Regarding my post about the male being handcuffed the day of the murders. If I did, I did not mean to cause any problems. I had never seen that picture before and did not know for sure who was being handcuffed. I do appreciate all the replies.

I don’t believe your post caused any problems as it generated good discussion and more importantly reminded us of the first day and the difficulties the Manley family faced. Sometimes unfairly or unfortunately necessary by LE protocol but still hurtful.
All while dealing with the horrific murders of their beloved family members.
I remember LM and how angry he was. And rightfully so. May LM RIP.

I found the answer to this question. During my searching yesterday I came across pictures from the Cincinnati channel 5 media . Among those pictures were about five pictures of a male talking with officers and then being handcuffed in front of DR’s driveway.

Are these the photos? I see a man in a gray T-shirt talking to officers at the end of Dana's driveway, then walking towards the black truck, then he is standing at the door of the black truck with an officer with him with his hands behind his back.

Those pictures are not of anyone being arrested, their hands are behind their back, so they do not accidentally touch the truck, and another man is just resting his hands behind his back. There was confusion when the photos were first published, and determined to be just hands held behind their back.

Thursday, February 17th:
*Pretrial Hearing (@ 3pm ET) - Civil case vs. Carman Pendleton - *Fredericka Carol Wagner (76/now 79) on 9/9/21 Civil complaint in foreclosure.
9/9/21 Update: Summons on foreclosure served on Carman Pendleton.10/6/21 Update: Civil status conference hearing held & conducted by telephone. 12/1/21: Returned failure of ordinary mail on Carman Pendleton/not deliverable as addressed.
12/23/21 Update: Judge Randy D. Deering. It is ordered that all Discovery shall be completed no later than 2/9/22 & further ordered that a pretrial hearing is scheduled on 2/17/22 @ 3pm. And all parties & attorneys are required to attend in person.
*OH - Pike County 8 people dead: Christopher Rhoden, Sr. (40), his ex-wife, Dana Manley Rhoden (37), their three children, Clarence "Frankie" Rhoden (20), Christopher Jr. (16), Hanna Mae (19); Frankie's fiancée, Hannah Hazel Gilley (20), Christopher Rhoden Sr.'s brother, Kenneth Rhoden (44), & a cousin, Gary Rhoden (38). Hanna Rhoden's baby girl (5 days old), another baby (6 mos) & a young child (3) were unharmed. (April 21-22, 2016, Pebbles) – for *Fredericka Carol Wagner (76/now 79) (Paternal grandmother) indicted (11/12/18), arrested (11/13/18) , charged & arraigned (11/15/18) with 1 count of 3rd degree perjury & 1 count of 5th degree obstruction of justice. Plead not guilty. $100K Surety bond.
6/26/19 Update: State is asking that a charge be dismissed without prejudice. No objection by defense on dismissal. Case discussed without prejudice. Bond is released. The dismissal was so prosecution can analyze further NEW AND FAVORABLE evidence without running out of speedy trial time. Charges could be refiled. There’s a six-year statute of limitations. The gag order over the case survives the dismissal, per order of Judge Deering. The new information being analyzed presumably stems from what was provided by defense in March which Owen had argued proved Wagner's innocence.

When is the six years up? The six year date of her grand jury testimony?

No legal knowledge - but I "think" it is from when they dismissed the case - but I'm sure someone will correct me if I'm wrong. :)

Yes. July 2024.

It will be 4 years this July and with so much time going by I do not think they will ever refile charges against her.

Ditto JM. Will be 5 years this May 16th since his 2 felony charges were filed.

Can't say I blame him. Its probably been difficult to spend time in court during the pandemic. A lot of people have taken retirement. With Jake's plea deal, his attorneys don't have as much work ahead of them.

We shall see. It probably depends on how the trials for the 2 Georges proceed. If there's any new evidence or testimony that turns up.

I wonder if Jake's 2 attorneys will be sitting with the prosecution when he testifies. Technically they won't be involved but then again they don't want him to screw up what he says and end up under the DP again.

Wouldn’t they need to be there on his behalf to object to questions?

The prosecution is there already to object to questions. Not sure if Jake's own attorneys could also be involved with that.

IANAL, but the defense will probably question Jake if he takes the stand to testify. The defense attorneys will probably try to contest Jake's statements, get him to contradict himself, etc. so they can cast doubt on his confession/testimony in front of the jurors.

JMO, George4's attorneys will try to do this.

All the defense will be doing is asking Jake questions. They made it clear they have 10 "snippets" in his proffer they want to bring out and that is only the beginning because there are 12 hours of interviews.

"Mr. Wagner you testified in your proffer with the State that George tried to talk you out of these murders isn't that true......?"

"What did he say.....?"

"Mr. Wagner you testified that George didn't shoot anyone is that correct.......?"

"Mr. Wagner you testified that George only went along at the last second to protect you from your father, why did George feel he had to protect you.....?"

"Mr Wagner, you were the one who did XYZ not George correct....?"

"George didn't have any involvement in those plans did he Mr Wagner....?"

"You made all those purchases not George, isn't that true....?"

ETC......

Yes, they'll be questions with an agenda.

JMO, the goal will be to try to make it appear Jake is being dishonest and George 4 as pure as the driven snow. He'll probably try to get Jake to say George 4 wasn't even there that night. :rolleyes:;)

It's what defense attorneys do. The prosecution will be prepared, though.
