Predictions for trial outcome

She has a history of getting away with things with her pushover parents.
not the same as getting away with things with the legal system.

That's sorta true- but getting away with stuff has been her reality. She's also gotten away with things with her brother, friends, boyfriends, boyfriend's parents, grandparents.
Also, just my opinion, but I figure she has gotten away with stuff we don't know about. If she has victimized friends and family- I can see her victimizing strangers.

The true story will come out at trial time. Casey will take the stand and explain why she had nothing to do with Caylee's death. Everybody will finally understand why her Defense team says she's really innocent. The Public will feel sorry they accused her. She will be released immediately. Years later, we will hear she met a nice guy, married, and has four children, but still manages to have a hip job in the music industry.

Not! That's Casey's daydream though.

I think she will get LWOP, but will never stop claiming she's innocent.

you had me ging there till you said 'hip hop industry'

unless the florida state of appeals is as stupid as the people you mentioned there, i cant see her walking.

Even if the jury recommends a sentence of death, for some reason I can't see Judge Strickland giving it to her based on his sympathy for the A family.

if a judge has any inclination of sypathy towards a defendent or her family, he should recuse himself, because he cannot be unbiased.

I think that she will be convicted and will get the DP but it will be changed to Life on appeal only because she is young and female.

Wouldn't a mistrial with a DP jury require more than 1 hold out? I thought that it was majority rule with a DP qualified jury. Am I right or wrong?

Conviction requires all 12 jurors.

Recommendation for the death penalty following conviction only requires 7 out of 12, but at the end of the day that is only a recommendation and it is up to the judge whether it is imposed.

Hi kpalma. Do you think she will serve this term or win freedom on appeal?

JoAnn_W

I think she will serve it. ( I hope)

OT, but do we know the date for the trial yet? I heard the judge saying 1/25, but is that for the check fraud?

I am not sure I agree with this.
I want my judge's to be human and feel sympathy.
Why let the family of the defendant speak at the penalty phase if their words are only to be heard by someone who will not consider them?

Feeling sympathy for the parties involved is fine in my opinion.
If they only feel consider the wants and feelings of one person or side then I think it is an issue. But if they weigh all the factors and apply a fair decision, I think that is their job.

frankly i dont want him being sympathetic to the prosecution or the defense in anyway. that's not his job, espeically not in pretrial/trial mode. if he has any human tendencies that come out, they should be after everything is presented.

LWOP is my opinion...

why isnt this a poll? I wanted quick results, not all this reading :biglaugh:

guilty/life

I dont think a jury will sentence her to death. but if they do she will end up with life on appeal. women are rarely put to death, especially not one so young. and while the crime was vile it wasnt as vile as some (for an example I dont think she would do it again - which is something they consider when debating death)

Hi Sharpar. Do you think the DP will be actually used or will she just sit on death row? Also, do you think it will be upheld on the automatic appeal?

JoAnn_W

Yes it will upheld SS will make sure there are no appealable issues and I
do believe in Fla they do execute. However we will have to wait 15 yrs
give or take for the appeals process to run its course.

I think this case will go to trail because of JB's massive ego and his need for publicity. Having said that, I believe she will found guilty and sentenced to death. However, I believe JS will overrule the jury and sentence her to life in prison.

Guilty, with DP and will be put to death.

I see a needle in her future....2018 or so.

Hi again MommaEarth. With her penchant for drama, and getting away with so much, I just can't see her sentence as cut and dry. I see appeals, technicalties, escape attempts or even suicide.

JoAnn_W
Well, I could tell you what order I'd prefer all that happening...but I'm gonna be nice instead and say nothing.

Thanks. I went back and did the research to find the above and posted it. I can see having the 12 jurors for the penalty phase and a simple majority because of the large number but for a conviction that seems like a lot of jurors to expect to get the same guilty/not guilty verdict from.

I predict in the end she will get life. I don't think one must be able to charm the bees out of the trees to talk to a jury about the many people that were wrongfully convicted, DNA later proved them to be innocent, and that is why the permanence of the death penalty will keep you up at night. In Florida life is life, no parole, so she wont be getting away with anything. I see Andrea being able to prevail upon the jury for this reason.
