I guess I was overly optimistic when I heard there would be a ruling on taking DP off the table/Prosecutorial Misconduct. I expected either the trial to end today (ruling in favor of the DT's motion/s) or for it to continue (ruling in favor of the State), not some amalgamation thereof. So disappointed that the judge has allowed the mitigation/sentencing phase to become something other than a sentencing phase--if I understand correctly these issues are related to the guilt phase and should be addressed through appeals, right????

I cannot imagine what the jury is thinking about this testimony--they have to be very confused at this point. This trial is scrambling my brain SMH. Honestly, I am so over all of this.

I am really disappointed. Especially with allowing the DT to go so far towards appeal issues that have nothing to do with mitigation.

I seem to recall judges in other cases that would stop testimony if the attorneys stray off topic as to the purpose of what they are trying to accomplish. That never happens here in this phase and I am extremely disappointed.

-no Transcript
-no ruling on DP
-other witnesses not allowed to have Juan cross them and we go to brand new witnesses
-other witnesses not done yet and we have new witnesses
-jury questions not allowed yet on these other witnesses

What is going on? There needs to be some control back in this courtroom and fast. There is mass confusion and the jurors must be totally lost by now.

Maybe JSS said she couldn't see the relevance of all this to posecutorial misconduct, so now Wilmott is attempting to show why? So confused by all of this.

IIRC, JSS said she would rule about various motions "by Monday." I don't remember if she gave a time, but I guess she has until 4:30 to rule and have it still be Monday.

I'm changing my mind.

Because this testimony clearly points to DT attempting to prove prosecutorial misconduct -- I don't think it has any other obvious relevance -- JSKS hasn't yet decided how she'll rule on the motion.

But if that's the case, why is she doing it in front of the jury? It doesn't make sense, unless DT is just fishing because they doesn't have any more witnesses but want to waste time.

Willmott gets to point where Flores provided a cord to defense attorneys in 2009 to power up Alexander computer. Says he did not turn it on.

Seems like we have heard all this before, but the jury has not. Maybe "🤬🤬🤬🤬" is coming in?

Judge said she's allowing the defense to present this stuff now because it didn't come up before. Like hope said, she's righting any perceived wrongs.

1)when you touched the computer with a pen, had you heard Jodis 8th version of what happened where she suddenly accused him of being addicted to 🤬🤬🤬🤬 so you thought you better hid it all?

2)does 🤬🤬🤬🤬 on a lap top change the fact that she admitted on the stand that she killed him

3) is "he looked at 🤬🤬🤬🤬" a new defense for 1st degree murder

But they already knew they had a witness lined up for today. Was it always going to be Detective Flores?
