This is why DeMarte needs to emphasize during her testimony that it is NOT a mental illness.

Every thing I have looked up re bipolar says it is a mental illness...which could backfire as a mitigator

The DEFENSE has rested for their part of mitigation.

I think it was last, because weak or not, at close enough range to blast through someone forehead, that bullet must've ricocheted around at least some before resting where it did. Now if it had gone straight through and exited, then maybe I could see it not affecting all facilities right away.

And we don't know for sure what path the bullet took because Dr. Horn stated the brain matter was in decomposition.

That sounds like Wilmott. Dr. Horn said that even though he couldn't see, it would be reasonable to presume it went through the brain.

I was wrong in my other post. Borderline is a mental illness. I remember some posters here that were diagnosed with BPD said it was not a mental illness.

BPD also shouldn't be a mitigating factor because it's not a mental illness. IMO it shouldn't be a mitigating factor because a mature adult would get help for it and know how to manage it. BPD doesn't predispose a person to murder. I'll bet BPD-ers have the same incidence of being premeditative murderers as the non-BPD US population.

* Insanity - Doesn't know the difference between right and wrong and so can be found not guilty because of it.
* Mental Illness - Knows the difference between right and wrong so it doesn't affect guilt, but could be a mitigating factor for DP.

At least that's how I understand it from earlier comments from AZL and others.

My understanding is that insanity is a legal term only.

I say my cat is going insane when she's super playful or that the iPod is insanely great, but that's not using the word correctly.

Well if BPD is a mental illness I think some jurors might not want to give her the DP because they think she is sick. I thought in the trial, everyone played down that it was a mental illness. Or maybe that was Jodi not wanting anyone to think she had a mental illness.

I re watched Dr. DeMarte's testimony and you could tell Jodi was furious when DeMarte was diagnosing her. Looking down most of the time and scribbling.

She hated DeMarte. A woman the same age who has accomplished things in her life. We will have to see. If she allows her DT to highlight that she has a mental illness or she allocutes that she is remorseful and is sick...it could save her life. But I don't see her doing it.
