But having you just been going on about MJ and the "whole" TES records and how sympathetic the judge is to the defense's request to see ALL the records? (which he isn't actually)
Now I am confused.
The judge has not ruled on this motion for all the records that I know of. He gave Tes a continuation.
In doing so, he may have stopped the defense from being able to comply with the order to show substantial evidence by Feb 1st. The judge knowing this may have reset the discovery for this week. This was all just speculation on my part.
Further I speculated that perhaps Tes gave those records to Le and therre is something in there that has caused this new motion. All speculation on my part.
I don't see the Judge being simpathetic to anyone. He may rule that Tes has to give all their records to the court. Hope that helps. Moo
