Merle Dech and Jane Roman of Toledo will provide co-counsel to Daniel Myers, 48, of Green Creek Township, who faces the death penalty if convicted of aggravated murder, kidnapping and aggravated robbery charges that carry sexually motivated specifications.

The appointment of Dech and Roman, Braun said, means the case will continue on track for a speedy trial.

"It speeds up the process," Braun said. "The attorneys will be able to interpret evidence quickly, and we will be back in court next week and we will schedule a trial. He did not waive his right to a speedy trial."

Through the course of the investigation into Myers' alleged involvement with Bogle, Hilton confirmed that the sheriff's office is investigating the death of Myers' ex-girlfriend Leigh Ann Sluder, who was found dead by Myers at a trailer he owned in 2009.

I don't think they have *officially* been cleared. However based on the allegations against the former sheriff and how he conducted investigations, I'm guessing that they weren't involved.

Suspects no more?

The fate of three others — named “persons of interest” by former sheriff’s detective Sean P. O’Connell — isn’t clear.

At one time, O’Connell said he had a list of “persons of interest,” but he named just three people as suspects: Omar Satchel, Keyona Bor and Kayree “Manny” Jeffery.

All three denied having any involvement in Bogle’s death. They also claimed they were being harassed by the detective, in one way or another. Jeffery said he was unequivocally cleared and O’Connell knew it even as he released his name to the public, calling him a suspect in Bogle’s murder.

“As soon as my name came up (in the investigation) I volunteered to talk with police. I provided DNA samples. I told them where I was. They checked my alibi,” he told the Register in April 2016.

O’Connell was forced out as a deputy last year after numerous allegations were raised about how he was handling the Bogle investigation. Bogle’s family complained, other police leaders became concerned and general dysfunction in the investigation and inside the sheriff’s office was being widely reported by the Register.

'How do I get my life back?'

In that first interview immediately after the murder, they showed her gruesome photos of the crime scene, and questioned her. Bor told O’Connell and the deputies with him she didn’t know Heather Bogle and knew nothing about who killed her.

The only connection between them she could figure was she lived in the apartment building where Bogle’s car and body were found.

One motive, however, was clear: O’Connell was angry her son’s father was appealing his 2014 criminal conviction on drug charges that O’Connell helped secure. After the first raid at her home in April 2015, deputies left a copy of Julian Kiser’s court appeal, carefully laid out on her bed for Bor to find.

She doesn’t know whether O’Connell did that to send a message to Kiser to back off his appeal, or if he simply hoped to intimidate her. If it was the former, it didn’t work, she said. If it was the latter, it did. Bor said she was definitely afraid of O’Connell, of what he’d done to her life and what he threatened to do.

Attorneys for Daniel Myers, the man accused of killing Heather Bogle in April 2015, have filed a flurry of court motions in the death penalty case including one seeking to close future pretrial hearings to the public.

The Toledo-based attorneys, Merle Dech and Jane Roman, filed 22 motions earlier this month on behalf of Myers.

On Wednesday, Sandusky County Common Pleas Judge John Dewey met with the attorneys and scheduled a hearing in Feburary to discuss the motions.

March 27, 2018 Trial Scheduled

Former Sandusky County Sheriff Detective Sean O'Connell was arraigned following his arrest on felony charges related to the Heather Bogle homicide investigation.

During his arraignment in Sandusky County Common Pleas Court, judge released O'Connell on his own recognizance without bond and scheduled O'Connell for a four-day jury trial to begin March 27.

O'Connell, 53, was indicted by a Sandusky County Grand Jury on eight counts — four felonies and four misdemeanors — with seven of the eight charges related his handling of the Bogle homicide.

Daniel Myers murder trial delayed

Myers, 48, of Green Creek Township, is facing a possible death sentence if convicted of murdering Heather Bogle in April 2015.

He will next appear in court at 9:30 a.m. April 23.

The continuance means the trial, which attorneys for both sides had agreed in February on the May 7 start, will not go as planned, according to Sandusky County Common Pleas Court Administrator Brock Kimmet.

Heather's sister, Jennifer Bogle, told the Fremont News Messenger after Monday's pretrial that the family has become frustrated with the delays in the case.

"I was hoping he'd go ahead and plead so we don't have to go through with all of it, but at the same time, we know that he did it," Jennifer said.

Braun and Myers' defense team of Merle Dech and Jane Roman agreed to a Sept. 4 jury trial date.

DNA evidence debated by attorneys in Heather Bogle murder case
A judge ruled on several motions Monday regarding the capital murder case of Daniel Myers, charged in the 2015 slaying of Heather Bogle, including access to DNA evidence collected from fingernail scrapings in the case.

Many of the 53 motions addressed in court Monday were agreed to by both the prosecution and defense, including a motion to extend the deadline for the defense to review discovery evidence.

Overmyer coming home

"FREMONT — Former Sandusky County Sheriff Kyle Overmyer will leave his prison cell to testify at the trial of his former detective, Sean O’Connell.

A July 20 court order commands the Sandusky County sheriff’s office to take custody of Overmyer — who’s imprisoned at Allen-Oakwood Correctional Institution in Lima — for an “interview for trial preparation and for testifying” during O’Connell’s trial.

O’Connell’s trial is slated to start July 30. He faces charges of obstruction, dereliction of duty, coercion, unauthorized use of property, tampering with evidence and falsification related to how he conducted himself during the Heather Bogle homicide investigation.

Bogle was killed April 10, 2015, and O’Connell headed up the investigation of her death for about 15 months before Overmeyer removed him from the case...."

Trial of ex-detective O'Connell set for Monday

"FREMONT - Ex-sheriff's detective Sean O'Connell will stand trial beginning Monday on charges he mishandled the investigation into the homicide of Heather Bogle.

Among the 28 people scheduled to testify is his former boss, Sandusky County ex-Sheriff Kyle Overmyer, who is serving a four-year prison sentence at at the Allen Correctional Facility in Lima.

Overmyer pleaded guilty in December 2016 to stealing prescription pain medication and misusing public funds. He was transported to Fremont and booked into the Sandusky County Jail on Friday morning after being subpoenaed to testify in O'Connell's trial.

Several law enforcement agents from the Clyde and Fremont Police departments and investigators from the Ohio Bureau of Criminal Investigation are also scheduled to testify during the trial....

Seven of the eight charges levied against O'Connell are related to his investigation into the homicide of Bogle, a 28-year-old single mother from Ballville Township who was found dead in the trunk of her vehicle on April 10 2015....

O'Connell was investigated in 2016 by the Lorain County Sheriff's Department for sharing the confidential Bogle investigation file with a worker from the Sandusky County Department of Job and Family Services....

Daniel Myers, 49, of Green Creek Township was arrested in June 2017 and charged with Bogle's murder. He is scheduled to go to trial in September...."

Looks like I missed the hearing on Friday, July 27th for him where they waived the trial, as it was supposed to start 9/4.

Not sure if he still has hearing on 8/13 & 8/20 - thinking not as that has to do with jury selection. I'll try & remember to look mid-week next to see if they have other court dates for him before the 10/22.
