Chapter 2: Until Larry Voorhees went and got his family owned roofing tools and successfully dismembered him so they could throw him down the garbage chute, possibly in garbage bags..

Didn't expect such a blurtation* of the insanity so early on. All or nothin' with this whacked case.

And so it begins.. And Yes, I am OK!!

These details are shocking, to say the least... I'm so sad for Joey and his family. Why did this have to happen? I'm flabbergasted that the argument was over cigarettes, how absurd!! In my mind, I still think there has to be more to it than that :(

I can't imagine a parent knowing/living with the thought that these were their child's last few moments on earth. Effing heartbreaking.

I actually feel nauseas. What a bunch of animals. I feel so bad for Pat and his Mom. I don't know how they held up so well. I hope he didn't feel a thing after the first punch.

This case has many layers. I guess they couldn't plead the fifth on the condition Joey's body was in. They had to start explaining, finally. I guess they'll stick the cigarette BS as long as they can.

Dilione is in deep. I personally feel he did it all. I also still feel it may have happened elsewhere in the building and James might have been in his own apt.

None of them had a scratch on them, that we could see. Dilione's hand must be messed up a little. Or, it could have been a paid hit gone wrong, where they waited for him to pass out to kill him.

I guess we'll have to wait for the NY Post or the Daily News to alternate their turns on this case, since no one else is allowed to..

So LD's home was not searched until 9 days after the murder, and that's after pointing out where the body was located, as well as admitting that he had beaten Joey to the point of unconsciousness!!

I wonder if it would have taken 9 days to search after all this ^^, as well as leading NYPD to the victim's body (and its proximity to LD's business & both perps' residence, as well) if these two had been your average 20-something year olds.

I say, NO. Damn straight IMO that your average young adult's home would have been searched before 9 days under similar circumstances much less these!

What I gathered from that mumbo-jumbo article is they are laying the ground work to toss out anything to do with Gemma and also trying to say disregard any of Larry's confession because it was obtained illegally.

I think it's very premature to even discuss these things. They just shared the horrific crime scene details but the TPTB seem to be going in the direction of blaming it on shoddy police work as a loophole to have it play out as they wish.

We'll never know truly what went on, but all three were involved and the case needs to heard. It's all hearsay from people accused, blaming the other accused. It's about as reliable as a jailhouse snitch testimony.

These people are psycho enough to kill and dismember someone. I don't care who they are related to who their friends are. This is very seriously scary and disgusting behavior that needs a trial and punishment given to ALL those guilty..

This makes me think Dilione and Joey went elsewhere in the building. Again the garbage chute could be used from any floor, the removal of the safe,the confusion of who owns the Mercedes, etc., etc.

Now it's five duffel bags,oh, and a back pack? I don't think it matters what was in the Jersey City apt. I think they have enough to go on.

How is James going to fight this. He needs the project innocence people, now! I mean if he really didn't do it, which is possible. Until I see the footage of James and not Gemma darting in the stairwell, I'm not convinced. That's my opinion.

I may be looking to much into this but IIRC didn't Gemma say he changed clothes because he wanted to get more comfortable to go to sleep?

Bederows statement may be throwing me off but I'm taking it that he literally changed BEFORE he left and that would contradict Gemma's account.

LD admits hitting JC, he admits being there when JR killed JC, and he admits hiding the body. Doesn't all that equal murder? If someone is present while a murder is being committed and helps with the getaway, I thought that was grounds for a murder charge. I think it's especially so in this case when LD could have physically tried to prevent JC from the violence.

I'm thinking they might have enough for a circumstantial case. And, that is probably why we aren't hearing much in the news about the case. Defense wants a jury who hasn't heard about the confession.

According to Gemma’s account, he and his roommate, Lawrence Dilione were at the 1OAK nightclub and retreated to the E. 59th St. apartment of James Rackover after deciding to avoid a club, Gilded Lily, where a fight was taking place.

Gemma, Dilione and five others piled into a pair of cabs and headed to the winding down party at about 4 a.m.

Gemma told cops the party was peaceful and that he did not see anyone when he woke up and left the dark apartment after about two hours of snoozing and making his way to the PATH train and home to Jersey City.

“I asked him if anyone had any disagreements or anyone started any fights and he said no," Det. Jeffrey Ford wrote in a report filed in Manhattan Supreme Court.

The group boozed until about 6 a.m., when Gemma said he passed out on the couch after borrowing sweatpants and a T-shirt from Rackover.

“He said he was uncomfortable in his jeans to sleep in," Ford wrote of the conversation.

Assistant District Attorney said that Gemma, a marketing professional, had “changed his clothing” and that it “had something to do with... the concealment of certain items.”

That doesn't make sense, now you punched him, I can't go to jail so let me stab him drag him to the bathtub kill him and get rid of him and that would make the law so much easier on me witnessing you "Larry" punching him. Instead, go for the huge coverup for Larry??????

Joey was first beaten unconscious after a night of cocaine and boozing, then viciously pummeled and kicked while helpless, according to a statement by suspected co-conspirator Lawrence Dilione.

The suspect admitted to the initial attack on Comunale, but blamed the murder on James Rackover.

&#8220;I didn&#8217;t kill Joe, it was James," Dilione allegedly told cops. "All I did was punch him, then James said he didn't want to go to jail and then James stabbed him."

&#8220;Dilione admitted assaulting Mr. Comunale to the point of unconsciousness after an argument over cigarettes," said Gemma, citing Dilione's recorded admissions.

"Rackover then viciously kicked and beat the defenseless Mr. Comunale," the lawyer claimed, and declared that "we have to kill him.&#8221;

Rackover allegedly choked Comunale and stabbed him in the head with a knife. The victim was dragged to a bathtub "where Rackover unsuccessfully attempted to dismember him with a serrated blade,&#8221; said Gemma.

Dilione pointed police to the m shallow grave in Oceanport, N.J. He and Rackover allegedly dumped the remains after attempting to clean the scene of the crime &#8212; Rackover's E. 59th St. apartment.
