Why accused bike path terrorist is unlikely to face death penalty

"Here’s a real Halloween horror story: The ex-Uber driver accused of killing eight people in lower Manhattan last Oct. 31 — saying he “felt good about what he had done” for ISIS after the bloodbath — will probably never see death row.

Sayfullo Saipov, 30, is slated to go on trial next October — roughly two years after he allegedly used a Home Depot rental truck to mow down dozens of New Yorkers and tourists in the name of ISIS. The act of terror also injured 12....

The Department of Justice is seeking the death penalty for the Patterson, NJ, resident, who allegedly chose last Halloween the attack because he believed there would be more people out on the street for him to harm.

But even if prosecutors get the judge’s OK to pursue capital punishment, it’s unlikely he will be put to death, according to Robert Dunham, executive director of the Death Penalty Information Center.

It’s not for lack of trying. ...

Keeping Saipov alive might also prove to be the wiser choice, according to Harvard lawyer Alan Dershowitz.

Sentencing him to death will just “make him a martyr,” Dershowitz told The Post.

“He will be forgotten if sentenced to life.”"

NYC Marks First Anniversary Of West Side Bike Path Attack

"NEW YORK (WCBS 880/AP) -- New York Mayor Bill de Blasio and Police Commissioner James O'Neill on Wednesday marked the first anniversary of the truck attack on a lower Manhattan bicycle path that killed two Americans, a Belgian and five Argentine tourists.

De Blasio and O'Neill were joined by police and fire responders as a wreath of white roses was placed at the site of the attack on West and Chambers streets. A small group of family members and friends attended the ceremony along with the consuls general of Argentina and Belgium...."

Lawyers seek to exclude evidence at NYC truck attack trial

"NEW YORK (AP) — Lawyers for a man charged with killing eight people in a terrorist attack on a New York City bike path said in a court filing Friday that they had learned the FBI had intercepted his communications, though it was unclear when that surveillance began....

In a portion of their court filing attacking evidence in the case, Saipov's lawyers said it was clear that two FBI agents who questioned Saipov at a hospital the day after his arrest interrogated him "about matters and contacts that overlap with surreptitious FBI surveillance of Mr. Saipov's communications."

A portion of the court filing dealing with that surveillance was blacked out in the public version of the document and it was unclear when the surreptitious surveillance occurred.

The lawyers asked the court to throw out statements Saipov made to the agents, saying he was questioned while under the effect of powerful drugs as he recovered from gunshot wounds....

Saipov goes to trial next fall..."

Sayfullo Saipov, an Uzbek man who lived in New Jersey, is accused of intentionally driving a truck into a bicycle path in 2017 to run over cyclists and pedestrians. He was inspired by Islamic State to carry out the attack, prosecutors say. The presiding judge will begin questioning prospective jurors Tuesday.

Mr. Saipov has pleaded not guilty. His lawyers have argued that capital punishment violates his constitutional rights, saying the sentence is rarely sought in federal cases and is applied arbitrarily. The lawyers also appealed directly to Attorney General Merrick Garland to withdraw the death penalty from the case but were turned down, court filings show.

Mr. Saipov’s trial, in which jury selection lasted nearly three months, will focus first on the question of whether he is guilty; and if he is convicted, the same 12-member jury will decide whether he should be executed — typically in the federal system by lethal injection — or receive life imprisonment. A unanimous vote is required to impose the death penalty. The process could last until March, the lawyers have told Judge Vernon S. Broderick.

The jurors are likely to be presented with graphic evidence and testimony about the attack, in which Mr. Saipov said he was inspired by ISIS videos he had watched on his phone. The assault ended after he drove the truck into a school bus, jumped out and waved pellet and paintball guns while shouting “Allahu akbar,” Arabic for “God is great,” according to a federal complaint. Mr. Saipov was arrested after he was shot in the abdomen by a police officer.

She said the truck came within an inch of striking her. Afterward, she said she approached one of the bicyclists who was struck, an “older gentleman” who asked her to call his wife overseas with his phone.

But as she tried to do so, someone whispered to her: “Don’t make that call. His wife did not survive.”

The testimony from victims occurred a day after Saipov’s lawyer, David Patton, told jurors bluntly that his client is a killer. Patton said Saipov “murdered eight people” because he believed it was his religious obligation and he expected to die in the attack. Instead, a police officer shot him, and he was arrested and held in a federal jail until trial.''

On Monday, U.S. prosecutors will ask 12 people to authorize a punishment that hasn’t been levied on a Manhattan defendant since 1963: death.

Sayfullo Saipov, 35, was convicted last month of fatally mowing down eight people as he raced a truck down a West Side bike path in 2017. Now comes the phase of his trial that will determine his punishment: The U.S. government wants to end Mr. Saipov’s life with a lethal injection.
