I realize now when I get in the weeds with the defense my brain gets scrambled!!! Too old for that so I will wait for Mr M to straighten this mess out...

Once we get off the Slime Interstate (defense BS) and back on the Sanity Highway (Juan's Cross) you'll be out of those daggone weeds Meemaw. Juan will be doing 90 miles an hour getting back on course. :happydance:

To me this whole thing is open and shut. And apparently to twelve other people who found her guilty it was too. Why oh why is the sentencing taking so damn long. It is as if we are sitting through the guilt trial all over again. Personally I am losing interest. I am coming to the point that I don't care if she lives or dies and I don't like this indifference I am developing. It seems they have all forgotten why they are there. Please folks let's move this along. mo

Well unfortunately the original twelve weren't able to get the whole job done so it wasn't that open and shut to all of them, even though it really should have been if they had been following the law. There were no mitigating factors last time that should have had anyone voting to spare her life.

So they handed the DT a do over it appears. And the judge is too scared of an appeal to do anything about it.

The state should have just requested that the judge sentence her after the first jury could not. She'll never actually get the DP anyway.

Might also be time to look at how sentencing is done in DP trials. I think that should be left up to the folks who know and understand the law. Maybe a panel of judges rather than a jury of laymen?

I miss the forensic astrology forum but am so grateful to have Tuba posting on the killer and this case. Thanks to all of you here, it certainly helps to have such fine minds and kind hearts pulling together to see this through. This has been a long and painful road. I hope and pray it leads to justice for Travis, his family and loved ones. The fact that Christmas is approaching just breaks my heart for them.

Maybe she's not, in fact, assertive, but instead very very aggressive.

I think she is PASSIVE/AGGRESSIVE personality. Not outwardly assertive, but then strikes in an aggressive manner after seemingly passive.

(I can't believe I'm looking at the HD stuff again...sure wish Nurmi would lay off the motions...)

His latest is just plain poorly written contradictory silliness. I'm repeating myself, but then, so is Nurms.

The original 2008 image exists, so no evidence was destroyed. Its that simple. Changes were made accidentally June 10. No negligence, no malicious intent.

Changes were made on June 19, 2009, these the subject of Nurmi's original motion, in which he accused JM and Flores of sneaking the HD drive out of the evidence room and of deliberately shredding thousands of 🤬🤬🤬🤬 files. It couldn't be an accident, said he then. Had to be egregious misconduct.

Sadly for Nurmi, turns out the HD was checked out to accommodate the DT, who insisted on examining the original HD tho they knew an exact image had already been made in 2008.

Nurmi's response? Now JM handled the HD on the 19th, in his quest to find naked pics of CMJA. So the deletions on the 19th are still JM's fault.

Reality is, its not the State's fault that the DT didn't ask for an clone from the 2008 image rather than the 2009 one , anymore than it is the State's fault CMJA rushed to be interviewed after she was found guilty.

Has anyone kept track of the motions that JSS has in her pile to rule on (after taking it under advisement)?

Haven't 9/10 of them been released "under seal"?

Why does the DT get to wait on the CoA summation of their findings before putting on certain witnesses? If they run out of witnesses willing to testify - can they stall further if the CoA doesn't answer for a couple of months?

This trial has been bits and pieces of information and feels kinda like picking up a few pieces of confetti from the actual trial transcripts and trying to put a page together let alone the contents of what is actually going on.

So far, JA's only scheduled tomorrow at 9:30 am, for this week. What all does Juan have to do? Provide the original hd, take the transcripts & testimony from the trial & ta dah, oh interview JM vs Geff's? I really didn't understand the schedule for the remainder of this week and the Jan. 2nd, date JSS threw out there. Crazy.

Any explanation for the schedule via tweets would be appreciated. I was busy today but checked when I could. (lame, I know) tia

I think it would be quite easy for someone as methodical and devious as JA to manipulate a test like the MMPI. She has spent her life observing others and absorbing their personality traits, as she is void of "self" essentially. She becomes whatever works best for her to achieve her current goal. She has no self to which to be true. Her "personality" is an amalgamation of observed and culled traits of others. It would most likely be fun for her to work backwards from her end game and assemble a persona to achieve that goal. With that mindset, the test becomes a tool and a game for her. How come this didn't come out with Dr. MF the "sexpert"?

Because she wasn't there to talk about JA's sexual dysfunctions, only Travis's. According to her though the only issue with those sexual practices was the Mormon religion part of it.

Let's see. Today was full of BS by the defense psychologist Geff...something or other. According to him JA is NOT aggressive, does not have anger issues, is suicidal, has no support, is depressed, is submissive, does not refuse, etc, etc, etc. Picture a female that is the exact opposite of JA.....that is who this Dr claims JA is based on the tests she took. That was pretty much the entire day, over and over again.

Witness of the week for the defense is Dr. Robert Geffner (if you recall from the first trial, he of the spilled water and audible burping into the microphone). Wilmott spent just about the entire AM going over his credentials and getting the whole thing Juan hammered him on in the first trial out of the way - namely a judge in another case telling him he was nothing but a hired gun and completely ridiculous. He spent the afternoon going over some of JA's psych tests. He says she is severely depressed, submissive, and highly suicidal. He said she is not aggressive, not a liar, not assertive, does not have anger issues, and a whole bunch of other things that made us LOL.

In other news, Nurmi has filed another motion to dismiss the case or in the alternative drop the death penalty based on - wait for it - prosecutorial misconduct. This was filed yesterday. We also learned that Neumeister has still not turned over whatever it is he was supposed to turn over, and that Juan needed to interview him, Tony, and mystery computer guy further. Oh and defense never provided summaries/notes of today's witness, and the judge graciously agreed to give Juan a whole hour tomorrow before trial to interview him (note the sarcasm).

I am so sick of this fracking trial. Now we have her as mentally ill wilting wall flower. So, sick of these motions that Nurmi twists around. So sick of looking at her fugly puss and her unusual minions. I just want her to wither away into the dirt and get trampled on. I can't wait for Juan to get up and take her, her team and her manipulated witness and make them pound dirt. Feeling frustrated. Get it done with.

Also, she did not do an assessment/psychological evaluation on Jodi either. So she says, and I wouldn't want to mischaracterize her either. :eyeroll:

Thank you both. She's not a liar? He didn't seriously say that did he? If he did his entire credibility is out the window. The one thing proven is that she is a liar. She made up several stories. How could anyone say, in a serious tone, that she's not a liar. :gaah:

Easy answer to that one. "JSS".
Sure, the DT is bringing up the purposely BS delays, but JSS is absolutely the ONLY person that can help speed this trial along and she is doing nothing about it. Juan tries to help but gets little to no support. So I put a large part of the blame of the length of this garbage right square in the judges chambers.

I had high hopes before this phase started that she would play some hard ball this time around but no, that is not what we are getting. We are getting an endless game of Nerf Badmitton.

The schedule makes 0 sense and we should be having every single workday possible to finish this phase. Instead it seems every single excuse to NOT have a trial day is taken by JSS. I know its getting old harping on the judge but she is the absolutely only person with authority that can do anything about speeding things up. And its not happening. And no sign things are going to get any better.

So we may as well all start taking the judge's attitude and pull up a lounge chair, take some more breaks, have a drink or 2, and settle down for a long winters nap. :)

Lets just hope the jury is still around by the time they are given the case.
