I think there's probably a few crimes she hasn't been charged for - like stalking and stealing from her grandparents. I do think this is her first murder though. She's too disorganized to get away with it. She's a sloppy, chaotic, reactionary psychopath. There are others, of course, that get away with dozens of murders - they're generally either incredibly lucky or much more organized - with emphasis on the latter.

To me, there are 'good' psychopaths. When they lie, they do so with such fluidity and sincerity, one may very well question their own reality. Then there are 'bad'. When they lie, they get caught - you may even confront them with it (they'll deny, deny, deny), but you'll still know damn well they're lying. Ergo, Jodi's a bad psychopath. A very bad one. ;)

Again with another test, anxiety and depression rank high for #jodiarias. This test 5 years after incarceration.

NOT SURPRISED. This is a woman that lied for two years straight about ninja's killing TA. It's entirely plausible that she'll keep pretending to be a poor depressed victim when talking to PSYCHIATRISTS! She's not stupid.

Psychopaths keep on learning more and more ways to manipulate and affect outcomes when dealing with psychology types. Many a psych type has been fooled by them. She's had plenty of time to perfect her game, enabled by the DT, the mitigation specialist, and Judge Stephens. And if she has had complete access to all her tests, it's a slam dunk.

This is all starting to make sense to me....

The thing she was most likely to do (off herself) is the one thing she never did despite having numerous chances to do so.

The thing she was least likely to do (be aggressive) is what she plotted elaborately for several days, carried out, and then carefully tried to cover up.

So obviously the mitigating factor that should spare her the death penalty is that these tests suck!!! I can't believe I never realized it before!

Found a minute entry date 11/13/2009 that says:



Haven't found anything yet that explains why a 2nd image copy was made Dec.2009 though...

Strange ordered to turn over by Nov 20 2009 (so that would be the June 2008 mirror) and def is claiming they got Dec 2009 image.

Doesn't make sense to me....

Like so many other things, it depends on how they are used. And since they are not an exact science, there is plenty of room for manipulation.

#JodiArias jury is taking no notes on any this psych testimony.

Interesting if true, either they understand, don't understand or don't see any of this as a mitigator.

I hope some may see it as the DT offering up excuses for the convicted murderer.

Interesting. I thought Dr. DM found she was malingering, but not sure.

Plus she knew enough to answer incorrectly on the first test to support her ninja story. And somehow Dr. S. missed that part.

Just noticed on Beth's notes of the hearing, that when JW was questioning Maria S. about her June 19 visit, she said she knew a mirror image had been made. She left the case in Aug. 09 (Jodi req'd her removal in motion 5/09). Doesn't that dispute Nurmi's contention that the defense wasn't aware of this 2008 copy? Maybe the defense (at the time) was told...

So they are saying that the prosecution deliberately withheld the original copy from them? It was never turned over in discovery? That doesn't sound good?

Before getting excited over this one, it might be helpful to know the usual protocol with electronic evidence. To me, the hard drive itself is the evidence and the State did grant them access to review it and make their own copy. Does the defense normally rely on the State to provide them with a copy or do they make their own?

I think Nurmi is making mountains out of molehills here, suggesting that the State did something wrong. My guess is that the defense would want to make their own forensic image and if they had any concerns, they would then ask the State for a copy of the original forensic image. Something tells me the State is not obliged to provide them with a forensic copy if they have already been granted access to the actual physical evidence.

ETA: Posted this before I read the 2009 minutes ordering State to turn over copy by 11/20/2009.

Guess my theory is blown out of the water.

I have to remind myself that I get all riled up when the defense is doing the questioning and everything gets straightened out when Juan gets up to question.

It's like waiting for Underdog to appear in the midst of a crisis. No pun intended. LOL

Whenever I despair over this case, I watch JM's rebuttal to Nurmi's closing from the guilt phase and all my fears melt away.

Rereading the new motion. Nurmi says that had the DT been aware there was a difference between the 2008 and 2009 images, they would have asked for both.

Well, then the DT must have known about the 2008 image. Duh.

And I love how he dismisses the fact they didn't ask for the 2008 image to be cloned by Dworkin....that case law says its irrelevant.

Something weird is going on with my computer. I apologize for not being able to post more tweets from Twitter. I'm trying to figure out why I can't get past page 12 on this thread--in addition to not being able to access the latest tweets going on in JA's sentencing phase of the trial.:tantrum:

If you are using a Windows 7 operating system, there was a bad patch in the updates that came out last Tuesday. I am still working my way through trying to fix the damage. Google Windows 7 Update and filter it for the past week for more info.

You're not crazy. ;). That's why I said she's talking out of both sides of her mouth, why I don't think JSS "gets it, " and why I am not the least bit optimistic that JSS is delaying son as to cite him with contempt.

BN's refusal to obey her and her kumbya response is a perfect example of her overall paralysis , IMO.
