From my read of Oregon law, I don't think, from what we know now, this would be kidnapping. Kidnapping must be without consent. If she went with him voluntarily, and continues to remain with him voluntarily (free of threats or violence etc.), that is not kidnapping. It would, however, appear to be custodial interference, even if she went with him willingly and remains with him willingly. Of course, if he is having any kind of sexual contact with her (god forbid), she is not old enough to consent to that, and even if she did that "willingly," that would be its own separate crime.

There are two weapons shown in a photo on her ink [aka instragram] page with the caption "my babies". Would be good to know if those are missing as well.

Her instagram profile reads: "future marine! Single. 13. d.j. artist. boxer. guns and knives are my life".

The photo with the caption "goodbye to all my friends. I love guys." appears to be a selfie taken in a public restroom.

All very disturbing........

Call me old fashioned but I can't get my head around a 13 year old having a profile of

"guns and knives are my life" and calling two weapons "her babies".

The "good bye to all my friends. I love you guys." Does this have a date on it? It would have been taken before she left as the phone was found at home. But if it was taken days before then there would have been some planning put into her disappearance .

On S.'s father's FB page there are several photographs, one dated November 30, of the family sitting at a table in a restaurant. Isn't that McCune sitting directly across from S.? Look at the shape of his eyebrows and what you can see of his ears. I had to enlarge the photo several times to compare it with the photo released by LE but if that's McCune, and I think it is, his head is shaved now. S. has cut her hair and as well as colored it sometime since this photo was made, too. It at least seems that they were making some attempts to change their appearance in the days preceding December 3/4.

I don't know anything about this site so I have no idea what the date means but at the top of the photo it says, "2 days ago" -- I assume that is when the photo was posted but I can't say for sure.

Oh my...

A 13 year old with a 40 year old male... So,scary...

And... I cannot imagine too many places in Oregon ...or anywhere in the US for that matter ...that would be a warm, safe place for camping... Unless one or both of them are very experienced, prepared, and resourceful campers...

I agree!! It's supposed to get down to 7* F here in the sierras on Sat. most of OR and WA are experiencing the same cold front. Even friends in AZ are complaining of the cold. camping anywhere on the west coast right now would be insane. I hope and pray that she is safe and warm somewhere, and found soon!

Another young teen with an adult missing! I will keep praying over these two, they are so young! And it is very, very cold in the PNW.

Do most states consider a child under a certain age to be not capable of consent? I know that in some instances predators have lured younger children into vehicles on some pretense of looking for a lost dog or some such, and that was considered kidnapping or abduction. Technically, the child went willingly, so perhaps if they are over the age of 12, the law says they are old enough to consent and it's not kidnapping?

I don't think to most parents, they would accept that their child wasn't lured, coerced, or whatever, just because they were 13... most of us would think 'abduction' because a 13-yr. old is definitely not mature enough to consider the consequences of such a thing.

But the law is the law, and we can't change it. Still... I would want the guy punished severely... it's not right!

I asked a similar question. What I got out of it is that even if she went willingly, that man has no legal guardianship over her, and her parents didn't consent on him taking her. So that would be considered kidnapping, even if she didn't resist or went willingly. A minor isn't able to consent to anything without parent consent with another adult. Am I wrong with that statement?

If you scroll through that whole photo album, it appears to be a photo journal of a trip to buy fireworks from stands at a native American reservation in Skagit County, Washington, which is north of Seattle. The photo is posed, and two other men are also shown, one of whom also has the same last name as KM (brother? cousin?). The later photos show them taking apart some devices and making their own bottle rockets and blowing up eggplants and watermelons. There's kind of a jokey tone to the captions for the photos and I got the impression that his pose for that photo was intentionally made to look like a doofus who loses fingers to a fireworks device. (could that be how he lost his eye in years prior?). There are more photos of him on the subsequent pages of the album. Also a short video.

Because it's from ten years ago, I wonder if he lived in that area at one time. It would be a long way to drive from the Portland area just to buy fireworks, when all they would have to do is cross the river into Vancouver, Washington to buy them from one of the legal stands.

If he's shaved his head and still has the facial hair, he could be going for the look of Walter White, the main character in the tv series Breaking Bad (about a high school science teacher turned meth-cooker extraordinaire). If you look at her instagram page, she has done a drawing of Walter (3rd row from the top, far right photo). She also seems to be a fan of The Walking Dead, a tv series based around an apocalyptic zombie outbreak, as there are several references to killing zombies ("double-tap"), and a drawing of Daryl Dixon, one of the main characters of that show (4th row, first picture).

I'm getting the impression KM may have lured her away from her family on some premise of playing a make-believe game of zombie hunting and survivalist living. Not sure how Breaking Bad fits in, unless this guy is a meth user/cooker.

I nosed around FB quite a bit. The man you are speaking of is, I believe, an entirely different friend of the fmaily with his own page and profile, NOT McCune.
