Rereading the new motion. Nurmi says that had the DT been aware there was a difference between the 2008 and 2009 images, they would have asked for both.

Well, then the DT must have known about the 2008 image. Duh.

And I love how he dismisses the fact they didn't ask for the 2008 image to be cloned by Dworkin....that case law says its irrelevant.

Looks to me like the original attorneys asked for the HD copy and the sim cards from the phones in November 2009. So in December 2009 they were given access to the actual computer and the phones. Looks like after they messed around with the computer, their IT guy got a copy of HD. Nothing ever came of the sim cards because...well they don't exist. And all of this was done by the original defense team. Enter KN and JW. They see this motion from Nov 2009 and they realize they do not have a copy of the original 2008 copy or the sim cards and they fire off the motion for prosecutorial misconduct.

Looks more like miscommunication between the original defense team and the current one to me.

I can imagine CMJA is depressed and anxious. It would make total sense as her life, as she knew it once, is way way over. She has to fall in line in the jail hierarchy and IIRC, she is still in isolation, with 1 hour outside of the jail cell per day. I truly believe she thought she was not going to be convicted, and at the time of her post conviction interview, she had not even come to terms with it.

I just look at all the motions as stuff being thrown against the wall to see what will stick. It seems as though Nurmi continues to do this as if to show the appeals court he has been justified in all his actions. IMO CMJA will probably get LWOP. She has 1 mitigating factor, maybe. I just hope JM drives home the heinousness of the crime and the aftermath, then maybe, just maybe, the jury will see what we all do. JMV

Strange ordered to turn over by Nov 20 2009 (so that would be the June 2008 mirror) and def is claiming they got Dec 2009 image.

Didn't JW express in the guilt phase ( I think in closing arguments) that she would be proud to have the convicted murderer sit next to her at the table because she was intelligent ..... Not exact but some thing to that affect ..... Now JW wants the jury/court to believe the convicted murderer is mentally ill.

Such good sleuthing skills so many of you have. I can do some really good sleuthing in genealogy for other people but so far this area is eluding me, guess because I rely on you all. Wonder if this means that the State made a mirror image copy with write blocker from TA's actual computer in November of 2009 and did not make a copy of the June 11, 2008 mirror image copy with write blocker. This as explained by some that neither PT or DT might not been aware of the changes that were made to computer by turning it on for the DT to look at the computer (June 16, 2009). Thank you for finding the minute entry date for Nov 13, 2009.

WOW...I wasn't aware there were so many of them. No wonder things got a little muddled as far as what evidence they had. I am even more convinced that is exactly what happened. Which explains JW's foolish insistence on the sim cards as well. Likely the original team had already seen the phones and knew they didn't have sim cards. So they just waited for the prosecution to process the phones and give them the discovery (I read it took two years to get the text info from them?) But for whatever reason, they decided to take their own copy of the HD, probably the day they were there and turned on the computer because I believe they did indicate they had an IT person there with them didn't they? Was it Dworkin? Was he there that day? Did whomever took the copy not think about the possible consequences of turning the computer on before taking the copy? Did they get the copy at a later time? Did the defense neglect to tell their expert that they had been viewing it and had turned it on to do so? Didn't MS say that they needed to look at it to see how much they had to copy or analyse? To put it in the budget or something? Why was that necessary when they could have just waited for the copy from the state that they had requested?

I think we're going to find out that agreements were made between the state and the defense team at the time that they had the evidence they needed from that motion. But of course MS will likely get up on the stand and "fudge" about that as well.

What a mess. And again...nothing on the computer has anything to do with why JA slaughtered TA and is in no way exculpatory evidence in the original trial or in this sentencing phase.

ETA: Okay so I see they were there in June 2009. So how did Dworkin get a copy from December 2009? Did he get it himself by getting access to the evidence or did someone from the state take a copy then and give it to him? :waitasec:

To me this whole thing is open and shut. And apparently to twelve other people who found her guilty it was too. Why oh why is the sentencing taking so damn long. It is as if we are sitting through the guilt trial all over again. Personally I am losing interest. I am coming to the point that I don't care if she lives or dies and I don't like this indifference I am developing. It seems they have all forgotten why they are there. Please folks let's move this along. mo

To me this whole thing is open and shut. And apparently to twelve other people who found her guilty it was too. Why oh why is the sentencing taking so damn long. It is as if we are sitting through the guilt trial all over again. Personally I am losing interest. I am coming to the point that I don't care if she lives or dies and I don't like this indifference I am developing. It seems they have all forgotten why they are there. Please folks let's move this along. mo

I couldn't have said it better. And still wish the Alexander family peace as they continue this journey. I'm not sure I could sit thru this nonsense.

I don't think I could. I can hardly stand this and I didn't even know Travis. God bless them and give them continued strength. It has got to be taking a huge toll on them.
