Ohio is a death penalty state and they put another baby killer/rapist to death by lethal injection this year after 20 years of legal appeals.

Yes. I liked how it went to the Supreme Court, he tried to use his age, as a "teen", so he wouldn't be put to death. He was 19 at the time.

I don't care how old you are when you commit a crime like this. There is zero chance of Rehabilitation here. Something is wired all wrong

Conneaut mother charged in connection with death of 13-month-old daughter

The Ashtabula County Prosecutor's Office announced on Friday that the mother of a 13-month-old girl who was raped and killed last October has been charged in connection with her death.

Kelsie Blankenship, of Conneaut, was arrested on Friday and has been charged with murder, felonious assault, endangering children and domestic violence, Ashtabula County officials said in a news conference.

The mother's boyfriend, Joshua Gurto, 38, fled the area but was later arrested by the U.S. Marshals Service in Alleghany County, Pennsylvania. He was charged with aggravated murder, murder, rape, felonious assault and domestic violence and transported back to Ashtabula County.

Prosecutors initially sought the death penalty for Gurto, but authorities said on Friday they have filed a motion to dismiss the death penalty.

Gurto's trial is scheduled for April 2, 2019.

The defense for a woman accused of murdering her 13-month-old daughter last year says the prosecution has not made clear what she is accused of doing.

Public Defender Marie Lane wants County Prosecutor Nicholas Iarocci to provide what is known as a bill of particulars, which details the conduct of Kelsie Marie Blankenship that led to her murder indictment.

“The review of the voluminous discovery received in this matter does not provide any indication of Kelsie’s conduct other than Kelsie was present in the home,” Lane wrote.

“The discovery does not reveal any evidence new to the investigation that would justify the delay in Kelsie’s indictment, or to explain the allegations of her conduct, especially considering her continued cooperation in this matter. The lack of knowledge concerning the specific facts is prejudicing her ability to prepare a defense.”

It sounds like the defense wants specifics. Like HOW did she commit these crimes. The prosecution is claiming that what they have given (the indictment and discovery) is sufficient. The way this prosecutor is talking sounds very familiar so I'm probably not very unbiased here. That may or may not be the case. Here's an example I dealt with.

We had a client that was charged with a crime that occurred between January 1, 2013 and August 31, 2015. Seriously? Dude probably has an alibi (out of state, in the hospital, at work, even in jail) but how are we supposed to provide that with a 32 month time frame?

We filed a Bill of Particulars asking the to narrow down the time frame a little. Even if they just narrowed it down to the season! Since he does seasonal work, that might be enough. We had zero luck. The prosecution refused and the judge agreed they didn't have to.

So it's possible that her defense really does NOT have more information and DOES need it. We sure could use it in a lot of our cases!
