Retrial for Sentencing of Jodi Arias - Day 22

It's kind of interesting that she sat on all these motions so she could consolidate them into one giant ruling. It's ljke she knew this would happen and wanted to reduce her work and having to write a response to a new one every other week. Lol.

But what about the length of the trial thanks to sitting on the motions?

Could anyone point me to the support page that has comments on it, please?

The FJA page doesn't have comments that I can see. TIA

No one here has the right to compare any of us to anyone who supports Jodi Arias! When someone says that we think the judge supports the defense but the Jodi supporters think the judge supports the prosecution, we are being lumped in with those maniacs. Don't even think about it! This is quite an insult to us. I have a right to my opinion as much as any one of you do. I am happy about today's ruling but it comes after weeks of the jury being bombarded with innuendo about 🤬🤬🤬🤬 and prosecutorial misconduct and Jodi's secret testimony. All of that has to be weighed against any good that came from today and we have yet to see what the next few weeks will hold. So while I am happy for the rulings, it doesn't mean JSS grew a backbone. Just sounds like the COA and SC slapped her pretty hard, just as she did to the defense. If I am going to hand out praise it will be to the COA and SC, not to a judge that wanted to decimate the US Constitution.

It's too bad the jury can't see this ruling.:/

Just want to say that when it's noted that many people here see JSS as being pro defense and Jodi's supporters see the opposite, that is not comparing people to her supporters nor is it meant as any kind of insult. It's to make note of the fact that people can look at the actions of one person and see completely different things. It's meant to give a level of comfort that maybe, just maybe, the judge isn't either of those things and people are just projecting things onto her that aren't there.

Anyone got a cure for insomnia? Lack of sleep is makin me ugly. :(

I personally favour an anti-histamine and a good monotone documentary, just make sure the anti-histamine isn't the daytime variety.

Oh yea, she was upset because the mean guard searched her cell. Did she forget that she was found GUILTY of brutally murdering someone? She had better get used to having her cell searched and contraband taken away. :jail:

She was already cold busted witness tampering by giving Ann Campell the 2 magazines with the hidden writings in them telling Matt You f'd up what you told my attorneys, it directly contradicts what I've been saying for over a year now. Remember JM had his Perry Mason moment asking her regarding this..."You tried to get someone to lie for you right about the time of the pedophilia letters were being discussed in a hearing, didn't you?" message to matt from jodi in magazine.jpg

Damn straight your cell will be searched Jodi Arias. OFTEN!

She was worried? Come on. She is a judge over a DP case. So it will take a million and ONE different times and ways to make me understand and believe this was good judgment.

She had recourse. She spelled out recourse in her rulings. The COA spelled out recourse. What's not to understand? With all that at her fingertips, her worry is misplaced IMO.

This is my favorite part: The Court is unaware of any legal reason the detective’s wife should be restricted
from providing her opinion or commenting about the case on social media. Even if
the court had evidence that Detective Flores had discussed matters from a sealed
proceeding with his wife, Defendant has failed to show that it affected her case in any
way. The penalty phase retrial jurors were questioned about any prior knowledge of
the case including information obtained through the media. None of the jurors
indicated any knowledge about these social media exchanges. Defendant does not
allege how her case was prejudiced by these incidents. The Court finds no ground for
dismissal of the indictment or the Notice of the Intent to Seek the Death Penalty
based upon this claim.
Jodi's minion, SW must be livid that her little plan to trap Mrs. Flores failed.

Funny. I thought AzLawyer meant that basically while we are frustrated by JSS's for whatever reason, JA's supporters are actually the ones who get denied/dismissed/adios on every issue of importance. And that when you think about it, both sides are against the same judge, claiming she's for the other side. And since I stalk her post, it's not something that she's said for the first time.

But aye, I'm asleep... Zzzz

I do not think JSS is biased for one side over the other but bias is not the only thing that would make one a bad judge. JSS lacks control of her courtroom and she often allows the defense team to dictate how things will be. She seems timid, and sometimes people can be taken advantage of if they appear timid. She could be a wonderful person, a fine neighbor and a good friend to many, but as a judge presiding over trials, JSS falls short. I do not dislike her as a person (because I don't know her as a person) and I do not think she is anti-Juan, although she may evoke those feelings in me yet...time will tell.

Were all these defense motions for misconduct by the prosecution? If they were that could be why she waited. If I were a judge and knew more motions would be coming I would wait also if I had the option. The computer issues certainly needed to be investigated considering what the first accusations were. That was not going to happen overnight. A trial within a trial. She covered all the issues just as the trial is winding down. Not sure that is normal but it may have limited the nitpicking by defense with misconduct motions every other day had she ruled on them separately. jmo

The DT argued:

I found it interesting that the DT had already petitioned the COA (secretly), way before the current debacle and its resolution. At that point it was shot down immediately because the DT sought the wrong remedy, as was mentioned more than once in the judge's explanation of her rulings.

I imagine this will continue to be the DT's recourse and threat .

It wasn't secret. It was a special action regarding JSS refusing to remove the DP option on the ground that Flores changed his mind on the order of injuries. IIRC no reason was given for the denial, which probably means the Ct App had no problem with this being considered an especially cruel murder.

Websleuths! Seriously beyond that reading, watching TV, doing logic puzzles, planning things, writing them down, warm bubble baths, eating something, exercise...

But what about the length of the trial thanks to sitting on the motions?

I don't remember the judge ever delaying proceedings so she could write this out.. Her sitting on these motions has had no affect on the pace of the trial.
