In the Power & Control wheel there are to be patterns of behaviors not just one incident.

So the tirade of 12-16 pages over 2-6 hours that Dr. MF testified of text when TA was totally P'eed off at Jodi for being the most evil person - does not a "pattern of behavior" make. (IMO)

She has already been found indigent. That finding will carry over to appeal. The State does not get to decide if her appeal is viable before approving the funds. That would be a major conflict of interest for sure.



The concern was that JA wouldn't get the right to testify and had not voluntarily waived the right BECAUSE she felt pressured into waiving the right due to the death threats, etc.

emotional abuse, verbal abuse= First off, no one knows what set off that "mean" e-mail. Secondly, one mean e-mail does not equal abuse.
Emotional isolation = Really? They were **** buddies. He wasn't responsible for her happiness.
and sexual abuse = The sex was always consensual.

I recall during at least one of JA's videos(or was it during her testimony...) that she freely stated that TA had never physically abused her and also that she was fully willing participant in all their sexual fantasies.... kinda hard to then say he'd physically abused her, even if she later tried to use her hinky finger as proof...

I'm thinking she might if KN was trying to suggest that the fact that they even happened was prosecutorial misconduct. In his convoluted thinking, the prosecution should have prevented JA from saying things on camera that were damaging to her mitigation case. APPEAL!! LOL

I think that Dr. Geffner has testified to the results of the tests he administered to Jodi in an appropriate and professional manner.

The tests are valid in that Jodi has consistently answered that she is suffering from PTSD, paranoia, suicidal ideation, anxiety and depression. This is a valid portrayal of what Jodi told him, answered in tests, and projected herself to be suffering with.

I think this opens all the doors for previous testimony on these very issues that brought him to his conclusion.

Funny though - he jumped from psych tests to issues of power and control (per JW's instruction) and we never actually heard what his final psychological diagnosis based upon testing was.

AZLawyer, can Jodi refuse to get back on the stand? And if she can and does refuse to answer questions from Juan and the jury, will the jury be instructed to disregard everything she's testified to so far?

If everything she said so far was already said in the guilt phase, JM could use portions of his cross from that phase to replace cross in this phase.

If not, JSS should instruct the jury to disregard whatever she said that was new.

Another option is to tell her to get on the stand for cross if she has nothing more to say on direct. And if she refuses to answer questions to tell the jury that they may assume silence means "yes." But that option would take some guts on the part of JSS lol.

Someone who refuses to cooperate with her attorneys and takes over her case herself, not once but twice just so she can "control" what is happening does not sound like a submission personality to me.
