Well, it seems like it's only an issue with BN's copies. But the expert is saying they aren't proper because there are things there that shouldn't be. And possibly making alterations to his copy so it looks like it was on any clones he made. But there's no way to check because he won't give it over. And they damaged the hard drive while getting their copies made so now the expert can't even view it against the original copy made in 2008. That's why it's relevant. He doesn't have much to work with and he's explaining why.

OHHH and since the hard drive is damaged, the only way he can analyze their claim that stuff were deleted in 2009 by Juan or Flores is by checking the clones/images that BN has. But he can't do that because BN didn't follow protocol. So Juan's expert can't research the defense team's claim that Juan and Flores deleted stuff, messed with Quicktime etc in 2009. Those actions aren't on the image made in 2008!! He needs the original to check on these things that JW says amount to "misconduct".

They still don't. CDMA networks, which VZW runs on, don't use SIM cards. That's not a good thing, btw, it just is what it is. GSM networks, like what AT&T run on, do use SIM cards.

I've had Verizon since 1999 and never needed one. Not a problem for me and testimony was perfect for this trial. IMO

Willmott presses Smith on whether it's ok to wake up a computer from sleep mode at a crime scene. He says it is under some circumstances.

Willmott gets Mesa PD computer guy Smith to admit that waking the computer changes files and deletes cache files, among other things.
 
Will defense get a rebuttal, and will they put Neu. back on the stand? lol

They will probably want to but he will be too busy so they will ask for a delay until he gets his act together.

Seriously, DT should just move on ... this issue is Dead in the Water, imo.

Ok, gang, the defense and BN had 3, count 'em, at least 3 chances to turn over the original mirror image they supposedly made.

If I were JSS, I'd say, at the end of the day, that the DT had not made their case and refuse the defense one more chance to turn over the real deal, if they even have it.

IIRC, Neumeister testified that there was no incinerator on the drive???

I don't understand a whole lot, but I do get that the defense is really trying hard to get one over on the judge.

Also, I wonder if Wilmott is off somewhere in the courthouse chit-chatting with BN asking, "What the He** do I ask now?"

She would have already known what he was going to say because the DT requested time to interview him at the status conference.

If he didn't violate policy it wasn't even negligence, much less malicious.
 
I don't think the computer should have been turned on. But it was an honest mistake. It wasn't misconduct.
 
Even if waking up the computer isn't really the best course, it's technically not in the protocol and the expert has even done it himself. So Flores didn't not follow protocol.

Was it turned on or woken up? Isn't that difference significant in terms of what's being charged?
