 880)Michael Cammarata and his girlfriend, Ayisha Egea, who are accused of killing Staten Island mother and teacher Jeanine Cammarata, were in court Thursday.

According to WCBS 880’s Peter Haskell, the two arrived in a Staten Island courtroom in khaki scrubs and neither said a word.

The two were indicted, but the charges remain confidential, despite pleas from the couple’s attorneys.

They are probably still working out a deal with her. As I recall, girlfriend is the one who led PD to the storage unit where the remains were located, so it sounds like girlfriend is is cooperating. Perhaps they will reduce her charges in exchange for her cooperation?

Estranged Husband, Girlfriend Indicted On Confidential Charges In Jeanine Cammarata Murder Case

“Fundamental fairness and the constitution of the state, in this country, dictates that anyone charged with a crime should know what they are being charged with,” said Mark Fonte, who represents Egea.

Fonte suspects Egea was not indicted for murder, and if she faces lesser counts, feels she should be released on bail as the 41-year-old is six-months pregnant."

I do agree with Fonte that people should know what they are being charged with. As for her being a 41-year-old who is 6 months pregnant -- maybe she should have thought about that before participating in a murder.

ETA: spreeee.......

Second degree??? How in the world is this not first degree homicide?

Do you know of any evidence that proves this was premeditated? I think the argument is that it was in the heat of the moment. Hopefully it’s life and no chance of parole given all of the different heinous factors... this man has ruined so many peoples lives in different ways I just can’t comprehend that level of selfishness and lack of self awareness.. it’s truly appalling.
