I agree this was a great mistake by the defense in having ALV testify during penalty phase. But even during mitigation, her CV would have been discussed ad nauseum still, and JM would have caught her lying, so the biggest mistake the defense made was ever putting her on the stand at all. And still she goes to CNN and can't tell the truth. Sad. :stormingmad:

Well, they had to have some "expert witness" to back up their DV claim and the pickings seem mighty slim for what they were willing to divulge to that expert, which is likely why so many others weren't chosen or passed on the opportunity.

And ALV might have gotten away with less scrutiny had she only been in the mitigation phase, we can only suppose what might have been had the original plan, and the one she interviewed JA in mind with, been the one that occurred in court.

She really shouldn't be putting her face back on TV now though, it is not helping her one bit in the arena of public opinion.

What also hurt her credibility with me was the way she talked to JM. IF she is truly a professional she would know the prosecutor wasn't going to give softball questions. Then she says, "Are you mad at me Mr. Martinez?". Such a joke. I also think she coached Jodi on answering the questions. It is always best to be honest and truthful. ALV, IMO, is a crybaby and untruthful.
Since she said she wouldn't testify again and since we know she most certainly could be subpoenaed to testify, wonder if it was her?

Geevee, I've been tweeting reporters and bloggers in AZ trying to get an answer on the subpoena. I'll post here if I find out anything...I'm just as curious as you, if not more so.

How does Anyone resolve this? Nurmi rails against the media frenzy & wants to shutter the action. Well, what about his client? She actually tweeted that she was entertaining offers from producers who would like to portray "the truth" about her case, unlike those who made Dirty Little Secret. How can he possibly reconcile that ! harm & damage to his defendant, how?

Why the h&*ll does the DUFENSE need to subpoena the CONVICTED MURDERESS' jail phone records??????? Did she give ANOTHER version of the murder? Did she contact the EPA regarding 'recycling?" Did she write a best seller for the book club? Did the "domestic violence" t-shirts sale reach the BAZILLION mark? Did she teach Spanish to latino girls??????

ETA - Oh, wait - Her convo's with possible "mitigation witnesses" had DEATH THREATS on them, or threats of death threats, or threats to threaten death threats to threaten death to the death threat witnesses who could be threatened with death...

Oh, thanks so much! I sure didn't expect this, who do they think she called and how could it help her? A member of the media and how easy it was (support for their twitter handles demand)? I made the pic of the subpoena as big as I could without fuzzing it totally out. Been having serious trouble with twitter since yesterday afternoon.

Right?! Since it is a fact that Jodi is the one telling her friends or her aunt or whatever to tweet for her, this is not going to help her at all. She could also be giving her friend a slew things to tweet throughout the week. In any case, this is a bad move opening up a door, once again, the state to walk through. I mean, phone records may not prove much, but since Juan would be trying to prove that she is sending out tweets through friends, wouldn't that leave him no other choice but to subpoena the actual phone recordings, since we know they record? Bad move if that's what they are trying to do. Bad bad move.

Jails record them all. In murder cases they are eventually given to both sides before whatever trial date. If they haven't already been given to Juan, they would be before whenever the next phase starts, and he in turn would have to give them to defense. At least that is how it works here. Sometimes the jail gives them to both sides, and bypasses the middle step, which is helpful.

They are usually not good for the defendant. Even CMJA should know that, but obviously she didn't grasp the concept that she is not crafty enough to disguise misdoings.
