Retrial for Sentencing of Jodi Arias #1

Arias believed she could mount her mitigation forces in secrecy. We have this continuance because the ordinary sign-in protocol at the jail did not satisfy her demands that her defensive efforts be kept under tight wraps. An officer at the jail balked at her arrangement and "did not comply". Here we have it again. The imposition of her will & her notions and it met with resistance.

Arias is not pleased that her expert and her P.I. will be undergoing interview and examination by Juan Martinez now. She knows that her carefully laid plans and her secret intentions will meet a scrutiny that discerns her purposes, so as to counter them. Weakness in a witness will be uncovered. Foiled again, Arias! I can hear her muttering in her sleep, "Why don't these freaks comply!"

Secrecy, carefully laid plans, and a proclamation to the court that her witnesses were unwilling to provide their addresses to the prosecutor.

Why? Well, the implication is certainly that it is out of fear that they will be threatened into not testifying the way some were threatened by Martinez in the guilt phase.

The convicted murderer's take on things is interesting; self-serving is to be expected but it goes further than that. I am convinced Arias actually believes some of the nonsense that she spews. The fact that Martinez has not only a right but an obligation to warn potential witnesses that he expects truthful testimony and any lies would be prosecuted to the full extent of the law flies right over Arias' head. Maybe she is not as smart as many give her credit for.

It was tweeted by someone in attendance on August 20th that Arias left abruptly when the hearing was finished with no parting words for anyone. How unlike her, I thought; she is one who always wants the last word.

I believed the tweet, and no doubt the reason for her abrupt departure is that she never expected her witness(es) would be required to be available to Mr. Martinez. She thought the court would come through once again when she implied that the witnesses fear Juan Martinez and therefore needed their identity and addresses kept secret so that he could not get to them; when that did not happen she left in a snit.

He adduced other evidence impeaching her claim of an attack that damaged her ring finger. She had told Ryan Burns & Det. Flores that her ring finger was injured at Alexander's in June but was now contradicting her explanation of the injury, saying she put her hand up to defend herself from a kick by Travis January 22. But what settled this convincingly for me was the entire work record of that day, which Martinez provided. I studied every entry. She did not leave until quitting a very short time before she gave in to her need for a nap & her headache. She had no argument to defeat that record. The content and nature of her exchanges with Travis in the early evening were innocuous. Arias wanted to borrow his BMW and he said fine but she didn't, due to the headache. She asked him if he put a deposit in her bank account, which he did January 20. Arias had also testified that the domestic violence roused Travis to bombard her with phone calls but that was contradicted too, as Martinez had the phone records.

I agree he did not definitively prove that it never happened, obviously. But he was definitely able to show that there is such a small chance that it actually happened that it probably didn't. If I'm remembering correctly the texts showed that based on his and her schedules that there was only a very small window of time where it could have happened. Like 30 minutes. All the texts after that window were just as normal as before it. It sounded like they never even saw each other that day. And also negating Jodi's claim was her asking if Travis had made a deposit into her account that day, when the alleged attack was supposed to have been caused by her unwillingness to loan him a large amount of money. All of that pretty much sealed it for me.

Personally, I'd love it if JM just dropped the Death Penalty before the retrial and Judge Stephens immediately sentenced CMJA to LWoP. I can't think of anything that would piss her off more. <-- I absolutely love the thought of her going apeshit in her cell and getting NO MORE SPOTLIGHT!!!!

Regarding domestic violence & battering, which will color her mitigation, the State torpedoed Arias' claim Travis physically attacked her on January 22. Martinez proved with workplace documentation that she was at work that day, at the time that
battery supposedly occurred. After work and a nap with headache, she talked to Travis on the phone. This was in the early evening and the call had to do with providing transportation.

Arias had believed this the perfect date to insert her fantasy attack because it was blank in her diary and she could always explain that his violence didn't comport with the Law of Attraction, so she wrote nothing. Her account was exposed in toto as a huge, detailed lie. And yes, Miss Arias, that does make you a liar.

When that lie exploded, it should have moved the walls & hit the ceiling of the courtroom. Ranks right up at the top of her d.v. deceits exposed for the defamation they are.

You are right Tuba, it should have. But I think the jurors were so tired of JA's testimony by this time that they tuned out some really important highlights. Esp the foreman.

If it is indeed granted for a one day delay for viewing, this will keep us hopping. Viewing twitter for live tweets versus trying to keep up with watching trial one day behind. I don't like this. Still believe in a live feed. Would like to view it as it happens.

But under questioning February 11-13, she did reply "It was after my morning shift" when her invention occurred. We also know that she did not leave after her morning shift, from work records.

I think the $loan/deposit discrepancy you point out gives the lie to the body slam & kicking provoked by her selfishness. The pretend motive is ridiculous and incredible as well.

Boring as these abuse lies are, it's good to examine them because she relies on surviving domestic violence as a mitigator.

Of course, she doesn't cooperate but she does protest that there would be no reason to hurt Travis because aside from some mean words, he never did anything but loan & give her money and sell her his car on absurdly favorable terms, "nothing, nothing!" That is a useful admission, considering the abuse she later concocted and which ALV exaggerated.

It's in evidence so he could. As far as my understanding of the retrial is, only 'new' evidence can't be introduced, which makes her P.I.-sleuthing all the more befuddling.

After learning from Sidebar of past sentences handed down by JSS, I take heart only from Martinez's abilities. We can count on him and we can pray for a reasonable jury.

Right? I'm thinking JM will cooperate now with her strange requests, let her do what she thinks she wants then object to the nature of the evidence she's trying to present. The guilt phase is over. Done. As tuba pointed out, she's trying for a do-over. I really don't think it'll work nor should it be allowed.

I was also watching a trial video yesterday and Juan played a portion of her interview with 48 Hours where she describes Travis grabbing some food for a homeless woman at a Wendy's. Given that the people who knew him best, including Jodi, tell story after story of a similar nature regarding Travis' kindness and selflessness, I'd say this is probably the real Travis. The one who bought all the stuff his friend needed to start her business. The one who helped homeless people. The one who did so much for Jodi and got nothing in return but his life taken away. "She repaid those blessings by killing him." It was a touching story, btw and his brother, not Steven but the another one, looked so touched by it. It's still so heartbreaking. What she did to him and what she continues to do to him and his memory. It's an assault of the heart.

She was unable to explain that and I think once her expert gets to the "crime scene" she may see that there is no reasonable answer for it. It remains to be seen whether this expert is truly an expert in her field or one who will say/do whatever she is paid for.

After reading AZlawyer's posted article I can see the reason for wanting the scene visit: It will be easier to speak of what might have happened once she has "experienced" the scene for herself rather than just via hearsay. I must say that after reading the article I feel a bit better about this expert wanting to visit the scene. It feels now more like a professional doing a job correctly and completely rather than a PI hoping to disprove reality. IMO.

Slightly off topic, however, still regarding the crime scene, who owns the house where Travis was murdered? It has been years since his death; is the house still vacant and if so who is paying for its upkeep, property taxes, etc.? If not vacant, how could it be an accurate representation of what occurred the day he was murdered?

A family lives there now. A news story was done on them and kcl along with Travis' siblings went there to meet them.

The only way it will be accurate is that it will be the same layout and still has the same shelves as the day he was murdered. Other than that, it won't be.

Thanks - I thought it had been sold, and that is what was confusing about JA's expert going there. Honestly I can't imagine living there.

New evidence can't be introduced, but JA will introduce it anyway.

Anyone want to venture a guess on how often JA gets away with stuff she shouldn't due to JSS not controlling the situation? JM will object and sometimes win but if JSS gets a bee in her bonnet she just might overrule more often than she should. She is not great at controlling her courtroom--look at the crap LaViolette got away with in spite of objections.

I am very worried about this. I pray Juan is on his top of his game and is prepared in amazing ways knowing what he's up against. May "our" strengh here go with him and Travis into this battle. I will hold Travis and his family close in my thoughts as they confront her evil again. Sorry, but she just is to me.
