I don't comment much but this is outrageous. She repeatedly, knowingly violated a court order many, many times. And her personal responsibilities should not be a factor in deciding if she goes to jail. I am appalled and wonder about this judge. I would like to know more about him and he past rulings. Is he a lenient judge? He ruled no contact but the "above the law ...." did it anyway and he just gives them a slap on the wrist. Words can't describe how angry I am. FW and her bunch must be more powerful than I thought.

This looks like the recording of the entire proceeding from the FB page

Nope, it cuts out the part where AC plays the recording of the phone calls and the Judge gives his ruling.

Of the bad things that happened in this hearing:

  • Defense attorney was a bumbling idiot. He was requesting things he hadn't even filed motions for, and the Judge was practically granting them.

  • AC didn't really object very strenuously to any of this. Junk didn't seem to upset either. I guess they don't mind being made into fools for the rest of these trials as the judge allows the murder co-defendants to flaunt rules and openly discuss how to derail the case.

JMO, but I believe the newsfeed was cut purposely!

Yeah, she's powerful, in ways that have nothing to do with religion or church, JMO. We've been saying that from the beginning, and I still believe it's the reason why it took so long to arrest the W4. JMO, that would never have happened without public pressure and attention on the case, plus an election that was coming up.

What does FW have on these people? Why does the criminal justice system, the AG & prosecutor and the Ohio news media think a bunch of extremely violent, murderous, white nationalist, drug dealing, grifting pseudo-Christians are people to hold in high esteem?

JMO, they and their "gang" must have a lot of dirt on a lot of people. The news media just goes along with whatever the AG's office or the governor tells them to do.

Not sure which infuriates me more...the flagrant disregard ALL SIX of the accused have for the law or the fact that the judge is allowing it to happen.:mad::mad::mad::mad::mad::mad::mad: (one angry face for each of the victims, not enough angry faces in the world for what the survivors of the eight victims are being put through.....) JMO

I sooooo Agree. Very frustrating day.
Bless the Families that sit there and have to swallow this crap time after time.
Justice can be so slow.
Angry face.

Not a lot of dirt, more like mud. Unreal I'll say... once again. Deering is a waffler and it was even more evident in real time.

I'm angry also. I think a lot of us are.

He warned her last time. This judge has major issues.

Deering's ruling:

“It’s a serious thing to violate court orders and you could go to jail,” Deering said. "There’s been a serious violation of this court order, so I’m going to expand the order. No phone calls can be taken from Angela Wagner and no calls are to be taken by her from anyone else in that house.

If the court finds calls are being received or made to Wagner or if people while at that house are receiving or making calls to her then one of two things will happen; you’ll go to jail or you can’t live in that home anymore."

The judge gave her a firm finger wagging and then told her not to do it again and this time he meant it by putting her on the honor system. Get ready folks because next time it could be a written warning.

In June, RN initiates conversation, starts asking where documents are, etc. AW tells RN not to testify against her. Asks Chris to reach Jake. Rita says she hopes she doesn't go to jail. AW gives RN buzzwords to use when she testifies that will help explain. Each asks to talk to the other at different times, when talking to someone else on phone. Very purposeful. AW saying let me tell you what my attorney said, discusses theories of the case that she can use in her trial.
Specifically talking about case strategy, what to say and not to say, whether or not to testify, even knowing they're not supposed to discuss this.

BBM
THIS is outrageous to me.
I don't understand how this was just a slap on the wrist.
Unless the prosecution can use to impeach witnesses.
Ugh so frustrating.

I just came home from work and my biggest fear was realized. Thank you for all the great court reporting and explanations here. It defies logic to think that NUMEROUS people believed they could wipe out families in such a cold, calculated and evil way and think to remain unscathed, unless they knew different IMO. This woman is a party to all of this, now with hard evidence, worries about HER mother and everyone is bending over for her, while these innocent young mothers were slaughtered with their babies by their sides IMOO. This court has redefined logic IMO. Sorry for the rant. I am very worried about the safety of who they may believe is turning evidence against them IMO.

Rant away. I feel the same way. I think a lot of us need ranting time. IMO

Everyone is coming into the courtroom now, sound is on.

Judge is speaking, usual intros.
Five motions pending. First two about compelling discovery. Also motion for change of venue, motion to dismiss and motion to revoke bond.

Something about a conflict of interest having an employee of Pike County present in GJ proceedings. Employee was just a recorder, not part of the investigation and was sworn in like everyone else.

Judge doesn't want defense going on a fishing expedition for info about secret GJ proceedings. Court requires defense to provide evidence that someone was in the GJ who wasn't authorized. No need to question the Pike County recorder about that.

Having RN testify, sworn in. Defense is asking a question about whether there was a police officer in the GJ room. RN doesn't know who was supposed to be there or not. She says there was someone who looked like a policeman there. AC objects - says describe the person. RN says it was a guy who had on a dark blue uniform. Didn't know if he had a gun. RN using a white board to illustrate where this person was.

Junk cross examining. RN says she didn't know who is supposed to be in a GJ room. Person just stood there, didn't talk or ask questions. Was there when she came and left. Pretty sure or 100% sure he was wearing a uniform. She gets testy with Junk. Person didn't say anything to anyone in GJ room.

Video feed off as judge confers w/ attorneys

Betty,

Thank you for posting all of the details and everything that you do in this forum.

Great reference on notaries

Notarization Elements

IMO, the actual documents RN notarized will stand. Not an "alleged" non-official conversation between an attorney and a prosecutor.

Also, there was a good reason RN was never allowed to "view" in DISCOVERY all her GJ testimony, as I'm sure she was shown and verified the signatures in GJ proceedings but was not given copies. Then in DISCOVERY only parts were shown to her, but attorney could view all pages and only verbally tell RN what he read. Sorry I don't have a link to the Discovery documents. JMO

BBM, IMO I think they WILL stand. In OH a notary public can only witness the signing of a document while it is in progress by the signer in front of the notary. And the notary cannot witness the signatures of their own family members. (I’m looking for the rule, they recently rescinded some rules and new rules effective 9/20/19 so it may take me a bit. So this is moo). If the documents were signed in Pike Co then taken to RN to “witness” in Scioto Co then she is bearing false witness. I’m trying to understand a scenario where BW would be signing the documents. Evidently they needed notarized signatures of 2 signers. Count 18 on BW indictment https://www.ohioattorneygeneral.gov...Prosecutions/PikeCountyMurderIndictments.aspx
Further,

"These include an application for the appointment of a guardian, a complete listing of the minor child's next of kin with addresses, and a form identifying the child on which the magistrate can set a hearing on the application. Any interested person can initiate the proceedings." (Click on form link above. Same form RN notarized for HR and the W boys in case they died, too....JMO)

How is a Guardian Appointed for a Child When a Parent Dies?

I'm not certain this is the exact form in question since Discovery calls it a DECLARATION OF APPOINTMENT OF GUARDIANSHIP.....

Any help on finding the form named would be appreciated.

All JMO

I have a blank copy of a form called “Declaration of Appointment of Guardianship in the Event of My Death or Incapacity” that I have in my Rhoden/Gilley Murders notes. It’s in my Dropbox but I can’t figure out yet how to get it from there to here.I’m not sure where I got it but I’m 99% sure it was from my investigation or I wouldn’t have it. As soon as I can figure it out I will post it.
