I know this is "old news," but I can't get away from it:

"She stated that she tampered with the victim's kayak," Mohl said in recounting the alleged confession. "She knew it would contribute to his death."

Graswald told authorities she "felt happiness and relief" as she watched him go into the water, and that "it felt good knowing he was going to die," Mohl said.

(Thanks to TedMac for giving us the article above in "Breaking News" yesterday in her post #1130.)

Call me Captain Obvious, but in my opinion, Graswald's statement above does two things, for starters:

  • [*=left]Shows clear premeditation and forethought
    [*=left]

  • [*=left]Tells us that the tampering was done to hide that she was clearly trying to kill him but knew she had to make it seem accidental, thus showing us she knew right from wrong, IMO.

I think she's in a bit of trouble...

Portale said he made a motion for a forensic expert from his legal team to observe the autopsy but was denied.
He said he might have to request an independent autopsy.
“I’d prefer not to,” Portale said. “I’d prefer to let the family move forward with their services.
“We want to make sure and see how the procedures are followed.”
Sources said more toxicology tests needed to be performed before determining the cause of death.

Whew! Finally caught up - and just wanted to make a few comments...

sorry for butting in but i am married to an ethnic Latvian and i won't start in the differences between ethnic latvians and russian Latvians, but i don't find all of them coldly passionate, some are, some aren't, just like latinos, some of us are hotheads, some aren't (just playing with cliches here)
she must just be a factual person which is just the way she is, might not sell newspapers or be the best way to advance an innocence plea but, as we all have seen in WS, different people react in different ways
just started reading the thread BTW

Say Sveiks to your husband! I'm a Latvian; and yes, QUITE a difference between ethnic Latvians, and the Russian (so-called Latvians)... I'd say AG is a Russian/Latvian!

Graswald is from Latvia, an eastern European country that was formally part of the Soviet Union, and Portale says her background might give insight into how she behaved following Viafore's death.

"They are taught to be hard, not to show sorrow, weakness and she was doing all in her power to be that person."

yeah - definitely a Russian/Latvian.

Graswald, who is originally from Latvia and in the US with a permanent resident card, is "very confident sounding, so even if she doesn't understand what you're saying, she'll answer in an affirmative tone," Portale said. She was suffering from hypothermia and the loss of her fiance a very clear language barrier.

Did she arrive in USA in her teens? She's not a new immigrant, if I recall.

okay - she's been in the US for 20 years... They teach English in Latvian schools, as she would have been 11 years old when Latvia got its 2nd independence from the Soviet Union. She knows English! JMO!

I shall be following this trial! Do we know "when" the next hearing date is?? TIA! :seeya:

:rose: RIP Vincent! :rose:

I would lose my mind if those lying, unethical windbags trying to get my loved one's murderer off were present at his autopsy or were allowed to do their own. The coroner/ME is supposed to be an impartial arm of the government. No need for a second autopsy by hired guns.

I wish I could "thank" your post a million times gitana1! As a WS Legal Eagle, your opinion on such matters is highly valued (to me, and I'm certain I am not alone!).

These maneuvers by the defense are beyond low and beyond the pale. :moo:

"Supposed to be" and "is" can be miles apart; allow me to play the devil's advocate and presume many coroners to be nothing more than LE apparatchiks, rubber stamps who will endorse the position they are expected to.

Of course the defense wants its own expert.

DA to give ‘further insight’ on body found in Hudson; Viafore
7:37 p.m. EDT May 25, 2015

snipped
The Orange County District Attorney’s Office will “provide further insight into the identity of the body and the ongoing investigation on Tuesday.”

A member of the Graswald defense team confirmed that the body found Saturday near Cornwall-on-the-Hudson was Viafore’s. The District Attorney’s Office has not yet confirmed the news.

Richard Portale, Graswald’s defense attorney, said he does not think the autopsy’s result will “hurt” Graswald’s case.

“I don’t think that anything they will find is going to hurt her,” Portale said Sunday. “I don’t expect to see anything other than the classification of the cause of death to be accidental drowning or hypothermia, with alcohol as a contributing factor. Anything else would be a surprise.”

WOW!!!
DA wouldn't go out saying something like this unless there is serious doubt, OR that they actually know, that the body found in Hudson River is NOT Vincent Viafore right?

And since it has been stated that the body had the same clothes on as VV had when he disappeard, then it could point to that this case actually might be a staged death after all.
And if it was a staged death, then the couple possibly killed a VV lookalike to make it look like it was VV who "drowned", sorry folkes my imagination is having the best of me, on the other hand... maybe not :what:
In any case, the next 24 hours is going to be VERY interesting!!!
What an ODD case and what a roller coster, most of all for VVs family, I really feel for them <3

Relative: 'Relief' after kayaker's body believed found - News 12 Westchester
Updated May 25, 2015 @ 10:30PM

[...]
Police say the body was in the water for so long that they will not officially confirm it is Viafore until they get dental records.

Viafore's uncle, Al Viafore, says the apparent recovery of the body has brought mixed feelings. "I guess it's a relief," he says. "It's not a good thing, it's not a bad thing. It's just done ... Not knowing whether or not it was him was the concern."

No positive ID yet on male body pulled from Hudson River
9 hours ago
[...]
Investigator Brian Santos of state police at Montgomery said a medical examiner's identification of the remains was incomplete as of Monday morning and state police could not say with certainty that the body was that of missing kayaker Vincent Viafore, 46, of Poughkeepsie.
The Orange County District Attorney's Office is expected to hold a news conference Tuesday regarding identification of the body, Orange County Sheriff's Office Captain Scott Hamill said.

Hamill said the time and location of the news conference is likely to be announced Tuesday morning.

"I have no personal knowledge that the body has been identified from a credible source," Hamill said.

Did the media jump the gun [based on alternate (non-M.E.sources)]?
The defense team made the announcement, IIRC. It has never been confirmed by the DA, nor the NYSP (based on the above quote).

I will say I won't believe anything until the M.E. officially confirms it. Anything coming from AG's side = HINKY!!!! :cow:

My heart goes out to the Viafore family. This roller coaster of emotions they've been on since the 18th of April has been absolutely mind boggling.
I truly hope tomorrow's news conference brings them the answers they've been waiting for.
