Just because Gemma left doesn't mean he didn't participate in anything else. They also don't say if he was seen returning, possibly with a power tool of some sort, maybe in a backpack.

Does his lawyer actually think someone will just throw out the charges on him? Where is Antoinette Carter, the prosecutor? She was very vocal in the beginning.

Could Gemma have taken the knives and hidden them? Were the knives at the gravesite? He apparently took or brought something very important, so how does he think his part will just be omitted? Affluenza maybe?

I've read that is extremely hard to dismember a body from other criminals and they weren't able to do it with ordinary tools. So if he brought back a saw of some kind, that's a biggie.

i bet dilione sucker punched him. There's no way that dilione could've took Joey down on a one on one, he looks like that type of a 🤬🤬🤬🤬🤬🤬🤬. this is so disturbing, may justice be served

I am eager to hear if JR is singing a different tune now that LD has "ratted" him out as the one who killed JC.

Ok, so now in this ever changing story there are 4 duffel bags and a backpack.

Even if Joey was in there, I'm positive they took all blood stained evidence to Jersey with them. Including any
tools, weapons and whatever else.

How could there be 32 pieces of evidence even left in the apt to find?

If he mostly bled in the bathtub how is there so much evidence around the apt. IIRC, please correct me I'm wrong, but didn't they say there was blood on a mattress? None of this is adding up once again.

I think Gemma's lawyers stance is asinine. Well you didn't check the apt so throw out the case?? Maybe they were evicted, if they ever had a place at all.

I bet James lawyer doesn't even know where to begin. James has stood by the story of being asleep and not knowing what happened.

How will the lawyer get his hands on the footage of the "darting basement boys" if TPTB are determined to conceal it. I still think that it's Gemma and Dilione, but that jmoo.

I feel this case will end up in court, regardless of " who's who" because there will be public outrage if this gets swept under the rug.

Think of Joey's family and friends that are probably mortified because Pat has seen the tapes. If Gemma's on them, that will be brought to light.

By rendering JC quickly unconscious in his supposed version of events, Larry may have been trying to explain away why JC may not have any defense wounds.

Also, by Larry painting JC as quickly unconscious, Larry may have been trying to explain away why James (and poss himself) may not have had any scratches, bruises, etc.

So how would Larry know JC was unconscious and not dead after his punches? Did he or James check for a pulse, breathing, etc? Additionally, after James further beats, kicks and stabs JC in the head, Larry basically states that the victim was still not dead.

He expects one to believe that one, the other or both checked at least twice for signs of life and understood that JC was still alive. I believe this version of events is pure nonsense

Why is it that every news report references this court filing but none have included a pdf of the complete filing?

It's beyond annoying to have to rely on parts of the court filing that have been cherry picked by a reporter and not be able to read the complete document verbatim...

7. The press version of the contents of this motion
6. The actual motion written by MG's lawyer in order to get his client off the hook.
5. The sources used by MG's lawyer for making the claims contained in this motion, which are what exactly? Perhaps cherry picked parts of what LD told him about his confession and what LD thinks the CCTV camera shows?
4. The actual taped confession by LD, which I very much doubt MG's lawyer has watched, and which likely contains many lies.
3. The actual forensic and CCTV evidence gathered by police, which haven't been released to anyone or anyone's defence lawyers
2. The actual memories of MG, LD and JR of what went down, 3as they remember it, which all 3 refuse to tell anyone, to protect themselves.
1. What actually happened.

The punching story isn't ringing true to me either. Joey was a big man and and he was an athlete. He's was a star hockey player, for pete's sake - he could take a hit.

The only explanations I can think of is that Joey was so intoxicated he passed out from a punch from a lesser man? Or, the punching story isn't right.

LD was so mad about cigarettes that he punched a big man into unconsciousness, just like that? Hard to believe.

If Larry Dillione punched Joseph Comunale knocking him unconscious, why was James Rackover concerned that he'd go back to prison?

If you assault another adult in my apartment and I did not assault anyone, I'm in no danger of being arrested.

Since cocaine can easily be flushed down the toilet before NYPD arrives and Rackover didn't assault anyone, what had him so concerned for his own freedom?

Exactly! Couldnt have said it better myself... You guys are missing the point and I stated this earlier... The statement about the cigarettes which you all know is the dumbest statement they could think of, and does not make any sense, is because the police/lawyers/Mr. Comunale do not want to state the obvious... I stated this earlier.. Word around Oceanport was that LD and JR were more than just "friends"... Go back to the things you read about James and how his "father" befriended him... Why do you think his "father" is not paying for anything and is keeping hush?? This was about two men who tried to make a move on JC... You think Mr. Comunale wants that as public knowledge?? As I stated before, there have been incidents where gay men make it a game to see if they can pick up a straight guy from a club/bar and try and make a move on him... They fed him drugs.. He wanted more even AFTER the girls left and thats when they made their move... You think they would have done that when the girls were there???

This was a 2 on 1... No way would LD knock him out and James all of a sudden say "OH CRAP, I CANT GO BACK TO JAIL... Lets kill him!" That is the stupidest thing I have ever heard...

Can James lawyer demand the security tapes? In my opinion, if they have clear, concise footage, the case should be easily solvable.

Whomever is seen darting and skulking around the basement, retrieving a dismembered body are cleary the murderers..

No one would ever do all that if they didn't cause the death.imo.If James isn't on that footage than I believe he is innocent.

Also, does all evidence submitted in court become public record? For instance, if the innocence project wanted to get involved or if someone was writing a book, could they see all the evidence?

James is no angel, but if he gets railroaded, how and who can help him then? There are many innocent people in jail and some even on death row. Just wondering how much access those people would have to help him, or anyone for that matter.

I don't know exact details regarding discovery but you can become more familiar with it by looking up NYS criminal case discovery


Also James has a top notch attorney. Railroaded is the last thing I think of when I think of James Rackover.

Thanks. I'm a sucker for the underdog and wouldn't want an innocent person to go to jail, especially Rikers Island. I noticed Sercarz wasn't there at his last hearing though.

I wish some legal analysts would weigh in on this and explain some of this roller coaster ride to us. Are things being done fairly according to statutes and laws when it comes to James?

I mean Larry confessed and he's out and about doing God knows what. James is getting worn down in there and doesn't have the privilege of preparing to state his case in a dignified manner.

They have him looking guilty before a fair and impartial trial. Or, maybe that's the plan.

James is not at Rikers. He's been and is still at Manhattan Detention Complex, not that anyone would want to be living there either.

BBM^^ Are things being done fairly? Definitely! He's not been charged with murder, and imo others under the same circumstances would have been by now.

As another poster noted, those accused have excellent defense representation. And if not for that, as they say, the book would surely have been thrown at them by now

BBM ^^ Exactly. First thing I thought of when I read Larry's admissions as to why James just had to murder JC. No worries...just flush it. His version of the murder is not believable
