It breaks my heart when I read all the case on WS of case solving in children that don't lead to prosecution and conviction. Sadly I agree that the key POI in this case will never be made accountable for this heinous crime.

I agree. The rumor being presented doesn't make much sense to me. That's the problem with bringing rumors from other sites here IMO.

I'm not sure if Colorado will execute anyone let alone Mark Redwine. Colorado has only executed one person since 1977 and that was nearly 20 years ago.


Colorado was the last state to perform an execution in the pre-Furman period (1967),[SUP][1][/SUP] but since 1977 executed only one prisoner, and may thus be considered as de facto abolitionist since October 11, 2007.

They would need to prove at least one of seventeen aggravating factors to get a death penalty.

Colorado-
(1)The murder was especially heinous, atrocious, cruel, or depraved (or involved torture)
(2) The defendant knowingly created a grave risk of death for one or more persons in addition to the victim of the offense
(3) The defendant killed the victim while lying in wait
(4) The murder was committed for pecuniary gain or pursuant to an agreement that the defendant would receive something of value
(5)The defendant caused or directed another to commit murder, or the defendant procured the commission of the offense by payment, promise of payment, or anything of pecuniary value
(6) The murder was committed to avoid or prevent arrest, to effect an escape, or to conceal the commission of a crime
(7) The defendant has been convicted of, or committed, a prior murder, a felony involving violence, or other serious felony
(8) The capital offense was committed by a person who is incarcerated, has escaped, is on probation, is in jail, or is under a sentence of imprisonment
(9) The victim was a government employee, including peace officers, police officers, federal agents, firefighters, judges, jurors, defense attorneys, and prosecutors, in the course of his or her duties
(10) The victim was an elected or appointed official or former official of the federal government, or local or state government, and the killing intentionally prevented the victim’s official duties
(11)The murder was committed against a person held as a shield, as a hostage, or for ransom
(12)The defendant used chemical, biological, or radiological weapons and/or the person intentionally killed more than one person in one criminal episode
(13)The victim was a pregnant woman and the defendant intentionally killed the victim, knowing she was pregnant
(14)The defendant committed treason
(15)The defendant’s possession of the weapon used to commit the class 1 felony constituted a felony offense under the laws of the state
(16)The defendant intentionally killed more than one person in more than one criminal episode
(17)The defendant committed the class 1 felony against thevictim because of the victim’s race, color, ancestry, religion or national origin

I have doubts that the State could do that.

I like the idea of waiting until enough evidence for a murder one conviction is found.

The current evidence may only actually prove that, yes, a violent death did occurr. We've all read and watched enough interviews to have a pretty clear idea who caused the violent death but without a few key pieces of info it, unfortunately, is easy to argue against the who and the why.

That being said, if I remember correctly, that one way plane ticket was a legit purchase; no nefarious reason behind it. Again, if I remember correctly, it was the mother's responsibility to get Dylan home. Her plan was to pick up Dylan by car.

Is there a possibiliy tthey have located more of his remains and no one really kows? Ad maybe they are able to piece it together. There has to be a logical reason tthey deem this a homicide based on a couple of bonnes. And I just don't beliee ttthe comment of where his remains were locaed as the determining factor of homicide. They have to have more tha juus the location of the bones to state homicide. right? I just hope and pray Dylan will get some sweet justice. RiP Dylan Redwine

That is exactly what I'm hoping and have been for months. I think they found a lot more than we know. IIRC the only way we know '' 2%'' was found is from Mark's own mouth.

Bill 34 = a bill that would create harsher penalties for those convicted of tampering with dead bodies in an effort to hide evidence.

So, do we take this to mean that LE has actual proof that Redwine moved Dylans body/bones, from under the back stairs maybe, but still nothing to connect him to the murder?

I take it to mean that at least EH has a working theory about what MR did with Dylan after he killed him. A working theory that she feels strongly enough about to lobby for this bill.

Wouldn't LE bring charges against MR if they had "proof" he tampered with Dylan's body (by moving him at some point)? Not charges of murder but charges of abuse of a corpse? It's happened in other cases. Maybe, though, LE is wanting to bring full murder charges against him and don't want to muck it up with smaller charges first.

I'm very curious.

Even if this case never gets to trial, rest assured that every day of his life POI is locked away in his own personal prison. He'll not live a full, rich, long life -- it's too late for that.

Dylan's Mom is still young, she has the promise of a rewarding and happy life ahead of her. She's moving on, and will get past this. As a mother, who did not lose my son, I put myself in her place and ask, "what if...?" My heart breaks for Elaine, but I get a sense that she has become strong in her battle, and will continue to go on with her new life. Yes, it's sad that it no longer includes Dylan, here on this earth, but what is left for her are her priceless sons, other loving family members, and countless friends, some whom she will never personally meet. They will ease her pain and partially fill the void.

I hope that we can all accept the possibility that justice, as we know it, will most likely never be served for Dylan's murder. There is one consolation, and it is this:
He may have wrought this tragedy and travesty of justice upon her, but this POI will not rob her of what rewards the future holds.

"LA PLATA COUNTY - A filing mistake led to the dismissal of the wrongful death lawsuit against Mark Redwine by his ex-wife, Elaine, with regards to the death of theri son Dylan, 9Wants To Know has learned.
According to an attorney for Elaine Redwine, the wrongful death suit was filed four days after the statute of limitations had run out on filing such a suit."

"The suit was filed in July 2015 claiming that Mark was responsible in the death of their son Dylan.
According to court records, the suit was officially dismissed on Dec. 28, 2015. According to Amber Cone, the court ruled the suit should have been filed two years after the date his remains were discovered. The wrongful death suit was actually filed two years after the date the Redwine’s were notified the remains that were found belonged to Dylan. That was a difference of just four days."

Maybe that case being dismissed is a blessing in disguise for Elaine. That would have been a grueling, hellish ordeal for her, in my opinion. She has a little grand baby now. Maybe it is better for her in the long run, to not have to put herself and her family through that civil trial. :candle:
