Despite JSS' paranoia about successful appeals, if that's her issue, I can see the conviction being thrown out down the road, based on counsel erring in not presenting a mental illness defence in the guilt phase. The thought makes me feel sick.

AZL.....think its possible for a group of WS's to file an amicus brief in this case, as representatives of the public, requesting that the transcripts be made available immediately?

That's kinda tongue and cheek, and kinda not. The COA has already reminded JSS that as the public we have inherent standing in this or any other case. :)

Couldn't someone (even AZL herself) just appear with the order and request the transcript? How could JSS legally say NO?

Thank you, AZL--I am still a bit confused regarding the transcripts. Why is the video, versus written, the official transcript? Does one carry more weight than the other? Does this become an argument of semantics as JSS has ruled no video released until the trial is over? I thought the pending order JSS was waiting on to release the written transcripts was the COA order, which has now been issued. :confused:

Both are now the official transcript, but only one was ordered to be held. JSS ordered no MEDIA video released until the trial is ordered. She also sealed the court video, but then unsealed it and ordered a written transcript to be prepared but held pending further order (not sealed, just held).

Yes, IMO the Ct App order should be good enough for her to release the "held" written transcript, and IMO the video transcript from that day has been unsealed and I would pay good money to see David Bodney try to convince one o the court clerks of that fact lol.

Good Morning. Judge SS is still looking over other cases. No sign of #jodiarias or her mom, but counsel, witness and TA family here.

Luckily there is no such thing as a mental illness defense. Mental illness short of insanity is only relevant at the mitigation stage.

Since the COA order the transcript released, could'nt one of the people present that day when she testified (such as TA's family memebers) make a pubilc comment about her testimony? They are not held to secrecy anymore.

If they actually start at 9:30 that would be starting early. Usually about 9:40 we hear that she's finishing up another case, then there's a sidebar and the jury is brought in before another sidebar etc. The 9:30 time ends up being closer to 10am most of the time.
