What is Return of the Hearing?

I think I haven't been present enough in the last couple weeks! : )

It's the trial within the trial, in which the prosecution is the defendant, and the defense is the prosecutor, and there's everywhere and the psychopath is heard saying 'fun fun'.
Simple, isn't it?

The latest defense witnesses seem manufactured just to lend weight to Nurmi's motion. During a hearing before JSS Juan mentioned the defense had two expert witnesses, a possible witness from CA, and affidavits. Now all of a sudden there's all these witnesses that can't bear the Constitution. Rather convenient, isn't it?

Dr F probably wishes she had gone that route at this point too.

Agree. This way Nurmi can talk about what they would have said without actually having to call them while making the argument that Jodi couldn't adequately defend her life because all these witnesses were willing to testify but just didn't and their testimonies would have helped her. It's kind of stupid, really. In terms of trial noteriety, Jodi's up there but it's still failed to reach Anthony and OJ levels. The only people following it anymore are the people who always followed it. It isn't even super market tabloid fodder. I don't know who these people think they are. And, hopefully, JSS will remind the defense that if subpoena simply isn't an option then they can either choose or not choose to testify but that is their call and their right.

It's too bad that JSS won't ask KN this question: "So except for Dr F, everyone on your witness list - including Ms A herself apparently - would rather that Ms A get the death penalty than testify on her behalf in open court?"

The end date given during jury selection for the #JodiArias trial is in 16 days. Glad I took the "over" with my bookie.

That's right. The precedent Nurmi's motion would set, if granted, is ridiculous. If your defendant is such that no one will come forward to defend her in public, that's a reflection on your defendant, not an indication that the Constitution has to be adjusted down to accommodate her poor character.

What galls me almost as much as Nurmi is that JSS should have seen this coming. She aided and abetted this mess, helping Nurmi pave the garden path straight into the garbage dump.

And that's exactly why JSS should realize she'll get slapped down again if she does down this path. Otherwise every DP trial from now on in AZ will have the DT demanding court be closed.

On Thursday the jury will be absent but we will be hearing testiphony from a defense computer "expert" who will say Travis' computer was full of . This hearing started the week before Thanksgiving, I believe, and features the same guy (Brian something) who tried to convince everyone at the first trial that you could see an outline of the killer in Travis' eyeball in the shower picture.

But have no fear - Juan said he can prove Brian tampered with the computer and what he is testifying to is a load of you know what. And if Juan said that, I gotta believe it.

Wouldn't it be funny if a deputy is standing nearby twirling some handcuffs ready to arrest BN as soon as he walks of f the stand for tampering with evidence and perjury?

I agree.

I think back to how other judges have quickly denied and denounced tactics like this from defense attorneys, and yet we have been taken down a rabbit hole so many times.

A lot of the crap the DT has been throwing should have been shoved right back down their throat. And with lightning speed. Not days of delays.

The money and time waisted is beyond ridiculous.

This trial has sunk so deep into the Arias psychotic quagmire, dragging the American Constitution and all jurisprudence with it, that I doubt JSS can ever pull it back out. Justice for Travis seems an impossible dream at this point.

For the jury's sake, I hope JSS orders a continuation/completion of Dr. F's testimony first thing today. The constant interruptions and gears-switching is ridiculous and unjust to the victim.

I remember JM nailing Dr. F with the fact what TA's email to a 9 yo was a job related mass mailing. Then Dr. F testily replied iirc something very like, "I never said TA was a pedophile, and I don't believe he was." Did that occur during JM's cross or Nurmi's redirect, because I don't remember JM pouncing on that astounding admission?

It was during cross. JM didn't pounce on it because calling the witness's attention to her error usually backfires. Best to hold the pouncing for closing argument.
