I didn't read the whole thing, but I find this motion to be a clear sign of what BS this issue of prosecutorial misconduct is. Jodi wants the charges dismissed or IN THE ALTERNATIVE for the death penalty to be dropped.

Say what?!?! If the prosecution is hiding/destroying/altering evidence, the charges SHOULD be dismissed! Look at Debra Milke. She's going to go free, never to be bothered by the charges against her again. Why would Jodi and her team be willing to settle for the possibility of life without release if what they say is true?

Obviously they know it's not true.

Psychopathic deviance. It doesn't exactly measure psychopathy levels but psychopathic traits. Hers were very high, though, which is a red flag. I remember Willmott questioning Demarte on this. When she asked what it stood for and Demarte told her, Willmott quickly moved on.

Right you are. Most who score highly for that scale are dx'd with a PD. Psychopathy in terms of actual clinical dx only exists as a scale for antisocial personality disorder in the DSM V. There is no 'clinical' test for actual psychopathy - rather tests used (usually forensically) are specifically geared for psychopathy, such as Hare's PCL-R.

Oy. The computer wars rage on. Now the State is accused directly of with holding exculpatory evidence in the form of.....the 2008 image HD.

Says the 2009 HD image by Dworkin was made in Dec. 2009, so after files had been modified by the DT examining the HD. So......is the DT saying Dworkin didn't use the 2008 image HD to clone? Why not?

I personally don't know a single woman who has kicked holes in walls, kicked down doors or smashed windows. And considering that she had a decent childhood, a decent family and decent boyfriends... she's a raging freak.

And let's not forget--CMJA also kicked and probably killed Doggie Boy--since he was never seen again after she kicked the poor thing. Also she took a baseball bat to her brothers head when she was only 4 years old. She also kept a co-workers cat locked up all alone in a room for two weeks. She did provide food and water--but never went to check on the cat for two full weeks! By then the cat was shaking and totally traumatized.

Because at the time, the (current) DT didn't know that creating a new "2009" image of the hard drive would result in something different than the 2008 image created by the prosecution. But it did, because the hard drive had been altered (although probably not in any relevant way) during the 2009 meeting with the (former) defense team to review the evidence.
