My main hope springs from the State making it quite clear that they will appeal any sentence considered lenient in relation to the crime. If MrJitty sees this, do you think that that knowledge will play into Masipa's sentencing or will she just go her own merry way? I wouldn't have thought she would want to be overruled again.
BIB - Me neither, but you can see the way she was leaning after dismissing his bad prison behaviour as only having been "at the beginning." Not every prisoner treats prison staff with disrespect, but for OP, it's in his nature to treat other people that way. That's who he is. Someone who thinks he's better than everyone else and who must have his needs met.

How could such a broken and depressed person be perfectly okay to do a TV interview, but not take the stand? Did Masipa wonder about that? Probably not as she was no doubt distracted by her bun and whether it needed to be rearranged in between tea breaks.

I think we all knew that 'health' issues would come up as another way to avoid jail. The whole world, bar the tiniest minority, can see right through OP. A liar, a coward, and manipulative as hell. All this BS about wanting to do charity work and use his skills to "help" people. Help himself more like. And since when do common murderers get to choose their own punishment? Stick him back in the slammer and let him use his 'skills' in there.

All three of him are still alive though, and none of his family have had to endure the news that he was shot and killed while cowering in fear in a toilet. However 'broken' he is, he can be out of jail before he's even 40, leaving himself a potential 50 years of life ahead of him. Reeva has no life left, and her family will never see her again. OP's situation is entirely of his own making. If he ever expects anyone to believe he cared about Reeva at all, he should shut the hell up, stop portraying himself as the victim, be grateful for all the time he's been able to spend (as a convicted murderer) at the luxury mansion, and start paying for his crime. But that would take someone with a moral compass, and he doesn't have one.

The family business H Pistorius & Co‚ along with its rivals in the fertiliser industry and the Fertilizer Society of South Africa‚ will appear before the competition tribunal over claims that they were part of a 13-year price-fixing racket. Last year‚ it was reported that the Competition Commission favoured an administrative penalty of 10 percent of the company's turnover over the period of the alleged price-fixing‚ related to the fixing of agents commissions.

Minimum he will be mid 40s when he gets out. Maybe his enabler family can babysit him then.
This judge. I just cringe. It's like Groundhog Day judge.

Appeals against sentence are fairly common.

The defence is bound to appeal unless they get something extremely favourable.
 
If Masipa factors in depression and being 'broken' as a reason not to send that killer back to prison, then all murderers must be entitled to avoid punishment just by saying they're 'broken'. Telling Nel that the "aggressive and verbal" abuse directed at staff was only at the beginning" shows the lengths she will go to in order to defend a convicted murderer. But hey. This is the same person who reduced Reeva to being "good in front of a camera" and downplayed all the abusive texts the killer sent Reeva. She has about much sympathy for the victim as OP does.

BIB Yes it's a sorry reality that because of the way that sentences are calculated over there, "the triad of Zinn" aspects, we talked so much about ( before the WS thread got closed down) , the factors concerning the perpetrator are one of three elements in sentencing. ( The other two are the needs of society and the details of the crime IIRC) .

So the impact on OP, of his own crime, is a factor!:scared:
The more successful he was, the more he has lost therefore the quality of mercy......

I heard one SA lawyer say about OP, " he has rights too. ", "mercy" for OP will factor in her decision-making.
It's like a set of scales with 3 weighing plates - she has to weigh the three factors altogether.

Agree. We made a list of things we thought he would try and use as mitigation. Media & Mental Health were on there.

On media - he cannot have it all ways - Scholtz said that the media scrutiny & also "vilification" by the media was exacerbating his dire Mental Health issues - but he then chooses to participate in an exclusive TV interview which will be reported worldwide.
( Sneaky Arnold says it was his choice, not Oscars - what is OP then a ventriloquist's dummy ?- and also time the broadcast date after the sentencing. )
It would be ironic if, due to delays and Defense ploys, the sentencing was delayed beyond the broadcast date.

BTW I had a look last night when I came in - OP's private psychiatrist Dr. Bosch and psychologist Dr.Scholtz are both from the same training ground & later workplace.
Univ Pretoria & Weskoppies.
Whilst that may signify nothing,I wouldn't be surprised if they already knew each other well and one recommended the other for the Defence team.
 
Good morning everyone. This is O/T but is huge breaking news in SA, Henri van Breda has been arrested and charged with the axe murder of his parents and brother and the attempted murder of his sister who somehow miraculously survived. This is another extremely wealthy family.
 
The part that I find hard to understand is where I come from High Court Judges are not to be messed with.

That is how we learned! You don't go into Court and mess up or you would get torn a new one!

So to come waltzing into Court having done media work, but then don't front as a witness, and instead get an expert to introduce all your stuff as hearsay evidence...

That would earn you a dressing down!

Surely a Judge ought to be asking Mr Roux that if he wishes to introduce the state of mind of the accused as to acceptance of the murder, the accused shall give the evidence!

Absolutely. As Nel is dealing with a biased and totally incompetent judge, when he was applying the blowtorch to Scholtz yesterday IMO he should have said in so many words, "Professor, that is hearsay. Only Mr Pistorius can tell us this" each and every time. I know it was alluded to, but Masipa is so dense that it needs to be spelled out in clear words that even a ninny could understand. Subtlety will go right over her head.

It's just normally the case is not televised

As usual, it was concerning how Masipa fails to ensure the integrity of evidential procedure.

To me it is baffling that one expert should seek to introduce so much material in his EiC that was outside his own direct experience

Much of this evidence by the good doctor sounds like very juicy cross examination meat. This could get ugly.

This turned into a disaster in cross.

Especially the fiasco around the complaints register was humiliating for the witness and highlighted the lack of technical quality that seems to be common place in RSA proceedings!
 
Since when are we interested in his state of mind after the offence. Masipa said he showed remorse immediately after the murder, crying, praying to god, blah, blah, blah. I'd like a dollar for every time I've seen someone do that after committing murder. It's almost expected. I can't tell you how sickened I was by Scholtz and the defence team. I'm angry, I'm upset, but I was expecting it. That didn't help though.

It was a strange and awkward moment

The Judge had already overruled Roux and allowed significant latitude on the cross examination "on the conversation",

Nel then stated he could not accept the evidence to which the Judge stated that he did not have to.

I think in the ordinary course, a prosecutor would have registered a strong protest with the bench, or wish it noted for the record, that the defence was trying to introduce a significant hearsay component via the back door - though Nel did say that in so many words.

I guess he just did not want to unduly annoy Masipa
