An explanation of the subpoena by Joey Jackson:
"While I have not spoken with the Defense team for Arias nor any sources in Arizona, I have looked at the subpoena filed by Jennifer Willmott. In it, she requests all phone records from the jail regarding calls in which her client was a part from January 1, 2013 to August 1, 2013. The best I can determine, the defense needs to know the following in preparing for her punishment phase retrial: what the substance of those calls were, who they were with, when they took place, exactly what JA said, who she said it too, when she spoke with them, and any information that may have been conveyed between her and anyone else. While JA could simply tell her lawyers this information, the stakes here are way too high for her lawyers just to depend upon what she tells them.
JA may be wrong in what she tells her lawyers, may mislead them, may be interpreting what she said differently than what really happened during the conversation, or may leave out (on purpose or otherwise) critical information. That said, in preparing for the retrial, the defense team needs to know what else the prosecution can use against JA in a harmful way.
And while discovery and the sharing of information by the prosecution with the defense is commonplace and even required, the defense is in just as good a position as the prosecution in conducting due diligence (doing their home work) to get what they need so as to be prepared for the case. Their client's live depends upon their arguments, preparation,
and the ability to manage any surprises that may undermine their efforts to save her life."
