The man who was stuffing the BAGS into the car was immediately taken in for questioning, but let go when he refused to speak. But the evidence collected on scene was enough for police to warrant a search inside the home and car of the person of interest, who was placed back in police custody on an unrelated charge.

Larry didn't admit to driving. Where are you reading that? He just allegedly said "we buried the body in Oceanport"

Investigators, using license plates readers, were able to determine that, shortly before 10 p.m., James Rackover drove onto Franklin D. Roosevelt Drive and went through the Holland Tunnel into New Jersey. At 3 a.m. on Monday, the car crossed back into New York through the Holland Tunnel, and was back at Mr. Rackover’s building 15 minutes later.

Some facts from NYPD Chief Boyce:

Robert K. Boyce, the New York Police Department’s chief of detectives, said investigators recovered 32 pieces of evidence from Mr. Rackover’s blood-spattered apartment at 418 East 59th Street, including sheets, towels and clothing that belonged to Mr. Comunale. The men had tried to clean up the scene with bleach, Chief Boyce said.

The police said Mr. Comunale was stabbed 15 times in Mr. Rackover’s fourth-floor apartment on Sunday, after the three men had met in Greenwich Village on Saturday night. The police did not offer a motive for the killing, and neither suspect was cooperating with the investigation, Chief Boyce said.

Evidence unearthed by police suggests a 2015 Mercedes Benz licensed to Jeffrey Rackover was used to transport the body. James Rackover was seen loading a large duffle bag into the vehicle in the late evening of Sunday, Nov. 13, according to a criminal complaint.

The vehicle was seen traveling from the Upper East Side into New Jersey via the Holland Tunnel Sunday Night and then back through the Holland Tunnel at 3 a.m. Monday morning. Rackover was then seen exiting the vehicle at a 58th Street garage Monday, according to the DA's office.

A police dog later discovered signs of the presence of a human cadaver in the trunk of the vehicle.

The NYPD flashed the younger Rackover a search warrant Wednesday and entered his apartment, where they found evidence of foul play relating to Comunale's disappearance and death, an NYPD spokesman told Patch.

EARLY SUNDAY MORNING - NOV. 13
Comunale tells his friend that he's going to attend a party at 418 East 59th Street, which is located between First Avenue and Sutton Place near the Ed Koch Queensboro Bridge.


SUNDAY EVENING
James Rackover is seen leaving his apartment building on East 59th Street and placing a large duffel bag into the trunk of a black vehicle with tinted windows that was parked outside the building.

Police later identified the car as being a 2015 Mercedes Benz that's registered to Jeffrey Rackover

9:45 P.M. SUNDAY
License plate readers indicate that the Mercedes traveled from the Upper East Side of Manhattan onto the FDR and through the Holland Tunnel to New Jersey.


3 A.M. MONDAY - NOV. 14
A little more than five hours later, a vehicle with the same license plate as the Mercedes is recorded coming back through the Holland Tunnel. It heads north on FDR Drive.

3:15 A.M. MONDAY
Surveillance video from a parking garage on East 58th Street in Manhattan shows where the Mercedes went next.

"I observed what appeared to be a black Mercedes, driven by defendant Rackover, enter the garage and park, after which I observed defendant Rackover leave the vehicle," the NYPD detective wrote in the complaint.

TUESDAY - NOV. 15
Later that day, a cadaver dog approaches Rackover's Mercedes parked in the garage and makes a positive alert for the presence of a human body or bodily fluids in the area of the trunk or rear panels of the car, the complaint states.

The K-9 officer takes the cadaver dog to James Rackover's apartment, and the dog also indicates that there was a presence of a human body or bodily fluids at that apartment.

Detectives would later find blood splatter inside that apartment.

Imo..I'm sure Dilione didn't carry his bags of body parts all that way and he also didn't say James' was driving.

I haven't seen proof James was driving and i believe you have to be caught behind the wheel. I'd still like to know if Larry has a valid DL

Never in a million years and I worked for one makes me not trust what you are saying is fact. I know many attorneys and related to many through friends who host gatherings and parties at their homes, and a few are good friends. There are such vastly different personalities among lawyers, work ethic, likes and dislikes, and I can tell you, what angers and incenses one may not incense another regarding their case. You may have one who reads a smear of their client in the morning papers and they are fine and another may blow their lid. You can control the press if they are mistating facts. I have read the silliest mistakes corrected about persons in articles. It may have been in fact this particular lawyer was one that needed his client to ask for something to be done with it.

It is in my opinion also that you cannot speak for millions of lawyers and paralegals of what is important to them, what incenses them, and what they are busy doing and not doing. To me that is insane.

Similarly, you could not scoff and tell a woman her busy doctor did not sit down with her patiently and give good care because they are just too busy and do not have time for that. Some give extraordinary care regardless if they are busy and some do not.

Salsa, with all due respect, I'm just as entitled to my opinion as you are. My professional background combined with my education in criminal justice does give me some level of credibility. But yet, the stories you hear from friends who are attorneys at friendly gatherings somehow holds more weight? Forget credibility, why is your personal experience more valuable than mine, and mine makes you question if what I'm "stating is fact"..?

I never said I was speaking for millions of lawyers and paralegals.. I was merely suggesting a general attitude based on personal/professional experience. Please don't be so quick jump to conclusions.

I am confused when I hear that LE is still trying to determine who the killer was. Don't the witnesses become accessories to the crime? I thought that an accessory had the same punishment as perp? An earlier poster raised a good question regarding the tools. City dwellers don't generally have shovels. Short of going to a 24 hour Home Depot, I think that the tools might have come from a home in Oceanport.

LE is still trying to determine who did the actual act of the stabbing. notice we know nothing about the murder weapon. which is vital, and the only thing defense has going for it at this time. without the murder weapon, IMO, this is why the men haven't been indicted for murder.

Donna- If Larry lives in Jersey City but works down the shore then in my opinion he most likely yes does have a valid drivers license and probably a vehicle.

I thought James was initially taken in on traffic charges - not having a valid drivers license?

Didn't Jimmy say he never saw "the kid" in his jailhouse interview? He didn't say that when questioned by LE:

"detective goes to the fourth-floor apartment where Comunale was last seen Sunday morning, and talks with James Rackover. According to the complaint, Rackover tells the detective that he hosted a party in his apartment in which his friend, Larry Dilione, a number of women and a man he didn't know attended. Rackover says he doesn't know what happened to the young man who attended his party.

Hi Donna. This timeline is not new. It's from Nov 18th. IMO Joey's body was in a suitcase but other evidence (found NEAR Joey) may have been transported in the duffel bag to be disposed of. The reason I posted this timeline was in reference to JR's activity on the days in question. HTH.

Evidence found its way back inside again.

Those sheets have been at the burial site, the basement dumpster and out in the court yard. Unless James had endless sheets and Joey had a 2 gallons of blood.. This can't be true.

Joey was not found IN the duffle bag. It was found nearby. And this fact never changed. This article is from early on:

I remember the mention of the duffel bag, they initially said it contained the bloody sheets and pants sheets.

What happened to him being in a suitcase and lit on fire, but just his legs burnt story. Don't think that's possible
