Please don't any WS'rs call JSS boss. I am sure that they are well aware of the length of this trial - court schedules are backing up because of it, no doubt. (IMO)

I do understand the frustration and I have been guilty of being outraged at the snail pace of this trial.

Just to put this in perspective the trial started on Oct 21st, there have been 36 potential days for trial (M - Th) not including Thanksgiving or the 2 week Christmas holiday. If court were to have been held from 9 - 5 there is a potential for 6 hrs daily = total of 216 hours.

To date, jurors have been present 16 days for a total of 69 hours of testimony.

BBM: These are the hours that Nurmi&Co should be paid, not the entirety of the delays.
Maybe if it's stated that the amount of time caused by delays will not be payable/billable there would not be so many.
Or, for every hour delayed, deduct from grand total.
I'm sure the thought process would be different for defense attorneys.
I know this will never happen - just a different perspective or view.
Oh, by the way, just my opinion:giggle:

But, even if intent was different than the outcome. She should be judged on outcome not intent. She could have called for help after shooting him.....she did not. She killed him ruthlessly and painfully.

Exactly! IF he was shot first and it didn't kill him, that should have sobered Jodi up enough to forget about her plan and all the subterfuge and dial 911 IMMEDIATELY!

Pre-med can happen in the blink of an eye, even if one didn't believe pre-med before, she had time to back out right then.

Actually makes it More cruel and Heinous to me. Poor guy survived a gun shot and was aware of all the stabs, up to and possibly including the near decapitation?????? Surprised the DT went there, musta' been Jodi's bright idea.

I wonder if the TA family regrets not going for LWOP. I understand they feel she deserves the DP, but this has got to be grueling for them. JMO

One would presume that JA would never have agreed to that. She has nothing to lose really.

Not a chance. They are likely more angry, more determined by the minute. However, if the jury decides LWOP, they will feel let down for a long while. There is no such thing as closure when a loved one dies, much less is murdered. I suppose eventually they will be glad she is gone, locked away in a small cell. But for now, they want her to pay.

This has been one of my biggest pet peaves with the way the judge is handling this infinite phase of the trial. Practically every single stupid motion and allegation from the DT goes unchecked and not questioned by the judge. I thought there needed to be PROOF supplied with the allegations that Nurmi keeps throwing out there. Its like the judge just automatically and erroneously is allowing all these motions and allegations as if they are fact.

I honestly think a very large portion of the motions and allegations could have been squashed and denied right up front because Nurmi was not supplying any proof that his allegations are even true.

A perfect example is in the latest one. He claims witnesses are afraid to testify and wont testify because they received life death threats. The judge needed to have sworn witness statements to that affect and I dont think that was the reason for most of them. The real reason was they saw how embarrasing it was to stick up for the murderer Jodi and they saw the backlash from the public. Which by the way is totally legal and expected to have the public get outraged by supporters supporting a known murderer of the likes of Jodi with all the lies she has claimed about Travis.

So the real reason most did not want to testify had nothing to do with death threats IMO. I concede there was 1 or 2 witnesses that may have gotten a threat but those were already dealt with and they already testified. These other witnesses Nurmi is now alleging is BS about his reason.
JSS needed to get sworn statements to prove him wrong and then she could have denied and thrown out his motion.

There are many other examples of this same sort of thing. The judge is not asking for proof of the allegations and they must be proven before you derail a trial for days, months, years. Most all of his actions could have been denied straight away with no proof.

And for MOST of the rest of them, they should have been CLASSIFIED as an "Appeal against the original Verdict", and has nothing to do with senticing phase and could have been thrown out for that reason. Let him file appeal after sentencing.

BBM ITA. Didn't JM depose Womack and she reneged on testifying because of what he discovered during that interview? Doesn't JSS remember why she didn't testify? The judge should definitely require substantive proof of death threats. I know we miss much, maybe all, of what goes on behind closed doors :facepalm:, so she may well be much more engaged than she appears.

Perhaps. Either way, the first jury necessarily saw a very different defendant than one who for all but one day has sat next to her attorneys, quietly doodling.

But they did see the autopsy photos and JM will remind them.

I'm still a little confused about the grounds for appeal. JSS did comment in her ruling that Flores' false testimony was a "harmless error, " given what she believed to be evidence that Travis suffered and that JA should have known that he would suffer.

My interest in JSS' rulings on agg is entirely about whether or not she's vulnerable on the issue later on during appeals, or if she at least perhaps believes her agg rulings might be open to attack.

OK, she was using the phrase "harmless error" in a different way, but I see where you got that from now.

I don't think she's going to be overturned on that issue, but given her super-sensitivity regarding appeal issues, she very well might feel differently. And I think it's the BEST appeal issue out of all the pretty bad appeal issues.

I don't understand the bolded part. Anyone want to help make it a little clearer? What result?

JSS was saying that the murder would have been "cruel" based on the evidence regardless of what Flores said or didn't say about the order of events.

The circus atmosphere definitely does NOT continue to this day. Seriously, no one in Phoenix is talking about this case, and certainly the courthouse is not surrounded by TV cameras and trial tourists. IMO JSS would have been better off sticking to her guns, though. Changing her mind only telegraphs that she thinks her original decision was in error.

I agree that, as with the original trial, JSS does not maintain order in the courtroom, does not demand respect from witnesses or counsel, does not consider the rights of the public to know what's going on, and does not keep things moving at a reasonable pace.

And does not consider, or appear to consider, the jury, and their inconveniences by showing up and being sent home time after time after time.

1. A few months ago someone on here mentioned that if this jury can't come to a decision (LWOP/DP), then JSS decides between the two (LWOP/DP). Is that correct? Can you imagine what JSS really knows about this case?!? She knows all of the 'secret' stuff, sidebars, dead pets, all the goodies WS'ers have found, etc... CMJA will never see the light of day if JSS gets to decide CMJA's fate.

2. Isn't all this computer back-and-forth tied up in a motion with a Prosecutorial Misconduct allegation? We keep focusing on the 🤬🤬🤬🤬 motion (and delays therefrom), but if it clears the State of prosecutorial misconduct (a possible appeal option), we should welcome a thorough review, right?

I just read the states motion to preclude, and basically from what I now understand is its all sues fault and she is going to be the patsy. BN backed off his high horse while being deposed

I think the gun shot was last. I think he was still making noise gurgling or something and she had to make sure he was dead. I don't understand why this jury or juries in penalty re-trials aren't required to watch video of the first trial. If they did that, this jury surely would be mad already because everything has changed. In the first trial she claimed self defense and now it's that she is a mentally ill "little" girl. If I saw the differences as a juror I would want to know why. And I just don't understand why they don't have the jury do that to bring them up to speed. JMHO

I think the people in her 'journal life' are much like Casey Anthonys fantasy friends. They are loosely based upon 'real people'----but what she says about them and the events she describes are all n her pointy head.

Firstly, "Pointy head"..... cracked me up. Thanks for that, Katy. Secondly, I agree with the fantasy friends point. Her journals talk about going skiing, swimming, four wheeling... with her fantasy friends. They may be loosely based on people she knows but we know she never went skiing. She was writing to make her life look much better than it was. PPL gave her a chance to travel domestically, a little. Her journals also talk of world travel - wanting to explore. I hope she never gets beyond the gates of prison.

I'm voting #3, AZlawyer. Thank goodness, Juan has (supposedly) his real name. My reason for believing this is the best possibility, maybe? Go back to the Casey Anthony trial. On Day 18, the defense tendered William Rodriguez, a Defense Department employee and expert in forensic anthropology and taphonomy, the study of human decomposition, as a witness. It turned out that Jeff Ashton had never read a report from him and needed time to depose him.
