This is complete speculation on my part, but I wonder if Billy has untreated learning disabilities. I noticed on GWWII's death certificate his level of education was listed as - less than 8th grade. Maybe a learning disability genetically passed on from his father?

I think the purpose of the ordered evaluation is to create doubt he was the mastermind and if that doesn't work, the basis of an appeal if there is a guilty verdict.

It could also serve to keep him from receiving the DP, if convicted and given that penalty. He would be precluded, if his IQ is low enough.

I'm not yellowbeak, but what I think the poster meant is that if he is claiming "not to be" the mastermind, in a way he is admitting that he did take part in the murders but one of the other 3 was "the mastermind".

Oh yah! My client isn't the mastermind with his 7th grade education , oops! I mean he didn't participate at all. No I mean none of them did.

I think the challenge for the prosecution is the order in which to try the cases. They will want to lead with their strongest case. The prosecution wants to show the public too that they 100% have the right perpetrators. I think that is why GW4 didn't waive time until the last minute. I believe his case is the weakest in terms of evidence and motive, and his attorney knows this and wanted him to be tried first.

I think if the prosecution can get the trial dates solid AND get GW4's trial scheduled last, they can use that as pressure for him to take a plea. Would you want to be the last person tried after three trials proving these horrific crimes? And I do believe they have a ton of evidence, showing this horrible massacre against an entire family.

@Daytocincy I think that GW 4 will go first. His trial was set for September 4 but was bumped because his attorneys were still receiving evidence.

I don't think his case is the weakest even though there is no DNA. Wait, I think there is DNA listed now.....But whose?

GW4 really wants out of there and I'm guessing he wants his trial to start as soon as possible. His attorneys said it's a 2 month trial so I predict November/December or January/February.

JMO, the defense attorneys are still trying to decide which case they want tried first. Maybe they're not all in agreement. For a while, it looked like GW4 was going to be tried first, but his attorneys recently introduced that big batch of motions. That happened right after RN's hearing revealed so much bad information about AW and her scheming phone calls. Could be the attorneys are re-evaluating things. Maybe they're waiting to see what comes out at RN's trial.

All JMO and I could be wrong, but the timing of GW4's attorney launching a bunch of motions seemed possibly significant.

Yeah, i think all that will come into play. Which defendants attorneys came out with the most motions early on? Wasn't that AW and JW? Were they trying to go first? How much evidence still needs to be turned over? Does AC have some strategy for that? She most likely wants to try first the one who has the most evidence against them. I've been busy, haven't been thinking about the cases much at all, but maybe time to review again.

IMO, the EVIDENCE will show beyond a reasonable doubt that all four of the Wagners knew full well what they were doing when they "planned, premeditated and carried out these brutal murders, from beginning to end. The defense knows this, yet it is their "job" to get these murderers "off." I hope and pray with all my being that Justice for the Rhodens and H. Gilley will be served brutally, swiftly and without mercy, exactly in the same manner their lives were taken that awful day in April 2016. Say or think whatever you want, about me, but I stand for the victims and their families. And I condemn their killers, all the way to the Death Penalty, because that is the sentence proposed by the laws of the State of Ohio based on the evidence found from a very long investigation. All just my opinion, based on everything presented in these cases thus far. I am a person of great dignity, integrity and faith and I pray my conscience would never let me live through the taking of another life, let alone blatantly denying and lying about doing such. JMO

Suds turned 5 shortly after the arrests so she will be 6 in 2 months. Yes BR was 3 back then so he is at least 6 if not 7, and wow, Ky will be 3 1\2 next month! Don't forget Rug, he will be 4 soon.
Tony Rhoden asked a relative if he can be a part of BR's life, said he wanted to be close to him, and I think all these kids and the extended family are all a part of each other's lives. I hope so because it would help them heal and the more family ties the better. All my 2 Cents only.
