I don't think the judge's authority is at issue at all. The prosecution motion reads, in part (emphasis mine):

1. Certain materials and information have come into the possession of Law Enforcement.
2. Those materials and information are discoverable under F.R.C.P. 3.220.
3. There is good cause to delay disclosure of these materials and information pursuant to F.R.C.P. 3.220(k).

So they have some stuff that they feel should not be disclosed to the defense just yet. My opinion is the judge will grant the motion to see the evidence without the defense present, and then will decide whether or not to delay disclosure.

Just throwing this out there but what obligations do AL's students have to preserve their professors clients secrets? What if the students were asked to do something unethical, destroy potential evidence handed to the defense..whatever and someone came forward?

With all due respect, from everything I have read the SA has been above board on EVERYTHING. If we have a moment of truth, it will be from Casey Anthony, and we ALL know, that's not gonna happen.:innocent:

I respectfully disagree. Earlier the Sa withheld information about the duct tape fabric coming from a different source\roll. Bc had to release that doc dump. So not above board at all imo. What is it with all the secrets?

1. Fbi and bodyfarm discovery.

2. Dc interview sealed.

3. JJ tape and anything said in it sealed.

There is much more missing. Just read the what would you like to see in evidence thread.

This is suppose to be a fact finding mission. We don't need any secrets. If the Judge approves this motion, it is only going to look bad on the States part.

The state brought these charges, they need to be forthcoming. Get it all out on the table. No more secrets. This is crazy. This is also how they ended up with the Sunshine Law in the first place, I am sure.

If the public wants Kc to be convicted of this crime and executed, then they need to do it knowing the whole truth. Otherwise how is the public suppose to sleep at night not knowing. No More Secrets. Moo

I'm guessing the most absurd possibility that Casey has sent a confession letter to the SA office, and her claims are now being investigated and compared to the existing evidence. THAT, IMO would be a bombshell....doubt that the defense would want that material or information released to the public.

Don't have link although my recollection is that what BC "released" was info that had already been released
1) as JS said FBI/Body Farm info is between JB and FBI/Body Farm
2)wasn't that sealed because he was protesting saying it was confidential, client/PI info - not sure but JB might agree with that

Why wouldn't the prosecutors want that information released if it were the case?

What if this new information or evidence is totally, flammatory and incriminating to KC? What they may want to avoid is outrage, we remember the protesters at their home. If it has something to do with another member of the Anthony family, they may want it kept secret to allow themselves to dig themselves into a deeper hole.

The State Attorney's Office has asked for a private hearing with Orange Circuit Court Judge Stan Strickland to discuss "certain materials and information" that have "come into the possession of Law Enforcement."

According to the state's latest motion, the materials and information are releasable to Anthony's defense and the public through the discovery process.

"There is good cause to delay disclosure of these materials and information," Assistant State Attorney Jeff Ashton wrote in the motion filed Wednesday.

This snippet doesn't mention who the LE are. Could it be the fingerprints from the duct tape, defense mentioned something about 19 prints at the fraud sentencing trial? Could it be someone gave something to LE?? I wonder what this could be that the defense needs to be kept out in the cold. Is it against, Baez, Dr. Lee, AL...whatever it is, it has to be very incriminating...Hopefully it's the smoking gun we've all been waiting for...:dance:

The public will know in due course. I'm not worried and I suspect the information will be released in the next few months.

This is not about with holding evidence the SAO are asking for a delay.

I am thinking it's something along these lines. Because if the DA had something that benefited them, a "slam drunk" piece of evidence they why not release it? One would think that if it was in favor of the DA they would want it out there!

If it was something that would benefit the defense, no need to wait. Cause they are going to get it anyway. Also, if it info that the defense could use, and it is 'held', that would hurt the case against KC.

If it would be helpful to the defense, it would be in the cases best interest to turn that info over promptly.

If it points to KC being innocent, then it would only delay looking for the REAL killer. Again, not helpful to the SA to hold it.

Basically, holding the info because it would help the defense is a stupid and silly thing to do.

In all seriousness, I would guess it might be something they are seriously investigating. IF it is another person, etc.. no one would want to tip the person off at this point. That would not be helpful to the defence. <wink> Might be info on a helpmate of sorts.

If it is underinvestigation, the might not want 'us' sticking our heads in there, and screwing up the evidence. Or the witnesses, etc. Who knows.

But being spiteful towards the defence or holding out just because it would be helful to the defense, I seriously doubt that. This case is to high profile to get away with that game.

hmmm... I don't recall that. I recall BC releasing stuff that had all ready been released, acting like it was new stuff, wasting our time. And I haven't seen anything proving that the tape was from different rolls all together.
