Why do you say that? Where has the part of the basement come from exactly?

@BU criminologist The Daily Mail link has a lot to offer.

My pro bono, self imposed paralegal researcher HOBBY is fascinating, but it gets tiring.

I think I've provided a link in almost every post. What are we doing here if we can't speculate.
They've been charged with something, so is speculating against the rules? I can't provide links for my theories.

Maybe we could together a timeline of inconsistencies, in police statements, MSM reports I think we'd get a lot further.

I understand BUs confusion, but if you read back a little further, I tried to show that there were many conflicting reports.

Where did James say he was sleeping upstairs and not in his apartment? I have never seen that in writing.

In his jail interview I only saw he said that he stayed in Saturday night watching a fight on TV then people came over for drinking games. He said there was no argument that could have resulted in a murder. Then said he spent Sunday watching football with elder Rackover.

IMO he was in the 4th floor apartment through whatever occurred.

Thanks.

He never said that. You're right.

"Rackover, 25, the surrogate son of a prominent Manhattan jeweler, said he stayed home to watch an Ultimate Fighting Championship bout on Nov. 13, a Saturday, and never left his E. 59th St. apartment.

Dilione, he said, was at a club and came by his house with a few people around 4 a.m. He said he knows Dilione through an ex-girlfriend. The group stayed at Rackover’s place until about 7 a.m., drinking and hanging out. There were no arguments that could have provoked the ghastly killing, Rackover said.

Body of Conn. man who vanished from NYC party found in New Jersey.

He also said that after they all left, he went straight to sleep. Rackover said he hung out with his stand-in dad, and the pair watched a football game on Nov. 14."

Snip

According to a criminal complaint, an informant told authorities Rackover was seen late Saturday leaving his apartment building and putting a large duffel bag into the trunk of a black Mercedes with tinted windows that was registered to Rackover's father.

...

Bloody clothing, sheets and towels were found in Rackover's apartment during the course of an investigation, prosecutors said. The black vehicle that Rackover had been seen driving was later returned to Manhattan, left in a parking garage on East 58th Street, and a cadaver dog made a positive alert for a body or bodily fluids in the trunk area, the complaint says.

...

Nonetheless, during the hearing, Assistant District Attorney Antoinette Carter alleged that "one or both of these people committed a murder."

I think joey was brought in garbage bag(s).

I feel someone may be splicing and dicing the film and using old footage of James loading the car at a prior date.

I don't think there ever were suitcases.

I think Dilione threw him down the garbage chute in bag(s).

He's in so deep at this point he takes the luggage cart to the basement and retrieves poor Joey. Then and heads to Jersey.. Jmoo

donna7777 - not sure that you were asking, or just stating your opinion - but i did locate mention of the suitcase in a few news articles, i am including a quote and link as fyi... thanks!

FWIW Sercarz is not listed as JR's defense attorney. Robert Caliendo is. Same office. Caliendo used to work for the Bronx DA's office.

Hmm I could have sworn I saw otherwise when viewing the document last week. Then again my eyes could very well be playing tricks on me. Unless the document was updated, which could very well be possible.

Although sometimes, multiple attorneys will jump in and appear on behalf of the defendant, even if only one is listed. It isn't unusual for one court appearance to have one counsel appear, and the next, have a another (say a partner in the firm, file some kind of motion) appear on defendants behalf.

No it wasn't ever stated that he was upstairs sleeping. You're correct. This was a theory suggested by someone else

Donna, yes you're correct, there are many conflicting reports. But if you try to analyze every single one, you'll drive yourself crazy :) My suggestion would be to take everything with a grain of salt since the details will all eventually come out anyway. But for those facts that you keep consistently seeing over and over again in the press... those aren't a bad place to start either.

My point earlier was, certain details are important (see in red above). Since reports are already conflicting, let's not get further derailed by statements of speculation that can be perceived as fact. It will make you a lot less tired, I promise!

The paralegals who work for attorneys are too busy gathering research and actually doing the work related to the case to make any calls to editors. I've worked for an attorney before, trust me, he would never in a million years spend a dime of the money he paid me to call an editor for any reason. We had more important things to worry about.

Additionally, what I meant is you can't control the press. Plus, with a man like Jeffrey Rackover, who has such famous clientele, of course the media would go into a frenzy. You can't possibly think everything you read in the news is true and everything that isn't is redacted, do you?

You're entitled to your own opinion, just as anyone else is

Never in a million years and I worked for one makes me not trust what you are saying is fact. I know many attorneys and related to many through friends who host gatherings and parties at their homes, and a few are good friends. There are such vastly different personalities among lawyers, work ethic, likes and dislikes, and I can tell you, what angers and incenses one may not incense another regarding their case. You may have one who reads a smear of their client in the morning papers and they are fine and another may blow their lid. You can control the press if they are mistating facts. I have read the silliest mistakes corrected about persons in articles. It may have been in fact this particular lawyer was one that needed his client to ask for something to be done with it.

It is in my opinion also that you cannot speak for millions of lawyers and paralegals of what is important to them, what incenses them, and what they are busy doing and not doing. To me that is insane.

Similarly, you could not scoff and tell a woman her busy doctor did not sit down with her patiently and give good care because they are just too busy and do not have time for that. Some give extraordinary care regardless if they are busy and some do not.

The stuffed in a suitcase is strange to me. He was a big guy and folding even a small petite woman imo would be difficult enough. Does anyone know if it would be difficult to rearrange a dead body, (of course with it not being a living person balling up like an extortionist to fit inside a suitcase). I read somewhere a fireman mention that he could lift 500 pounds in the gym when they lift those heavy bars but it was almost impossible trying to lift a 180 pound dummy made to resemble lifting a dead body in training.

It may be possible in a super large suitcase??? How tall was Joey? Does anyone know?

I am confused when I hear that LE is still trying to determine who the killer was. Don't the witnesses become accessories to the crime? I thought that an accessory had the same punishment as perp? An earlier poster raised a good question regarding the tools. City dwellers don't generally have shovels. Short of going to a 24 hour Home Depot, I think that the tools might have come from a home in Oceanport.

This only my opinion. Gemma and Larry were brought in almost immediately, with no tell tale injuries or OJ like cuts on their hands (that we could see). I would think fighting, sawing(imo) and digging would cause some sort of injury. Could they have also chatted with Gemma, who may have had injuries and was possibly excluded from immediate action until he healed?

Joey was a big boy, I
would think he got a few shots in. Could Gemma have been the one to say "what are you going to do about it" to James, causing the frenzy to begin? He was also stabbed multiple times l, all over his body.

Could Dilione have come to Gemmas aid and stabbed Joey in the back to get him to stop? Dilione doesn't have a mark on him, he seems the sort to stab someone in the back.

Why wasn't the pet felon brought fourth sooner is my question in jmo of course.

Theory #2 Bada Bing! ..Bada Boom!!

Take #1 MOO

Getting back to my original theory of Joey being a possible contender for the attention of Diamond Daddio money bags. I use that title because that's how quick Joeys death seemed to go. Just like he was lured there on the guise of a party and just like that he was dead.. Very GoodFellaish if you ask me.

Could James have hired them to get rid of his possible rival James? Could they have been promised that apt and cash or both?

I remember reading that the living arrangements for Gemma and Larry were sketchy. Larry had Oceanport and Jersey City, Gemma had Oceanport, Jersey City and NY Since we can't figure out why he died or what he could have done.. Maybe he was whacked. Imo

I don't think Jeffrey knew of this plan, but since it's working in his favor now that he's rid of the pesky rent boy and possible extortion attempts, it may just be a blessing in disguise for him.. Jmo James seemed to be good friends with Larry who may even have lived there part time.

Donna, there have been no reports to state that Joey was stabbed in the back or "all over his body". Perhaps Joey was stabbed after he passed out from drugs or drink and there was no fight. Joey wasn't "whacked". If someone was being paid to commit a murder it wouldn't be in his own rental apartment.

@Salsa he was 5'9 and 175

@Luke Larry was a roofer in a family construction business. I believe may have owned sharp power tools also. . Imo

Of course, he was not "whacked", stabbed in the back, or all over his body:
