it is possibly the mmost disturbing case, ever, IMO.
It's worth reading from the beginning, her social media, her dreams, her hopes and that girl kept picking herself up and trying again and again.

It's really very sad.
I hate the dp, find it barbaric, but in this case, it's just not enough!

On Wednesday, the defense’s motion to take the death penalty off the table was delayed again, according to the court hearing.

A state expert hasn’t finished the report to evaluate whether Desean Brown, the accused suspect, is seriously mentally ill as his defense claimed.

At his August trial, Brown’s lawyers filed a motion to exclude the death penalty. Now, the judge in the case will make a decision on the motion on Nov. 28.
 
Thanks @PommyMommy, I was looking for an update on this case today.

As an aside, I don't advocate for the DP in any case. IMO - LWOP saves the family from being endlessly re-victimized by court hearings after the fact. So go ahead, take it off the table.

Brown will never walk a public street again for the rest of his life anyway, regardless of whether he's deemed fit or not.

CINCINNATI — A new motive was revealed Friday in court for the killings of 3-year-old Nylo Lattimore and his 29-year-old mother Nyteisha in December 2020.

Kimberly Kelley, a detective for the Cincinnati Police Department told the judge it appears Nyteisha was pregnant with Desean Brown's child but then had a miscarriage. She said Brown was very upset and thought that Nyteisha killed his baby, so he was going to do something to her baby, Nylo.

Desean Brown, who filed the motion on his own behalf, says because the body of Nylo Lattimore has not been found, the murder charge against him should be dismissed.

Brown and his defense team are claiming he is mentally ill.

According to Ohio law, people with severe mental illness cannot be put to death.

The competency hearing centers on whether the death penalty applies to someone in his mental state. Defense Attorney Martin Pinales, who is not affiliated with this case, said motions like these come with challenges.

"A lot of people who are convicted of any offense, whether there's a death penalty or not, have some degree of mental illness," he said. "The question is 'Is it sufficient to get over the hurdle of the person being so severely ill that they should not receive the death penalty?'"

The judge heard from three experts who testified about Brown's mental capacity. Their opinions were mixed, but they all said he denied any involvement in the murders.

Same guy was making videos of himself dancing, drugging and narcissistically admiring himself in mirrors in the days and weeks immediately following the murders, probably while her body was still in the apartment too.

The suspect, Desean Brown, 23, showed no immediate reaction as Hamilton County Common Pleas Court Judge Megan Shanahan gave her decision and then immediately set his trial for Dec. 5.

Hamilton County Common Pleas Judge Megan Shanahan said Desean Brown may have bipolar disorder, but it didn't affect "his capacity to exercise rational judgment … or appreciate the nature, consequences or wrongfulness of his conduct."

In court Tuesday, Judge Megan Shanahan denied the motion to exclude the death penalty, ruling that while Brown may have been suffering from Bipolar Disorder, his illness did not significantly impact his judgment.

A trial date has been set for the man accused of killing a woman and throwing her three-year-old son in the Ohio River.

Desean Brown, 23, is facing murder charges related to the death of his girlfriend, Nyteisha Lattimore, and the death of her 3-year-old son, Nylo, in December 2020.

A jury trial date was set for Jan. 27, 2025.
 
I thought of Nyteisha & Nylo today. Looked for a more current update, but this is the last MSM report I can find. Still pretty amazed DB is going for a jury trial given the evidence. But I guess the long wait has kept him out of a State Prison, which will be far more detrimental to his health, IYKWIM.

Details of Disappearance​

Nylo was last seen in Cincinnati, Ohio on December 4, 2020. He has never been heard from again and his mother, Nyteisha Lattimore, disappeared with him. They lived on Melrose Avenue in the Walnut Hills area.

At 3:30 a.m. December 12, Nyteisha's body was found inside a body bag near the Purple People Bridge on the Ohio River; she'd been stabbed to death. With her body was a Paw Patrol blanket with Nylo's blood on it. The next day, Nylo's stroller was also found in the river, near where his mother had been located.

Neighbors reported hearing the sounds of a struggle coming from Nylo and Nyteisha's apartment on December 5. Investigators believe Nyteisha was murdered that day by her boyfriend, Desean Brown. Photos of both Nyteisha and Brown are posted with this case summary. Authorities believe Brown threw Nylo from bridge into the Ohio River, still alive, on December 6, five days before he dumped Nyteisha's body.

A few days after Nyteisha's body was found, Brown was charged with murder, felonious assault, gross abuse of a corpse and tampering with evidence in Nyteisha's case. He had purchased a body bag from eBay, and on December 11 he took an Uber ride with the bag to the Ohio River, telling the driver that he was moving out and the bag contained his clothes. In February 2021, Brown was also charged with Nylo's murder.

Brown is awaiting trial in both Nyteisha and Nylo's deaths. Investigators believe he killed them because he blamed Nyteisha for miscarrying his child. He could face the death penalty if convicted. Trial is set to begin in January 2025.

Nylo's body has not been located, but foul play is suspected in his case due to the circumstances involved.
