No, the argument about Steve and the tree tying began the night of May 9th and went on for around 3 hours into May 10th. May 26 was another argument.

ETA: There are posts in this thread about the May 10th argument, probably just a few pages back, I'll see if I can find them.

First off, her reaction to what he says, "what was that?" was put on, the way she did through the whole conversation, since it seems the tree tying fantasy began with her and Travis was only bringing it up to please her. But, I see what you mean now that I know the Steve Burns argument was from the 9th.

YW MeeBee, until a couple pages back I didn't realize they were both supposed to have happened about the same time either, with the Steve argument coming first. I knew I should have listened carefully to that phone sex tape during the trial but just couldn't bring myself to. lol
 
More affronts to Judge Stephens, who insures an orderly courtroom quite proficiently and who admonishes jurors on their responsibilities. But The Team's motions challenge the force of her admonitions & follow-up inquiries and her judgment about when and if television cameras would pose a prejudicial intrusion. The defeated motion of June 21 accused her of legislating from the bench. One of these days, the milk of human patience is going to boil over.

Who are these complaining Team Members to dispense justice? There are so many tweets, posts & texts floating around in cyberspace that an attempt to control who does them and who receives them is like trying to control thoughts. So I ask again, who do these teamsters think they are, the NSA? We do know for sure that certain websites are forever flinging mud at Juan Martinez and Esteban Flores and their medical examiner. What if a splat landed, God forbid, on the notebook of a juror!!!
That's almost like the word "guilty" mysteriously appearing on your notebook, as it did in the case the teamsters relied upon. I mean, who could ever recover from THAT? The horror! GMAB

Late, we learned that Kirk Nurmi was refused exit one more time, on July 16. In all seriousness, it must be awful, even wretched, to remain for years bound to someone whom you've tried hard to help, who has foiled those attempts to help, and who has expressed disappointment in you publicly. In fact, on network television. Yet you might as well be wearing chains that couple you.

This must be even more cussworthy because you have a private practice that languishes while you attend to this misery, a practice in its early days when it requires the most care & work. That was no prize package you were handed five years ago but a big yellow Salinas lemon that awaited inside the wrappings.

Still, with all this being true, the delay-defer-refuse strategies of the defense team have only worsened a rotten assignment until you find yourself pushed through a corner. Can't we resolve to meet this fate and surmount it? It is unhealthy to linger in the swill of her case. We can see you are gasping for oxygen.

I do admit that I feel sorry for Nurmi. Try as much as he did to keep JA on track during her testimony in court she kept going off script to put her own little spin on things and you could see the look of exasperation on his face. jmo

He is living the h*ll many wish upon his client and I do have sympathy for him too. I hope he can rein in his frustrations throughout the retrial, he probably doesn't have a lot of patience to spare.
 
I was looking through the docket to see if any last minute motions had been filed (not as of now), and while there looked down the listing to see if I could see any previous motions for the camera when I came across this, I have no idea what it means but the wording just struck me funny:

This was brought up a few posts ago but it was not addressed. As to JA having the camera on a strap or not. If you go back to DF testimony he is asked by JM and answers the strap for the camera was still in the box the camera came in and did not seem like it was ever on the camera because it was still in its plastic bag from the factory in the box. Sorry this was just bothering me. Well everything that has to do with JA bothers me.

Hi starporter; I recall that about the strap that came with the camera, but since she was a "budding photographer" and said she had two cameras with her on that trip, I figure she had at least one neck strap of her own.

I noticed something while rewatching JM's opening today, when describing what he thought was most consistent with what was happening during each accidental pic, he said when the shoulder pic was taken that she was taking the camera off her neck and it fell upside down and hit the floor, snapping the pic. For the last pic, he said she stepped on the camera and caused it to take that one.

I hadn't noticed this before but it never fails to amaze me how many details get past us until we listen or see something a few times. And this case is just chock full of details. lol
 
Anyway, that is a funny motion. Looks like Juan is getting a little fed up.
 
GeeVee, I just want to thank you for all the time you've spent with the photos. I have to admit I usually can't see what others do ...like Juan and the dog with a stick in his mouth LOL. But!!!! The shower photo very clearly shows CMJA in the upper left corner. That was amazing! Thank you!

I thought the eyeball thing was kinda silly too, and they picked the wrong one, he had a water droplet falling from the upper to the lower lid that would distort any reflection, they should have tried the other eye. lol
 
Probably resolvable on or before Sept. 16th:

I noticed at the status conference yesterday a marked difference in the way JA behaved towards J Willmott, watch JA all the way through to the end:

Contrast it to her behavior with JW at the end of the conference held before, on July 16th:

Little miss chatty cathy in July becomes someone who doesn't seem to know her own attorney in August, even as JA is leaving and the mitigation specialist seems to gesture towards JW and JA looks in that direction then back at the M.S. with an odd 'I'm smiling on the outside' expression on her face.

Something seems to have occurred between JA and JW, no more BFF, no more 'in it to win it', just two people in the same vicinity, barely cognizant of the other.

Something has happened, but just what? And will it affect the retrial?

Also, Nurmi left with what tweeters described as about a dozen copies of the transcript (a stack over a foot tall) - what could he need so many copies for? I'm sure he has a staff to aid in his study of them but this seems excessive, at least for what we know now.

Hopefully Sept. 16th will see the answer to many questions.

They were the trial transcripts, but he took many copies of them, I think it was Camille (I can't think of her whole name) who said (tweeted) all the stacks he was taking were the same size, which is why she thought they were each copies of the transcript, and took many of them, she said he left with a paper stack over a foot high.

We found out within the past week that both Nurmi & Willmott asked to slide out of this on July 16, and were denied. Reports yesterday were mixed but one source had them renewing the request on August 26. I think this may well be why Arias is alienated. I feel a need to clear this up & that's why I posted on this Unresolved Thread. I will be researching it on-line.

Thank you, geevee, for the comparison footage that revealed the frost now in place. As soon as Arias stood before the judge yesterday, I noticed her sad sack posture. I wondered if she leaned forward because the chains felt heavy but there was a definite slant there. She looked sick as mud.

I bet Nurmi does not have a staff of 16 but he would have had to order the number of copies in advance. Evidently, the judge found the number justified even if we don't.
 
It is still unresolved whether the teamsters asked out again. On the other hand, why would they forego an opportunity? Velez-Mitchell entertains another rumour, that someone above Juan Martinez prefers to negotiate a resolution of the penalty. She prefers not to name the party but I put a ten spot on Bill Montgomery each way. He laid out his willingness to deal months ago. Could there be a figure at state level who either agrees with his position or who is exerting pressure to yield to some bargain? Yes, but that possibility isn't necessary. The more the teamsters employ the Harvard Negotiating Drag, the greater the County urge to ash can this whole thing. Personally, I think that's an awful way to "win".
