Does anyone have the link to the legal reasons why the AZ court could allow a witness to testify in secret? TIA

There's case law under the 1st and 6th Amendment...I haven't read it recently but I believe the cases say something along the lines of closing the courtroom being the most narrowly tailored option to serve a compelling interest.

1. Can CMJA have her secret testimony "struck" from the record to avoid taking the stand again? She WAS testifying in her own behalf, wasn't she, so that would require her to be "crossed" by Martinez?

2. Can she just refuse to take the stand?

Just got back from shopping and Yippee!!

I love the way the COA refused to cover for the 'secret witness', or JSS, and named HER!

I always felt it was Arias, simply because she was the only one with sufficient power to demand secrecy, IMO.

Can't wait to hear/read her latest batch of lies, and for cross :juanettes:

My opionion is that Jodi, in secret testimony, is claiming sexual abuse by her dad and she didn't want her mother and dad to hear it until the trial is over, so that they don't become incensed and testify against her during this phase. Jodi will throw anyone under the bus anytime, anywhere. Anyone she can trash to save her hide is a fair trade off for her.

I could be way off base but why else would her attorney say she feared for her life unless she thought her dad would come crashing over those banisters and slap her once more? Lol.

Frankly, I don't care if she was abused, neglected, slapped around, you name it. She had no right to go and do that to another individual who was a decent man and then ruin his reputation. I have no sympathy for her.

In any case.......Juan Martinez is onto her. Thanks Juan. Justice for Travis!

1. She can try. I don't think it will work unless everything she said was already said in the guilt phase--in which case JM can play the tape from his previous cross. If JM agreed to accept "striking from the record" as a remedy, it could happen, but otherwise I think she's waived her right to refuse to testify and will have to undergo cross. Of course, maybe it wasn't testimony as a witness but merely her allocution being taken out of order--in which case there would be no cross.

We're going to hear about wooden spoons, scrambled brain, being choked to the point of unconsciousness, low self-esteem and so on. She might throw in some sexual abuse just to mix it up. In other words...lies, lies and more lies.


Oh there's going to be sexual abuse and probably pretty graphic. That will be why Jodi was so sexually aggressive. You are giving JSS too much credit. The judge really let down the bars here. Not only will Nurmi &Co be scrutinized for years to come but so will JSS. Wake up Judge and grow a spine.

ETA: Not only will Nurmi be scrutinized but he made a gamble and lost. Thank goodness.

Sorry if I am sarcastic. I am just so happy the COA overturned JSS. Guess my revenge side is showing. Good day for justice for Travis. I hope his family can at least be thankful for this much for Thanskgiving. I feel so bad for all they have gone through.

Of course their representation is going to come under scrutiny if their client gets the death penalty. It's called an automatic appeal. :facepalm:

Well, you bring up a good point. He's talking about public scrutiny. I wonder if the judge can/might seal all records for the appeal(s) as well, especially given Nurmi's paranoia (outrage) about 'scrutiny' and the murderer's obsession with successfully manipulating the justice system at will.

I say this because of a friend whose family member was overly sexually active by age 10 and was pregnant at 11. It wasn't family.

In any case, if she was sexually abused, and IMO, contrary to what every psychologist has to say on the matter, sexual abuse does not=psycho murder.

Well we don't know anything of course, but I'm very.. cautious ? .. of calling children promiscuous. Most aren't aware of what exactly it is they're doing. I don't know, it's a subject I don't know much about but if Angela is hers, and if the father is an adult I'd label it abuse regardless of whether or not Jodi wanted to have sex (since at that age it's impossible to be able to give consent). If the father was a child himself, then again, I'd probably label it more as kids experimenting and doing things they shouldn't, than calling a 10/11 year old promiscuous. But yeah, difficult topic I guess.

I think they would have used it to claim that Jodi was so damaged by this experience/abuse, that it made TA's pedophilia (with young kids like she was when she was pregnant) even more of a trauma that ended up messing with her head. I don't think they would have passed on the opportunity to mention it.

Hmmmm . . . . shouldn't Dr. MF "Clinic for Sexualities" have pulled out her M.E.G.A. assessment for adolescent sexually aggressive youth and done an analysis (not an assessment or diagnosis) on Jodi if this were true?

Yes I agree with your first paragraph. It was the only word I could think of for the 🤬🤬🤬🤬🤬 at the moment. A child would be experimenting I guess. Look, I wouldn't believe her no matter what she said now! She lies every time she opens her mouth.

As for the second paragraph, I am sick of any stories she and her attorneys come up with.
just sentence her already!
