hard to understand, in light of what nel is saying today... that the pt were previously prepared to appeal if the sentence was 8 years. why not appeal anything under 15?

It should just be weighty considerations. It should be recognized that this particular crime has been singled out for specific sentencing requirements. Correctional supervision does not pay due regard to the benchmark set out by the legislature.

The specified sentence should not be departed from for speculative reasons in favor of the accused.

The sentence should be proportionate to the crime.

The accused served a sentence of 1 year in a hospital wing in a prison. He was not locked up in a small cell for 18 hours a day as Scholtz testified. He had to retract his statement. Mashabane said he had two cells in a wing with one other prisoner, access to a makeshift gym, etc.

Nel telling Masipa that court's have a duty to impose minimum sentences.

Matchitchi (sp?) was a 2011 judgment in which the ACA said that criminality was on the rise despite minimum sentencing. It still is no longer business as usual, but sentencing courts are still deviating from minimum sentencing requirements based on the flimsiest reasons.

It should be the DUTY of the court to follow the sentencing guidelines.

I appreciate that no one could have thought they were justified to fire at a person in the circumstances and he will see prison time for that.

But this was mitigation.

it's not actually mitigation, though. It's irrelevant.
