This is for Jodi's damaged hard drive - you know the one that had photos of Travis chasing a little boy that her own defense didn't take seriously, and of photo's she took of herself on the road, but not for any specific purpose, and the man that saw the bruises all over her, that again her defense let her down, wasn't looked for, but she would of.......

Also Thursday, defense attorneys asked prosecutors to turn over Arias’ computer hard drive so they can conduct their own independent testing on it. They also complained that prosecutors weren’t being forthcoming in turning over evidence, because they have not given the defense access to the contents of the hard drive.

Prosecutor Juan Martinez explained that the delay was because the hard drive was damaged and an outside firm had to examine it for potential evidence.

Martinez says his team is still waiting for the examination and would turn over to the defense the hard drive and the firm’s report when everything is complete. It is still unclear what the hard drive could reveal.

My thoughts exactly. The hard copy should never be signed out, unless something is modified.

I can understand the defense being able to sign out the hard drive for examination, given that it is an adversarial system. The only way to get around not signing it out would be to have the evidence held by a neutral third party with no vested interest in the outcome of the trial.

If anyone here has in-depth knowledge of LE practices, would LE/the State make a copy of the hard drive just before releasing it to the defense and then immediately on return to see if any changes had taken place? Seems like this hard drive left the custody of LE a number of times, including several times this summer to the defense.

This has been the most repulsive trial/penalty phase I have ever followed. The trial jury found her guilty of first degree murder, FGS, and now this penalty phase is seeming to go on forever. I am disgusted beyond words and honestly don't know how much more I can take. But it isn't about me.

I posted at the beginning of the penalty phase that the DT was trying to wear down Travis' family into just asking Juan to go ahead and take the death penalty off the table. That didn't work so now they even want LWOP out. As long as the DT was wishing, they now want JA to walk free. I have had lofty wishes in my lifetime but only the reasonable ones were attained. Theirs are not even reasonable.

Judge Stephens may even be getting tired of the DT's sordid games. She needs to go into that courtroom in the morning and control it, IMO. She needs to face the fact that Nurmi is holding this trial hostage and tell him to get on with it. If he doesn't want to call a witness to the stand, then hold him in contempt. This Judge needs to finally tell Nurmi in no uncertain terms that she runs that courtroom and he will recognize that fact. Get tough, Judge, and stay strong.

It's not going to surprise me, though, if this trial is ground to a halt until after the Thanksgiving holiday. I could not despise anyone any more than I do JA, the DT, and the P.I.

Meanwhile, I keep all of Travis' family in my thoughts and wish them health, strength, and firm resolve to not let JA and her DT call the shots. They have come this far, GB them, and they know that JA deserves the death penalty. Please let them be well and persevere!

I don't post much anymore. I am usually behind and just reading the latest developments with my mouth hanging open in total disbelief!

You're right. The motion doesn't say anything about overwritten files but about someone going in without a write blocker and deleting thousands of files. I just figured the only way to successfully alter something but still have it be findable is by over writing it.

So now I'm more confused than ever. If LE was going to destroy evidence this is the dumbest, most traceable way possible. It just doesn't make sense. I want to know what exactly is happening. I want to know what Juan's response is going to be.

And Nurmi is known for wanting things out into the media that he knows will help him. He is calling a some computer guy to testify and if he and Mr. Computer guy were confident in what they'd found, they wouldn't want his testimony sealed. Maybe computer guy is the secret witness. This ploy of having nothing but this motion out there without the anchor of a thorough cross examination is very beneficial to the defense but, again, only in the court of public opinion. Maybe Nurmi wanted to save this motion until after the computer guy testified but now that the ish is hitting the fan, he went for a desperation Hail Mary pass.

This computer expert could be anybody. Nurmi doesn't exactly have a stellar track record when it comes to expert witnesses. I've been reading all of these comments and speculation for the last day or so, and from where I sit, your last sentence seems the most plausible.

It's fruitless to speculate on how/why anything made its way to Alexander's computer. To do so at this point would be like speculating about how/why Alexander wrote the "pedo letters." We simply don't know if any of this is true. It certainly seems improbable based on the testimony of both defense and prosecution witnesses in the guilt phase of the trial.

"ripoff report" is a RIPOFF. there was a major investigation done on the owner of that site by a major news outlet and they found he is a fraud. he fabricates 'rip offs' and then extorts the alleged bad people into paying him TONS of money to remove the bad info. he literally will create the complaints (posing as victims). he has a criminal record and so on.

The killer's description of Travis' reaction to a damaged CD of their travel photos seemed artificial. According to her testimony, he really became exercised, and then some. Since she supposedly brought her record of the trip to share, they might both be disappointed but I doubt he would be that rude. Plenty of Sleuths would have suspected she either distorted the incident or made it up. Only sex could pacify him, don't you know. In light of the new defense motion, the likelihood is she created the scene she describes because it was useful to cover what she was really up to that afternoon, all of it premeditated to fit not only her escape but her utter destruction of Travis. If she indeed was in part motivated by rage, jealousy & envy of his imminent trip to Cancun, their own ruined travelogue would have demonstrated both insult & revenge as it infected his computer. "This is what I think of you and this is what our memories mean now. To hell with your trip without me!"

And, IIRC, wasn't she super pi$$ed about his blog? What better way to really stick it to him, then to infect his computer.

Kiefer really can't be called a reporter or journalist. He's a tool. And has been working behind the scenes for the defense for a while now. He has a big personal beef with JM. He's filled with vitriol.

That's a journalist's job. You get on the inside, you stroke egos, you get the story. He has finely honed journalistic instincts, even if he IS biased against JM. (And maybe for good reason? ... THAT's why journalism is (or used to be) the "Fourth Estate." ... Edward R Murrow, Woodward and Bernstein ... Uncle Walter after his visit to Viet Nam ... TRUE journalism doesn't happen by way of press releases. It happens through the eyes of those who seek/know the facts, synthesize the facts, ASSESS the facts, and write the facts. Even if the "public" doesn't LIKE the facts.

In J-school pedagogy, this synthesis and assessment SHOULD be without bias; but that horse left the barn decades ago. Don't get me started on E-Journalism and the Blogosphere. Bleh. Label it as opinion. State your sources. Otherwise, sell it on e-Bay.

Kiefer is MAYBE getting his "inside leads" from the DT; but, most likely he is getting these 'tips' from a few folks in the court house who clue him into new filings. Again, having those tipsters is what a GOOD journalist attempts to cultivate.

This is inaccurate, she's already been convicted- there are no "charges" to be dropped, only a conviction to vacate, which wouldn't be done by JSS I think. It reeks of desperation, if the charges are not dropped, then they want the DP off the table.

Keifer's reports reek of Yellow Journalism. Sorry, but this guy is NOT unbiased, it's blatantly obvious that he's a shill for the defense.
