Not sure what you mean but I have to agree with Betty on this one, that Jake is Ohio's worst - convicted sitting behind bars killer.

Wow, and there ladies and gentlemen is your send him out of state security risk- protecting one out of too many is not impossible, they’ve got it covered but
24/7 then no way! Plus, the potential risk for others being collateral damage or influenced by behavior. Also, factor in that in the first few years just his presence causes prison to be off kilter, just a bit.
It’s probably just my perception of prior experience but claims of his move resulting out of fear by DA of possibility for potential escape doesn’t balance well for me.

In my opinion I do think he shot, and hit Big Chris. But if he did freeze, like they say. I am sure that will haunt him, everyone in prison saying he choked under pressure. That he can not be counted on, and he will choke, if need to have someones back.

Imo, it does not read well... it's not a contest, poor choice of words.

George Wagner IV, convicted in November of 2022 in the Pike County killings, has been transferred out of Ohio.

The Ohio Department of Rehabilitation and Correction confirmed Tuesday that Wagner had been moved out of the state, but did not say where he moved.

I can not access that link for some reason. What is the "amended" part of the motion? If it says? TIA!
I believe it has the attachments to it, I do not think the first one did. I did not read it word for word to compare but that was what it seemed to be.

Thanks for posting. I've read through it and the basic argument appears to be the same - pretrial publicity makes it difficult to seat an impartial jury in Pike County.

They're arguing the media coverage was so extensive that its impossible for potential jurors to "shut it from sight". IIRC, the question judges ask of jurors is whether the media coverage they've seen will make it impossible to render an unbiased verdict. In this time of media saturation and social media, its impossible to avoid pre-trial media coverage.

It also suggests, again, moving the trial to the Columbus metropolitan area, where there are many more citizens eligible to call for jury duty.

It refers to Exhibit G, which isn't here. Perhaps it has source info, etc. for all the data about claims of media saturation prejudicial to GW3.

His only pitiful defense I can see them trying to say is that Jake did all the murders and Jake and AW are lying on Billy. That will work for him the same way George's defense worked for him.

I think in Billy's out of balance mind he thinks he is going to control this trial, the lawyers, the witnesses etc. We may get to see him shocked a few times. I hope they are not rubbing his back in trial like they do in hearings, it is almost more than I can stomach.

“He said he definitely wants to go to trial,” Collins (attorney) said. “He is focused and he is going to be an active participant and he will help in his own defense.”

From one of Billy's Hearings:

Attorney touches Billy's shoulder and points to the judge to get Billy's attention and get him to look at the judge while the judge is addressing the defense. Then the attorney gestures twice to get Billy to stand up while the judge asks him if he's had sufficient access to his attorneys.

Billy answers "Yah."

His attorney tells him to say "your honor" which he then does. Judge continues to ask if he's happy with his representation.

Billy says "So far. I would say at times your honor at times."

Judge asks if he has any complaints - anything he wishes to say?

Billy answers "Nah, not at the moment."

Billy's attorney says:

We also had conversations and correspondence that Mr Wagner's a unique personality, a unique individual very intelligent and at times disagrees with some of the trial strategy, and me myself and the team have met with him and he understands the dynamics and the logistics and he's gonna let us know when he's not happy and when he wants to talk to you about some issues judge.

Is that a fair statement Billy?

We've long known this was the States theory from details they received from Jake. Nonetheless, Billy will be stubborn and demand his day in court where he will deny all and blame his family. What an idiot. Evil too.

Yup.

There just is no way to get around this damaging testimony from Jake.

Yes Jake lies, you could see inconsistent statements from him, but then you also have Angie's damaging testimony on top of Jake's:

Angela Wagner, 52, told the jury that her entire family, husband Billy Wagner and sons George Wagner IV and Jake Wagner, all participated.

Angela said Billy spoke to her in the carport of the Peterson Road home and told her they would have to kill Hanna May, her father, Chris Sr., and her brothers Frankie Rhoden and Chris Rhoden Jr. All of them would have to die, Wagner said, because any one of them would come after Jake and kill him and possibly the rest of the family.

Angela said Jake and Billy instructed her to buy items to carry out the murders: Billy told her to buy a signal jammer that would prevent people from calling 911 and a bug detector.
