WLWT Channel 5 reports the teen suspect wept Wednesday during her first court appearance. She is accused of killing Nyaira Givens, 13, on Monday, and is facing two counts of murder and one count of felonious assault, Fox 19 reports.

Police tell the Cincinnati Enquirer that officers were called to a residence in the Winton Hills neighborhood of Cincinnati just after 9 p.m. Monday. The stabbing occurred in a green space between two homes, the Enquirer reports.

The two girls reportedly got into a fight and the suspect is accused of pulling out a pocket knife and cutting the side of the Givens’ neck. Givens was taken to Cincinnati Children’s Hospital Medical Center but died of her wounds.

Both girls were seventh-graders at the same school, Local 12 reports, and knew each other before the stabbing.

During Wednesday’s court appearance, a lawyer for the suspect argued that she be released to her mother. However, the magistrate ordered she remain in custody, Local 12 reports.

Nyaira Givens was a freshman at Aiken High School within Cincinnati Public Schools.

Family members and witnesses said Givens got into a fight Monday night near where her family lived. During the fight, police say she was stabbed with a pocket knife.

Givens was taken to Children’s Hospital where she was later pronounced dead.

On Tuesday morning, police charged another 13-year-old girl in the death of Givens. That girl is being held at the Hamilton County Juvenile Detention Center and is due in court Wednesday morning via Zoom.

Family members said Givens and the 13-year-old arrested were former friends, but they didn’t know what the fight was about.

Family described Givens as an outgoing girl who loved to draw, do hair and lit up any room she walked into.

The teen, who we are not naming because she is a minor, appeared before a judge Wednesday on two counts of murder and one count of felonious assault.

Her lawyer asked that the teen be released to her mother but court documents show that her mom is not her legal guardian.

“This juvenile was in the custody of a Miss Blake prior to this. That person by her own admission returned the juvenile to her mother without permission of the court,” Assistant Prosecuting Attorney Joe Prem said.

The suspect’s lawyer said she does not have a record and does well in school.

The judge then ruled that the teen will be held until her next court date on May 3.

It just never stops, does it?
One young gone is gone, and one young girl is in big trouble.
What happened to just pulling another girl's hair and making her scream out of pain and anger, and the other girl say, "B****, stop!" and it's all done. They glare at each other and go to their respective homes.

We've all got a long road ahead of us to achieve some things that shouldn't be as difficult as they will be.

While killings are relatively rare, assaults against juveniles and between juveniles are reported to police nearly every day.

Winton Hills ranks among the most violent neighborhoods for juveniles in Cincinnati with 34 assaults or killings in the past year. The two of the three neighborhoods with more incidents – Westwood and West Price Hill – have significantly higher overall populations and populations of juveniles, according to 2010 Census data.

“I won’t be able to see my baby,” said Ashley Givens, whose daughter Nyaira died at Cincinnati Children’s Hospital. “I can’t see that smile.”

“That was my baby, and they took that,” Ashley said through tears on Wednesday. “They took her from me. They took my baby.”

Ashley says Nyaira, an avid singer, dancer and TikTok artist, endured bullying from the girl prior to Monday’s incident.

“At a point in time, I can honestly say that they were friends,” she explained. “After they had their differences, my daughter pretty much stayed to herself... and ever since then, that’s when the bullying and the rumors and everything started with her.”

“The girl that stabbed my baby... My baby needs justice,” Ashley said. “I need justice. My family needs justice. Her siblings need justice.”

Nyaria Givens, 13, was transferred to Cincinnati Children’s Hospital after being stabbed during an altercation with another 13-year-old girl, WLWT5reported. She later died from her injuries.

“I held her. I watched her as she died. I watched her, you know. All I could do was just hold her,” Maurice Jackson, Givens’ father, told WLWT5.

“ Just tried my best to protect her and be the father I could be, you know? I guess I didn’t pay attention to all the other stuff that was going on around her,” he added.

Jackson also said that his daughter was a freshman at Aiken High School and went to school with the girl who had allegedly stabbed her, according to WLWT5. He said that they were “on and off friends,” but also noted that his daughter was being bullied by the girl.

"Your honor, I know these are very serious, as serious they get, charges, however these are allegations at this point. We're asking if the court would consider releasing her on EMU back to her mother. She's only 13. She goes to Aiken. She has absolutely no record, she's an A student," said her public defender, Kelly Rice-Hunt.
