Retrial for Sentencing of Jodi Arias - 11/17-11/18/14 In recess

I heard that exact line of thinking/sentiment directly to my ears by a local reporter who imo operates as an arm for the defense. That this should have been 2nd degree and it's the family's fault entirely that it wasn't.

But when it comes to Arias I think it goes far beyond that. I do think she's that kind of killer who loves revisiting and reliving her crime in any way she can and in continuing to torture his loved ones, she gets some of that by proxy. I do think she's that evil.

I agree. She demonstrated her pleasure in the letter she wrote his grandmother (graphic details of the murder, barely disguised by lies, taunting her about the children Travis wouldn't have), in her interrogation by Flores ("I think , if I was capable of killing him, I would have had to be more humane, " and her knife plunges into TA's family even then), by attending the memorial and staring down his grieving friends and family......etc. etc.

Her whole allocution was awful. Her trying to be human just didn't work. Not sure what is under that skinof hers buti am sure it isn't human.
I agree, I know we repeat this over and over, but her allocution was bizarre, she stood up there as if she was giving a general presentation of sorts, not in anyway demonstrating any feelings/remorse whatsoever for what she'd done. Difficult for us non psychopathic killers to process, I believe she couldn't sound/be sincere even if she tried, good riddance.

Didn't Nurmi mention that Dr. F would be on the stand for 2 to 3 days - and isn't she on her third day already?? I think - should say HOPE - that Juan will get his turn tomorrow!!!

I believe Monday was the start of her third day.

AZL but doesn't it matter as far as mitigation? I mean she obviously had no remorse and if she is hiding weapons in a rental car where was she going and what did she need a gun and knives for, which just happened to be what she used to kill Travis. To me that shows she can't be rehabilitated and just like in her interview post conviction she says no one has to worry about her in society if they don't cross her or something to that effect. I know it's the law and I appreciate you deciphering it for us all but in my common sense mind it doesn't make sense that those kind of things can't be used to show why she SHOULD get the DP and not life. LOL when I typed that last sentence it reminded me of Judge Judy. She said something on her show about "it doesn't make sense and if it doesn't make sense it must be a lie" lol

I don't get it. How does having weapons after the fact show a lack of remorse? She didn't deny using the gun and knife to kill Travis, and she hasn't said that the experience made her not want to be around weapons any more. Now, perhaps JM should have asked her in cross, "So you have PTSD? Does this PTSD make you afraid of guns and knives?" Then if she said "yes" he could have brought in the later acts as rebuttal--and if she said "no" she would have undermined her claim of PTSD.

First rule of cross: never ask a question to which you don't know the answer. Unless you don't care what the answer is. ;)

I think Nurmi should have definitely read the jury better as far as this witness goes. She seems totally disconnected from today's societal norms. I'm no spring chicken by a long shot, and I find her thinking terribly antiquated, especially in terms of her profession.

When she said that people don't normally text after 11 pm, I had to laugh. I guess she doesn't have any young people on her cell family plans.

I think MDLR has to request approval for any additional expenditures outside the scope of her contract, see link.

Looks to me like Maria has surpassed the requirements of her position by getting involved in selling her artwork and fund raising for the family, general personal assistant activities (secretary)....and maybe getting involved in Jodi's trust fund activities??

That phone showed how involved Maria seems to be. I wonder if she is billing these hours to court. OH....and who is directing Maria's activities? Nurmi or Wilmott???

She despises TA's family. Because in her mind they're all that stood in the way of a 2nd degree murder charge. They refused to give her a chance to walk someday, so they must be punished. I'm sure her hatred has only grown during this round 2, that now its the fault of TA'S family that JM won't drop the DP.

I suspect she also hates them because they prove that someone can have a loving devoted family, particularly since they went through a much more abusive childhood than she did.

And unlike all her "expert" witnesses and JW, they don't worship the ground she walks on. I suspect she doesn't like KN because behind the scenes he probably tells her she's wrong about this and that and she obviously cannot stand that, while it seems JW and MDLR coddle her all the time.

Some possible reasons hearsay would come in (if relevant):

1. Testimony was offered in penalty phase;
2. Prosecutor was not trying to prove that what your sister said was true;
3. The statement was your sister's description of her "present sense impression" or state of mind;
4. The statement was an "excited utterance" made by your sister;
5. The statement was made by your sister soon after an event to record her recollection of the event (journals?).

Pretty sure it was 3.

Then why couldn't Dr. Hiatt come in?

This is like law school. :)

If Jodi said something about Travis's state of mind that was inconsistent with what Dr. Hiatt would have said (and was regarding the same time period), he probably could have been called to give that testimony. He couldn't have been called to say that Travis said Jodi slashed his tires, because Travis, frankly, was just guessing, and the statement would have been offered to prove the truth of the matter asserted (that Jodi had slashed his tires).

I have the Dutch nationality, yes. My island is part of the Dutch Kingdom. I was born and raised in Curacao (The caribbean), like Aruba, one of the former colonies of the Netherlands. I've been living in the Netherlands for 6 years now, to go to college and graduate school. ANYWAYS.. Long story short I consider myself more of an island girl than a Dutchie. :)

OT: You have some lovely Dutch Warmbloods coming out of the Netherlands for sure!

I always found it amusing during the original trial how JW automatically launched into "it's not for the truth of the matter" every time Juan objected to hearsay. Of course 99.99% of the time it was indeed to "prove" the truth of matter.

Is Jodi on speed or something??? She talks a mile a minute. Can more calls come out? And Maria, ugh, knee deep in working as Jodi's personal assistant.

"bi-laws"...."trusts"??? Wow.

Jodi has to talk fast before she or Maria are caught. Think of how many times she's had those three ways phone calls? All of our posters from Arizona have to pay for this and Maria smuggling Jodi's art work and crap out. I think she's most definitely cross over from professional to a private one.

Keeping an eye out for that new motion. It's a Motion to Strike the Compaq altogether. Maybe Juan didn't get that mirror hard drive.

It's why I want her on deathrow. So all the foolishness can stop. And when she dies, then it can all end.

Wait, I'm behind the curve on this one but Maria was "Lisa Schilling" on that call?

I'm still blown away by the lack of HLN/CNN, do we know for sure why they left town?

Well, who knows what it is. It's a Motion to Strike that somehow involves the issue of the Compaq. It could be a Motion to Strike Juan's Motion for Sanctions.

She sent Maricopa co. a bill for ten thousand dollars back a few months ago, so she's not through yet.

I gotta admit--I thought KCL's question about Dutch nationality might be comma-related. It sure is funny what sticks in my mind.

Problem is she has about a 2% chance of ever being executed on death row. She will statistically die of natural causes in prison. She'd be safer on DR though and have WAY better legal help. I'm surprised they don't "beg for it".

Oh, you're right. I thought it read Motion to Strike Compaq. But Compaq presario is in parenthesis.
