How heartbreaking. I knew this was the likely outcome, but I was holding out hope that the child was with relatives who didn't want to/couldn't come forward.

My notes from presser:
Remains are consistent with a child Owens size.
Won't know if more charges will be filed until all evidence processed.
Suspect came into country illegally and was deported twice and is facing federal charges for illegal entry and forged id.
Remains were found within 1/4 mile from his mother but were somewhat scattered--
Some remains in a shallow grave with disturbance from an animal.
For 10 days they had 1111 people searching the farm in May/June.
The rain and apple season worked against them searching as well as searcher fatigue.
The evidence they were looking for had been intentionally hidden.
They continued to search, however, with a limited continuous plan.
Although it was reported in media they had stopped-- they never stopped investigating. They never quit (this officer is emotional, his voice breaking :().
Suspect is represented by an attorney so LE has not questioned him since arrest.
An emergency response team was there on Wed as part of their search detail, they did a ground search and found those remains.
Location was called "Block 1" and had the most searches of any other area. It had been searched everyday of the 10 day search. The ground cover in that area was very difficult.
If it had not been for the ground disturbance by an animal they would not have found the remains --remains were partly found on Wed and more on Thursday.
They believe these deaths to be suspicious.
Oct is domestic violence awareness month.
There was a history of domestic violence.
They were not married but were partners/significant others and she had previously located to the victim resource center.
Area had been searched with cadaver dogs 7 times (wow!)
Had they not found the remains, they would have continued to search daily
Hoping for closure for the family
Selena had been seeking asylum and she was doing everything right (made court dates, paperwork, etc) to try to stay here.
Border patrol had taken in some people in Sodus at the time of this incident and at first LE thought Reyes, Selena and Owen may have fled because of that. But investigation revealed red flags and when they searched they found Selena's body within 20 minutes. They knew at that point Owen could not have survived on his own. (LEO is getting emotional again-- he is father and grandfather).

That's all I've got time for... need to go get some dust out of my eyes now.... Love this police force-- very caring and compassionate people. Poor Owen and Selena. :(:(:(:(

UPDATE: Investigators to give update on missing toddler Owen, Reyes to appear in court Thursday


Reyes admitted to having buried Selena, but did not admit to killing her. He is scheduled to appear in Wayne County Court Thursday (10/18) at 9:30 a.m. He is being held in the Wayne County Jail on a $25,000 bail.

As of right now, the only charge he's facing in Wayne County is tampering with evidence. However, Reyes is also being federally charged for illegally re-entering the country using counterfeit documents.

Alberto Reyes, "found her dead body, removed her from her home and buried her." Trail cameras provided by a neighbor show Reyes walking in and out of the woods for five hours with a shovel. He did not admit to killing Selena Hidalgo-Calderon. He did not make mention of Owen.
5/29/18 Update: Sheriff Virts says he believes Donoteo-Reyes, who also goes by the name Alberto Ebavardo Gutierrez-Reyes, was involved in his girlfriend’s death. Donoteo-Reyes is scheduled to reappear in court on 7/2/18.
6/1/18: Deputies said he could face more charges once the results of an autopsy are released.
5/28/18: U.S. Immigration and Customs Enforcement, also known as ICE, says it has filed to have a man suspected in the death of the Sodus mother and the disappearance of her young son turned over to the federal agency. ICE says 25-year-old Gutierrez-Reyes is an illegally present citizen of Mexico. An official said Monday a detainer filed late last week will ensure Gutierrez-Reyes is turned over to ICE once any local charges are settled. 5/29/18: Case goes to Grand Jury.

6/4/18: Federal Immigration hearing charged with re-entering U.S. illegally after being deported twice (arrested in Louisiana Fall of 2016, deported & March 2017 arrested in Texas, deported again), will be held w/o bail. Also charged with using falsified Soc. Sec. & Alien residency cards. Federal hearing in August. Both State & Federal cases will move ahead at the same time. He faces up to 10 years in prison on these charges. If found guilty in either case, will serve his sentence in U.S. before being deported upon his release.

7/16/18 Update: Next hearing 9/21 re arguments about statements Reyes made to Sheriff investigators are admissible in court. (Not charged with murder yet, also faces Federal charges for re-entering U.S. illegally.

When questioned Thursday by the defense, Sgt. Benosa reiterated that Donoteo-Reyes had denied harming Selena and repeatedly said he didn't know where Owen was. The police sergeant also admitted he didn't fully read Donoteo-Reyes his Miranda Rights.

Deputies said Tuesday more testing is needed to confirm the remains belong to Owen. Right now, Donoteo-Reyes isn't facing charges for Selena's or Owen's death. However, as lab results come back, prosecutors say Donoteo-Reyes could face further charges.

In court Thursday, attorneys reviewed statements Donoteo-Reyes made to police after Selena's body was recovered in May as part of a hearing to determine if those statements could be allowed at trial.

I was just coming to post they found little Owenbut see it has been posted already. RIP little guy. I am keeping an eye to see if charges are brought against the "suspect ".

I tried the site mistivon posted (thanks for the heads-up!). Unfortunately, not all courts in the state participate in the ecourts system, and Wayne County Court is one of those that doesn’t:

Alberto Reyes begs judge to intervene in his case, claims he was threatened



Lyons, N.Y. – The man charged with evidence tampering in the disappearance and death of a Sodus mother and child is the target of a new grand jury investigation.

Alberto Reyes appeared in court Thursday. There, he begged the judge to intervene in his case.

Clearly upset, Reyes rose from his seat and asked the judge to hear him out. He said he was tricked into giving up his right to remain silent and was repeatedly threatened by interrogators.

“He said he would talk to the judge, so he would never let me out,” Reyes told the judge. “Many times, I told him I wanted a lawyer.”

Back in May, Reyes told police he came home around noon and found Selena Hidalgo-Calderon dead in the bedroom. When pressed, he admitted he carried the body out of the house and described where he put her.

He said there was no sign of her 14-month-old son, Owen.

A Rochester Police sergeant who speaks Spanish conducted the seven-hour interview which, during the hearing, was turned over to the judge along with a translation.

Yet, through an interpreter, Reyes implored the judge to, “Please, please watch the entire video,” – possibly an additional 15 hours of interrogation.

Judge John Nesbitt agreed. He said he will take the next month to view the entire interrogation and have it translated from Spanish.

No one has been charged with the deaths of Selena Hidalgo-Calderon or her son. Reyes was notified in court he is the subject of a grand jury proceeding on December 17.

Grand Jury proceedings on 12/17. Reyes will be back in front of that judge on January 15. Whether or not he has a new attorney for that appearance is yet to be determined.
