GUILTY OH - Reann Murphy, 9, raped & murdered, Smithville, 14 Dec 2013

I think I read that she was reported missing after the people at the trailer park had searched every where.

Kidnapping and rape too? OMG, I knew it would be like this (rape) but started thinking he may have only strangled her for wrecking the snowman they built or something so mundane. Horrible horrible. No sympathy here from me, regardless of his "mental age", etc. JMO

I had allowed myself to hope she was spared the indignity of rape. I should have known better :(

I had that same hope. That poor child. :(

Does anybody know why there are multiple numbers of each of the charges -two counts of aggravated murder, three counts of kidnapping and two counts of rape?

Just trying to understand the legal reasons for multiple indictments for each crime.

It seems common in these cases - covering all the possible bases. The Daily Record article (http://www.the-daily-record.com/loc...-jury-indicts-metsker-in-reann-murphy-s-death) details each count so you can see the differences between each. Gives the prosecution more options if a piece of evidence falls down, I guess.

I was hoping the same thing. I had hoped this was an accident somehow.

Not a surprise, but still horrifying and heartbreaking to know.

I'm sorry Reann. X

Poor, beautiful, little Reann. :( We were all hoping this wasn't the case, but we knew better. What a monster!

Part of me empathizes with his mom, and then part of me hopes that she lives with the guilt of leaving him home unsupervised for the rest of her life! Seriously, what the hell was she thinking?!

:furious: JM is one sick, cruel, evil "unusual person"... :furious:

(Note: Unusual Person is used in place of words that I could get in trouble for...)

I have NO words. None. I'm absolutely totally disgusted. I shouldn't have listened to that 911 call. It hurts me to know her step-dad (I know it's her moms bf) is right there, panicking and the person who KILLED and RAPED her is standing next to him..

all the while they are calling out her name and she's in a dumpster.

I hope this tape is played to the jury. I do not believe in the death penalty, so I hope he's openly mocked and denied compassion his entire existence

a 7 yr old mentality (if that is true, we have only neighbors' words for that) within a grown man's body. So with grown man urges and sex drives.

I don't think the neighbors really considered that aspect while allowing their children to play "clubhouse" under blankets with this man.

All it took, was apparently the one opportunity to have the right child alone with no other witnesses about.

This is tragic.

Showing my ignorance, but how do you get charged two counts aggravated murder and 3 counts of kidnapping when you only have one victim?

I do not for one minute believe the "7 yr old mentality" bit, in fact not even for a second. He may very well be on the spectrum and have diminished capacity, but I think he's been fooling people for a long time. He seemed more on the level of a teenager than a 7 yr old in the 911 call. JMO

I agree... His 9-1-1 call indicated to me a person much older (mentally) than 7 years old...

Showing my ignorance, but how do you get charged two counts aggravated murder and 3 counts of kidnapping when you only have one victim?
In this particular case, COUNT ONE of Aggravated Murder says (BBM):
Aggravated Murder, a felony of the unspecified degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely cause the death of Reann Murphy, born October 30, 2004, who was under the age of thirteen years of age at the time of the commission of the offense, with the following specifications:

COUNT TWO says: Aggravated Murder, a felony of the unspecified degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely cause the death of Reann Murphy, born October 30, 2004, while committing, or attempting to commit, or while fleeing immediately after committing or attempting to commit the offense of Kidnapping and/or Rape, with the following specifications:

If they were unable to prove that he killed her "while committing, or attempting to commit, or while fleeing immediately after committing or attempting to commit the offense of Kidnapping and/or Rape", they could definitely prove that she was under 13. If found guilty, better to get him on both/everything, so that he could serve all sentences consecutively (one after the other) and be less likely to EVER come up for parole or get out.

There are similar difference in the other charges.

Thank you for the clarification, Ghostwheel...:seeya:

I agree. Am thinking more along lines of an auditory processing disorder which not handled properly causes all sorts of learning/communication difficulties but doesn't mean lower iq, mental ability etc. Poor Reann & her family. Cyber hugs and support to them.
