I gather from Nurmi"s argument it is this......"If court is open, it's game over. She cannot come up her and argue properly for life. This is not about KPNX and other media outlets producing reality TV. This is a death penalty case. ...This is not a voluntary waiver of mitigation and any sentence of death cannot stand."

KN's argument is spectacular if you expand on it a bit to what he really wants. "She fears for her life if she testifies to try to save her life, so the only fair thing is to take the death penalty off the table."

IMO ~

JA is throwing her father under the bus, and then driving those big tires right on top of him. She doesn't want anyone to hear her NEW LIES that he ALSO sexually abused her.

So, if I understand correctly, that makes him a) an undercover cop; b) a minor victim of sexual assault, or; c) just another one of Arias' witnesses. :silenced:

I would think JA would want to know on a day-by-day basis what the jury members are thinking through public comments. She is entitled to a public court trial. As a jury member I would be wondering why the public was kept for viewing her testimony and what they were trying to hide from the public. Taxpayers are paying for her trial. They have a right to know that it is being conducted fairly. If nothing else if she is having a problem with the gallery and media let them go into the overflow room where she does not have to view them.

"However, even if Arias decides not to testify in open court, her lawyers or the State can present evidence from the guilt phase trial or the earlier penalty phase trial that could be considered to be mitigation.2 A defendant who testified in open court during the guilt phase of the trial cannot decide she will only testify in the penalty phase if the press and public are excluded and her testimony is sealed until after any verdict. Neither the rule nor case law envisions that her concerns amount to a clear and present danger to a fair trial before an impartial jury."

Good Morning All ... I just logged in and see the circus is still continuing. Given the severe lack of transparency, I feel like this trial is taking place in some third world country.

That's why my earlier frustration/disbelief has been replaced by horrified fascination. JSS is setting a record number of precedents of what not to do for other AZ judges to learn from imo.

In the minute entries that were posted upstream, would these times be testimony or sidebars? Looks like not much will be in transcripts either way.

IT IS ORDERED sealing the transcript of these proceedings and the electronic court record from 9:57 a.m. – 10:15 a.m., from 12:18 p.m. – 12:28 p.m., from 2:44 p.m. – 2:58 p.m. and from 3:09 p.m. – 3:25 p.m. not to be unsealed without further Court order..

she fears prison and that will not be taken off the table.

JSS is going to deny, worried about if damage is done, can't be undone. Wants to give time for stay motion to be decided

Oh, how considerate JSS is of Jodie. Yet she shows no consideration for the Alexander family, no consideration of the juror's time, no consideration for the State or for the damage to Travis's reputation.

Given what is being reported as being on Beth's site, I wonder if this was back and forth about the scope of what Sue Duh Nihm can and cannot testify to at trial. But that is merely a guess.

If Beth is reporting Sue will testify in the trial, I would bet "porn" is coming in. On a Thursday, to give the jury all weekend to mull it over.

Does the state get to cross-examine witnesses any more? JA lied secretly for a day with no cross, then Geffner spent four days (which is like 25% of the entire penalty phase) saying Travis got what he deserved with no cross, and now we're moving on some other witness who'll spout another bunch of nonsense.

I don't know if this is ok--if not please let me know. But maybe seeing the statement JSS made regarding the "potential damage" in full form might bring more clarity... per BK reporting-

"Judge Stephens: This matter is before the Supreme Court. My concern is that if I release the transcripts, potential damage cannot be undone. Since the response was filed yesterday, I believe the Supreme Court should be given time to review and decide. This court asked that the transcripts of the sealed testimony be prepared so there will be no delay once there is an order. However, because the Supreme Court has had this issue only since Monday and because this issue is so important and can affect the outcome of this case, it is inappropriate to release them. If the Supreme Court does not rule on the stay by next Friday, Jan. 16, the judge will hear additional argument at 8:30 am"

FWIW IMO MOO, etc, this statement by JSS indicates to me that she herself believes that JA should be allowed to testify in secret despite what the COA has said--really believe at this point that she very well may have ignored or defied the COA ruling (and to a certain degree allowed the DT time to appeal to the ASC) because she disagreed with COA findings.
